Boston Port.

A BILL for repairing the Port and Haven of Boston, was read the Second time.

Resolved, &c. That the Bill be committed to Sir Anthony Irby, Mr. Cheney, Mr. Henley, Colonel Reames, Mr. Crouch, Mr. Hobby, Sir John Newton, Sir Char. Harbord, Mr. Mervell, Mr. Hungerford, Sir Tho. Higgons, Colonel Proby, Mr. Weld, Sir Hugh Windham, Mr. George, Sir Rich. Francklin, Sir Robert Carr, Sir John Lowther, Mr. Morrice, Sir John Hanmer, Sir Will. Coventry, Sir Rowl. Berkley, Sir Edw. Mr. Speaker, My Lords have returned you Two Bills, the One intituled, An Act for making of the Church, erected at Falmouth, a Parish Church; the other, An Act to prevent the malicious burning of Houses, Stacks of Corn and Hay, and killing and maiming of Cattle; with some Amendments: To which they desire the Concurrence of this House.

Duffeild Frith.

Sir John Brampston reports from the Committee to which the Bill concerning the Manor of Duffeild Frith, in the County of Derby, was committed, one single Amendment only agreed by the Committee:

Duke of Albemarle's Estate.

A Bill, sent from the Lords, intituled, An Act to enable Christopher Duke of Albemarle to re-convey several Manors and Lands, mortgaged to George late Duke of Albemarle his Father, was read the Second time.

The House then, according to former Order, did proceed to the Hearing of the Matter between Sir John Prettyman and Mrs. Humes.

And the Petitions on both Sides being again read; and the Counsel for Sir John Prettyman, and the Parties and Witnesses on both Sides, being heard; it being made appear, on the Behalf of Sir John Prettyman, that he had, since the last Recess, used his utmost Endeavour to apprehend and bring in Humes, the Husband of Mrs. Humes; and nothing of the Suggestions of Mrs. Humes her Petition being made out; upon Debate of the Matter;

Resolved, &c. That Sir John Prettyman be restored; and have his Privilege, to attend the Duty of his Place, as a Member of this House.

Supply.

The House then resolved into a Committee of the whole House, to proceed in the further Consideration of his Majesty's Supply.

Resolved, &c. That the House be resolved into a Committee of the whole House To-morrow Morning, Ten of the Clock, to proceed in the further Consideration of his Majesty's Supply.

Privilege- Jekell's Prosecution of King.

Whereas the House, upon the One-and-twentieth of this Month, did hear the Cause between Mr. Jekell and Sir Andrew King, and the rest of the Lieutenancy of the City of London, concerning their imprisoning the said Mr. Jekell; and passed a Vote therein, "that the Commitment of the said Mr. Jekell was, in order to the Preservation of the King, and Peace of the Kingdom:"

An Information being now given to the House against Mr. Jekell, . . ., notwithstanding the said Vote of this House, and that the same was served on his Attorney, doth, in Contempt of this House, proceed in his Suit at Law against the said Sir Andrew King; and hath procured an Order in the Exchequer this Day, upon the Motion of Mr. Burton; for Return of a Jury, in order to the Trial of the said Cause: A Copy of which Order was produced and read:

Resolved, &c. That Mr. Jekell, be sent for in the Custody of the Serjeant at Arms attending this House, to answer his Contempt, in prosecuting his Suit at Law against Sir Andrew King, one of the Lieutenancy of the City of London, in the Exchequer, after the Vote of this House passed the One-and-twentieth of this Month; whereby it was declared, that the Commitment of the said Mr. Jekell was in order to the Preservation of the King, and Peace of the Kingdom.

That Mr. Burton, Counsel for Mr. Jekell, be sent for in Custody of the Serjeant at Arms attending this House, to answer his Contempt, in moving on the Behalf of Mr. Jekell, in the Exchequer, after the Vote of this House passed the One-and-twentieth of this Month; whereby it was declared, that the Commitment of Mr. Jekell was, in order to the Preservation of the King, and Peace of the Kingdom.

That Mr. Ogden, Attorney in the Exchequer for Mr. Jekell, be sent for in Custody of the Serjeant at Arms, to answer his Contempt, in acting on the Behalf of Mr. Jekell, in the Exchequer, after the Vote of this House passed the One-and-twentieth of this Month; whereby it was declared, that the Commitment of Mr. Jekell was, in order to the Preservation of the King, and Peace of the Kingdom.
