Whereas the pope, under date 16 Kal. May, An. 5, granted the petition of the bishop of Winchester on behalf of his treasurer, John de Blebury, for the canonry and prebend of Beverley, void by the death of Richard de Fereby, notwithstanding that he had the church of Brightewelle, and at the instance of the said John committed to a papal auditor the hearing of his cause against a certain Andrew, who had surreptitiously obtained the said canonry and prebend from Clement VI. and whereas the papal letters of provision of the same to John remain, at Andrew's instance, impounded in the papal chancery, so that Andrew obtained a sentence in his favour against John, who appealed to the pope, on which the cause was committed to another papal auditor, the pope is informed that Andrew then held a dignity with cure of souls, a church, three prebends, and had two expectations of dignities, offices, canonries, and prebends in York and London, whose value amounts to 5000 florins, and is prayed to order the said letters of provision to be expedited and sealed, or at least the appeal to be heard, the king of France having petitioned that information should be given touching the retention of the letters, which petition the pope granted viva voce.

Whereas the pope committed to a papal auditor, Master Aymeric Hugonis, the causes which John Hauk had against Thomas de Thorp, rector of Bradewater, in the diocese of Chichester, William Scordy, called ‘de Velgheten,’ priests, Thomas de Watton, clerk, and Juliana Yong, a nun, and others, touching spoliations, imprisonments, and other injuries suffered by him, and whereas the auditor excommunicated the said priests and clerk for contumacy in not appearing, the nun and the laymen being left out of the cause, and whereas John thereupon prayed that the said persons, who remained contumacious for five months, should be cited to the Roman court, the auditor, on the ground of insufficient powers, refused this prayer, whereupon the said persons and Juliana pursued John in a lay court, where excommunication is not recognised: he therefore prays the pope to order the said auditor, or his substitute, to proceed against the said excommunicate persons and Juliana, and to call in the aid of the secular arm, punishing them for their seizure of his benefices and for their contumacy.
