Writ type: Trespass (force and arms)
Damages claimed: £100
Case type: Detention of goods; Taking of goods
Pleading: William Langton, brother and executor of William Gray, states that on 8 September 1462 Henry Johnson forcibly took and carried away various goods and chattels worth £40 and two bonds formerly belonging to WG and in his custody as executor in London, against the peace and to his damage of £100. The goods consisted of 369 dried fish called 'lyngefyssh', 80 fish called keelings, a blue gown lined with beaver fur, one striped gown, one green gown, another blue gown, a black cap, a feather bed with bolster, two pillows, two bedspreads, five pairs of linen sheets, a large hanging bed with a tester and three curtains of blue buckram, three tablecloths, three towels of worked diaper and one candlestick. One of the bonds recorded that Richard Semer was bound to WG in £12, while the other recorded that Richard Ryvet was bound to WG in £8. WL shows in court the testamentary letters of WG, by which he is executor and has administration.
Pleading: HJ denies force and arms; parties on country. Concerning the rest, he states that WL ought not maintain his action, since before the alleged trespass, WG possessed all these goods and the two bonds, and thus possessed he made his will in the parish of St Dunstan in the East in London, which lies in the diocese of Canterbury. By this will, he made both HJ and WL his executors. He then died, and the will was proved before master Roger Radclyff, dean of St Mary le Bow and commissary general of Thomas, archbishop of Canterbury within that diocese, and administration granted to both HJ and WL. By this, WL, as executor of the will, took possession of these goods and bonds in the parish of St Dunstan in the East and took them to the parish of St Magnus, and HJ, finding them there, as fellow executor took them out of WL's possession and carried them away, as seemed right.
Pleading: WL, not acknowledging anything said by HJ, states that WG made his will in Newcastle upon Tyne, and made WL his sole executor. He then died, and since he left goods and chattels in various dioceses, that will was proved at Water Lambeth in Surrey before Thomas, archbishop of Canterbury, and administration of his goods and chattels was granted to WL, by virtue of that will. By virtue of this, WL took the goods and bonds, and had them in his possession until HJ took them and carried them away. WG did not make them both his executors, as HJ has claimed, and he seeks judgment and damages.
Pleading: HJ repeats that WG made both WL and HJ his executors, as he claimed. Parties on country, jury here at octave of Michaelmas.

Case type: Debt; Real action / rents / damage to real estate
Pleading: Nicholas Boylee, Nicholas Boyle, Ralph Lambourne, Germanus Lynche, Patrick Moole and Robert Lancastre state that on 11 March 1461, one John Poleyn, former prior of the hospital of St Mary without Bishopsgate, predecessor of the defendant, and the convent of that house, in the parish of St Leonard Shoreditch, by an indented document which they show in court, sealed by the then prior and convent, granted to the plaintiffs an annual rent of 8m in the church of the hospital of St Anthony in London, payable from Easter then next during the natural life of the said JP at the feasts of Pentecost, St Peter ad Vincula, All Saints and the Purification. If it is in arrears, then the plaintiffs may enter the hospital's lands in the parish of St Botolph without Bishopsgate and distrain goods and keep them until the sum is paid. The prior and convent also granted that the plaintiffs may have a corrody within the priory [details of food and drink given], and a house which John Langton formerly inhabited, situated between a house called the Childe[…] [damaged] within the said hospital to the north and the messuage where Thomas Huswyff then lived to the south, which the prior and his successors were to repair and maintain for the life of the said prior. They were to hold this corrody and the messuage for the natural life of the former prior, with free entry and exit to the messuage. To guarantee this, the former prior and convent obliged themselves and their successors to the plaintiffs in 100m. By virtue of this grant, the plaintiffs were seised of the 8m annual rent, the messuage and the corrody in their demesne as of free tenement. Then, before the date of the plaintiffs' original writ, namely 20 March 1461, the former prior resigned his priory into the hands of Thomas, bishop of London, as ordinary of that place, to which the bishop agreed, and the former prior was exonerated from the status of prior. Later, before the date of their original writ, the present prior was elected, but JP was still alive. Since 26s 8d of the 8m rent, due at the feast of the Purification 1462, remains unpaid, it seems to the plaintiffs that they should have the 100m due to them by the agreement. They acknowledge satisfaction of 40m of this, but the present prior has not paid the remaining £40, to their damage of £40.
Pleading: The present prior is granted licence to imparl to octave of Michaelmas, with assent of plaintiffs.

Case type: Bond; Real action / rents / damage to real estate
Pleading: John Colman states that on 29 January 1440 Richard Colewyke, now deceased, made a bond with him in London in £10, payable at Easter then next. However, RC did not pay JC, and nor has his executor Henry Trecarell, to his damage of 10m. He shows the bond in court.
Pleading: Henry Trecarell asks to hear the bond and endorsement, and these are read in court. The condition of the bond is such that if JC, his wife Alice and Thomas Plowemaker should peacefully possess a certain tenement in 'Corviserstrete' (now Fish Street) in Worcester, next to the church of St Alban, and a parcel of land next to that tenement, according to the form of a charter made to them by RC, without any trouble or claims from Alice, wife of RC, then the bond shall be cancelled. Having heard this, HT is granted licence to imparl to octave of Michaelmas, with assent of plaintiff.
Pleading: [continued at Michaelmas 1463, rot 245] HT adds that JC ought not have his action, since he has fully administered all the goods and chattels formerly of Richard Colewyke on the day of his death, namely in Worcester, and has nothing left except 12d, and had nothing on the day of the plaintiff's original writ.
Pleading: JC states that on the day of his original writ, namely [omitted, but king named as Edward IV], HT had various goods formerly of RC still in his hands to the value of the debt, from which he could have been satisfied, namely at [omitted]. Enquiry by country, sheriff of Worcestershire to have jury here at octave of Hilary.

Pleading: [continued at Easter 1464, rot 302] RR seeks to hear the bond and this is read to him [recited in full, in Latin], stating that RR and a certain William Marchaunt were bound to RB in the stated terms. He also seeks to hear the condition of the bond, and this is also read [recited in full]. The condition of the bond is such that if RR and WM should, in the church of the Minoresses without Aldgate in London, pay RB or his attorney 13s 4d at the said feast of St John the Baptist, and 13s 4d at the following Michaelmas, 13s 4d at Christmas, 13s 4d at Easter, 13s 4d at the Nativity of St John the Baptist and 13s 4d at Michaelmas, or if they should pay 13s 4d at the aforesaid Nativity of St John the Baptist (1462), and 4m at the following feast of St Simon and St Jude (28 October), then the bond shall be cancelled. But if they default in any of these payments, in part or in full, then the bond shall stand. Having heard and understood this, RR states that RB ought not maintain his action, since he paid RB the six instalments of 13s 4d due at the feasts as required, in the church in the parish of St Botolph without Aldgate.
Pleading: RB, protesting that RR did not pay him any of the money specified in the endorsement, states that RR did not pay him the 13s 4d due at Christmas 1462, as stated in the endorsement. Enquiry by country, jury of St Botolph without Aldgate here at the morrow of Ascension.
