Malignant Ministers.

Ordered, &c. That the Report of the Ordinance for Restraining of Malignant Ministers from Preaching, or being admitted into any Living, be made on Monday next.

Message to Lords.

Colonel Birch carried to the Lords an Ordinance for granting unto Anthony Berrowe Gentleman, a Rent-charge of Fifty Pounds per Annum, out of the Manor of Sutton St. Michaell, Part of the Estate of Henry Lingen, of the County of Hereford, Esquire: And was to put the Lords in mind of an Ordinance, formerly sent to them, concerning a Debt of Four thousand Pounds, due to Sir Humfrie Tracie, a Delinquent, from Henry Poole Esquire, a Delinquent, granted to the City of Gloucester, &c.: Was further to put the Lords in mind of an Ordinance, formerly sent to their Lordships, for the better regulating the University of Oxon.

Message from Lords.

A Message from the Lords, by Dr. Aylett and Dr. Heath;

The Lords have commanded us to deliver unto you a Vote concerning the Removal of the King's Children into the Country for some Part of this Summer: An Ordinance for appointing Justices of the great Sessions for North Wales and South Wales.

King's Children.

The Vote concerning the Removal of the King's Children into the Country for some Part of this Summer was read; and, upon the Question, assented unto; and was in hæc verba; viz.

"The Earl of Northumberland desiring to know the Pleasure of the Houses, whether they thought it not fit to have the Duke of Yorke, and the King's other Children, remove into the Country, for some Part of this Summer; the House of Peers do hold it convenient, that they be removed to some of the King's Houses near London; and have appointed Hampton Court, or such other of the King's Houses thereabouts, as the Earl of Northumberland shall make Choice of for that Purpose: And desire the Concurrence of the House of Commons."

The Ordinance for appointing Justices of the great Sessions of North Wales and South Wales was read; and was in hæc verba; viz.

It is this Day Ordered and Ordained, by the Lords and Commons, in Parliament assembled, That it be referred to the Commissioners for the Great Seal of England, to nominate and appoint fit Persons to be Justices of the Great Sessions for North Wales and South Wales; and to give Warrant to the Clerk of the Crown in Chancery, to draw several Patents, according to the usual Form, for them respectively to exercise their said several Offices quam diu bene se gesserint: And that the said Commissioners pass the said Patents under the said Great Seal accordingly, whereupon they are hereby authorized."

The Ordinance was, upon the Question, assented unto; with altering the Words "quam diu bene se gesserint," into "quam diu nobis placuerit:" And Mr. Recorder is appointed to carry it to the Lords.

Message from Lords.

A Message from the Lords, by Dr. Aylett and Dr. Heath;

The Lords have commanded us to return unto you a Declaration concerning the continuing of the Grant of the Excise no longer than the Five-and-twentieth of March, to such Towns, Cities, and Counties, respectively given them: It moved first from this House: The Lords have agreed unto it, with one small Amendment.

The which was read; and upon the Question, assented unto: And was, That, in the 6th Line, after the Word "them," these Words "with or" be added.

Excise.

And then the Order or Declaration, thus amended, runs in hæc verba; viz.

"The Lords and Commons, assembled in Parliament, do Declare, That the Time when the Grant of Excise shall determine to such Towns, Cities, and Counties, as have the whole Excise of the said Towns, Cities, and Counties, respectively given them, with or without Limitation of Time, shall be the Five-and-twentieth Day of March next: And that all such Counties, Cities, and Places, as have the Moiety or any other Proportion of the Excise granted unto them in Kind, either with Limitation, or without Limitation of Time; the Time for Continuance of such Grant shall be until the Five-and-twentieth Day of March next, and no longer; And the Commissioners of Excise, London, are to take Notice of this Declaration; and to give Direction to their Sub Commissioners, in all Places, to receive the whole Excise within their respective Limits; and make due Returns, from time to time, of all Monies thereby raised, and to be raised, and accruing, unto the Grand Office of Excise, London.

Answers to Lords.

An Answer returned to the First Message, by the same Messengers; That this House hath considered their Lordships Message; and do agree to the Vote concerning the Removal of the King's Children into the Country, for some Part of this Summer: As for the Order for appointing Justices of the Great Sessions of North Wales and South Wales, they will speedily send Answer by Messengers of their own.

Answer returned to the Second Message, by the same Messengers; That this House hath considered their Lordships Message: And, as to the Amendment to the Declaration concerning the Excise, they do agree.

Privilege.

Colonel Leigh reports from the Committee appointed to consider of such Persons as preach, not being authorized, the Carriage of some Persons towards that Committee; that there was such Behaviour in some of them, that the Committee, to prevent greater Inconveniencies, did restrain one of them, one Mr. Tew, till the further Pleasure of the House were known.

Resolved, &c. That the House doth approve of the Action of the Committee in the Restraining of Mr. Tew, till the further Pleasure of the House were known.

Resolved, &c. That Mr. Tew be committed to the Custody of the Serjeant at Arms attending on this House, there to remain during the Pleasure of this House.

Resolved, &c. That Major Tyllydah be forthwith sent for, and taken into Custody, as a Delinquent, by the Serjeant at Arms attending on this House.

Assessments.

Ordered, &c. That, To-morrow Morning, the first Business, the Ordinance for Assessments towards the Maintenance of the Forces of England, and the Forces in Ireland be read.

Great Seal.

Ordered, &c. That the Report concerning the Great Seal, be made To-morrow Morning.

Radnor County Writ.

Ordered, &c. That a Warrant shall issue forth under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, for issuing a Writ, for the Electing and Returning of a Knight of the Shire, to serve for the County of Radnor, in the room and place of Charles Price Esquire, disabled and deceased.

Radnour Borough Writ.

Ordered, &c. That a Warrant shall issue forth under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, for issuing a Writ, for the Electing and Returning of a Burgess to serve for the Borough of Radnour, in the room and place of Philipp Warwicke Esquire, disabled by Judgment of this House.
