Pleading: John Chisull, executor of John Waldeve, states that on 20 July 1433 John Harleston made two bonds with John Waldeve the testator, each in £20, but has not paid JW, or JC as his executor, or JW's widow Elizabeth or Andrew Smyth, his co-executors, now deceased, to his damage of £40. He shows the bonds in court, and the testamentary letters of JW by which he, Elizabeth W and AS had executry and administration.
Pleading: JH states that, regarding £20 of this £40, during his life, by a document which he shows in court, dated at Wimbish on 20 July 1434, JW the testator, as JW of Little Bardfield, acknowledged payment of this £20 in the presence of Thomas Prior and other tenants of JH. And concerning another £10 of this sum, he states that, by a document which he shows in court, dated at Little Bardfield on 12 June 1434, JW, as JW of Little Bardfield, again acknowledged receipt of this £10 from JH, by the hands of Richard Hoghton. And regarding the remaining £10, he states that Elizabeth Waldeve, co-executor of JC and widow of JW, by another document which he shows in court, dated on 1 November 1437, as EW of Thaxted, acknowledged receipt of this £10 from JH by the hands of Henry Purlond, rector of Chevington.
Pleading: JC states that the release for £20 was not made of JW the testator. Parties on country. And concerning the other two releases, he states that they are not sufficient in law to preclude him from his action on the other £20 of this £40, and seeks judgment, the £20 and damages.
Pleading: JH states that regarding the £20 relating to the two £10 releases, the two releases are sufficient to preclude JC from his action on that £20, and JC has not denied the releases nor made any response, and he therefore seeks judgment and that JC be precluded. Justices wish to be advised, day is given at the octave of Michaelmas. Concerning the first £20, sheriff of Essex to have jury of Wimbish here at the same term.
