408 MANWOOD V ELLIS

Jasper Manwood, esq v John Ellis, gent

April 1636 - February 1639

Abstract

The cause of Manwood's complaint against Ellis remains unknown; however, the proceedings record that depositions were taken from his witnesses which he was due to publish in June 1636 and sentence was ordered for the Easter Term of 1637. No indication of sentence survives, but in November 1638 £20 in costs was awarded against Manwood and he was still being pursued for these in February 1639. [For Ellis's counter suit, see cause 190].

Summary of proceedings

Dr Duck acted as counsel for Manwood and Dr Eden and Dr Talbot for Ellis. After early proceedings in April and May, in June 1636 Manwood was required to publish the depositions of his witnesses. There were further proceedings on 8 November. On 28 January 1637 it was decided that sentence was to be heard in the first session of Easter term. On 20 November 1638 it was decided that Manwood should pay £20 for expenses and, again on 23 February 1639 Dr Talbot sought £20 from Manwood for expenses and the decision was referred to Lord Maltravers.

Notes

In April 1638 Jasper Manwood was among the commissioners appointed to investigate frauds of fir timbers and deal boards imported into England.
