Case type: Real action / rents / damage to real estate
Pleading: Margaret Stokes, prioress of St Helen's, Bishopsgate, was summoned to answer Henry Frowyk and his son Thomas that she abide by an agreement made between them regarding the manor of Boston ('Burston') and it's appurtenances, which she demised to them for a term of 3 years. They state that MS and the convent of St Helen's, by an indenture made between them and the plaintiffs in the parish of St Ethelburga in London, of which they show in court the part sealed with the common seal of the house, dated in the chapter house on 10 November 1446, demised to HF and TF the manor of Burston with appurtenances, along with two messuages and the reversion of a third in West Brentford which William Symond holds for a term of 14 years by an earlier demise, to hold from Michaelmas 1446 for a term of three years, at an annual rent of 11m to the prioress and 5s ¼d to the Abbot of Westminster. After this term, they may hold it for a further 80 years, at the same rents. They are to permit the priory's steward to hold his court there each year, although HF and TF may take the profits of the court. If the rent is ever in arrears by one month, the priory may distrain goods to that value, and if no distraint can be had within half a year, then the priory may re-enter the property. By this demise, HF and TF held this property until 1 December 1446, when William Symonde, on the pretext of an earlier demise, entered the manor and ejected them, and despite their complaints the prioress and convent have not reinstated them in their tenure, to their damage of £100.
