Capt. Hovell & al. Officers of Guernsey, Petition for Arrears.

Upon reading the Petition of Captain Thomas Hovell, &c. Officers of the Isle of Guernsey; desiring "they may have some of their Arrears paid them."

It is Ordered, To be specially recommended to the House of Commons, that some Course may be speedily taken for their Relief.

Zouch and the Tenants of Woking.

The House took into Consideration the Cause (fn. 1) between the Tenants of Woking, in the County of Surrey, and Mr. Zouch.

And the Question being put, "Whether the said Cause shall be dismissed this House before their Lordships be certified whether a Bill of Review will lye, or not?"

And it was Resolved in the Affirmative.

Answer from the H. C.

Doctor Aylett and Doctor Heath return with this Answer:

That they agree to the Alteration in the Declaration concerning the paying of the Money to the Scotts raising by the Ordinance for Sale of the Bishops Lands: To the rest, they will send an Answer by Messengers of their own.

Maintenance for the D. of York.

The Earl of Northumb. informed this House, "That whereas formerly he was a Suitor to both Houses, that some Maintenance might be settled for the Duke of Yorke, when he was committed to his Care; for Want of which Maintenance, his Lordship is put to many Inconveniencies in raising of Monies for his Maintenance: Therefore desires that some Course may be taken for settling a Revenue for his Maintenance, or else that he be put into some other Hand."

Message to the H. C. about it.

Ordered, That this be specially recommended to the House of Commons; and accordingly a Message was sent down for this Purpose, by Doctor Aylett and Doctor Heath.

Message to them, about the following Particulars.

A Message was sent to the House of Commons, by Doctor Aylett and Doctor Heath:

1. To deliver Captain Thomas Hovell' Petition to them, with special Recommendations.

2. To desire their Concurrence for making Robert Beck Gunner of The Providence, and Richard Loane to be Gunner of The Fellowship.

3. To deliver to them the Ordinance concerning Gouldsmithes Hall, and desire their Concurrence therein.

4. To deliver to them Mr. Hubert' Petition, with Recommendations.

5. To deliver them the Petition of the Lord Edward Pawlett.

6. To put them in Mind of Mrs. Hawkins' Petition for releasing of her Husband in Dartmouth, being there imprisoned for the Parliament.

Writs of Error brought in.

This Day Mr. Justice Bacon, Senior Judge in the Court of King's Bench, acquainted the Speaker, "That he had several Writs of Errors to bring into this House."

And the Speaker signifying so much to this House, the said Mr. Justice Bacon was appointed to bring them in; which accordingly he did.

Report of the Conference on the Ordinance for Sale of Bishops Lands.

The Speaker reported the Effect of the Conference with the House of Commons on Saturday last, concerning the Alterations in the Ordinance for the Sale of the Bishops Lands:

"That they adhere for the putting of John Blackwell, Rob't Fenwicke, and Edward Cressett, as it came in the Ordinance from the House of Commons.

"They agree with their Lordships to the adding of Alderman Vyner, Colonel Ric. Turner, James Russell, and Wm. Methold.

"In the 2 Mem. 48 Line, they desire the Quorum may be made ["Six"] instead of ["Five"].

"In the 2 Mem. 50 Line, they adhere to the Word ["Register"], and not to be made ["Registers"].

"In the 2 Mem. 59 Line, they agree not to the Alterations; but adhere to the Ordinance as it was sent up.

"They agree to the Alteration in the 4th Mem. 20 Line, and 21 Line, and 32 Line, and 42 Line, and 47 Line.

"They agree not to the Alterations in the 6 Mem. 6 Line, and 7 Line, and 14 and 15, and 22 and 25, and 28, 29, and 35; but adhere as it came up from the House of Commons.

"They desire the Words ["4d."], in the 35 Line, may be made but ["3 d. the Sheet"].

"To the Alteration in 6 Mem. 38th Line, they adhere to the Ordinance as it came up.

"To the Alteration in the 8 Memb. 1 Line, they agree to it.

"To the Alteration in the 10 Memb. in the 2d Instruction, they agree not to it; but adhere to the Ordinance as it came up.

"They agree to the Proviso concerning Ser'ts Inne, with the Addition.

"They agree to Proviso concerning the Surveyors, but not to the Alterations in the Instructions for (fn. 2) the Contractors; and they do not agree to the Altera tions in the Instructions for the Register, but adhere as it came up from the House of Commons."

And the Question being put, "Whether to agree to all the Alterations in the Ordinance for the Sale of the Bishops Lands, as they are now brought up from the House of Commons?"

And it was Resolved in the Affirmative.

Instructions for Contractors for Bishops Lands.

Next, the House took into Consideration the Alterations in the Instructions for the Contractors, for altering Ten Years Purchase, to be reduced to the Rate of Eight Years Purchase.

Resolved, upon the Question, That this House adheres to the Rate of Eight Years Purchase for the Sale of the Bishops Lands.

Ordered, To have a Conference with the House of Commons presently, to let them know, that this House conceives that the Rate of Eight Years Purchase will much advance and expedite the Sale of the Lands of the Bishops; and to acquaint them, that this House agrees with them in all the Alterations in the Ordinance for selling the Bishops Lands, their (fn. 3) Lordships being willing to further that Business, which is of so great Importance to the State.

Message to the H. C. for a further Conference about this Business.

A Message was sent to the House of Commons, by Doctor Aylett and Doctor Heath:

To desire a present Conference, concerning the Matter of the late Free Conference, concerning the Ordinance concerning the Sale of the Bishops Lands, in the Painted Chamber.

Fisher to be instituted to Sulgrave.

Ordered, That Doctor Heath shall give Institution and Induction to Ric'd Fisher Master of Arts, to the Vicarage of Sulgrave, in North'tonshire; presented to it by Mr. Ambrose Holbech the Patron; with a salvo Jure cujuscunque.

Sedgwick's Ordinance to be Rector of Tingwick.

An Ordinance was read, for making Mr. Steven Sedgwicke to be Rector of Tingwick, in the County of Bucks; and Ordered, To be respited until the Lord Viscount Say & Seale shall further inform this House concerning the Title of New Colledge in Oxon to the Presentation of the said Living.

Ordinance about the Exchequer of Chester.

An Ordinance was brought into this House, concerning the Exchequer of Chester; which was read, and Ordered to be sent down to the House of Commons for their Concurrence.

Webb's Ordinance to be Vicar of Ogborne.

An Ordinance was brought into this House, for presenting Mr. Barthol. Webb to the Vicarage of Ogborne-Andrewes, in the County of Wilts, (fn. 3) void by the Death of Mr. Sedgwicke late Incumbent, it being formerly in the Gift of the Dean and Chapter of Windsor; and being read, it was Agreed to, and Ordered to be sent to the House of Commons for their Concurrence.

Johnson's Order.

The Ordinance for Twenty Pounds to Ric. Johnson, for bringing News of the Surrender of Banbury, was read, and Agreed to. (Here enter it.)

Heath and Curtis.

The Order to pay Twenty Pounds to Heath and Curtys, Messengers from Ragland, was read, and Agreed to.

Capt. Thompson's Petition, for 360£. Arrears.

The Petition of Captain Sam. Tompson, was read; desiring "that the Sum of Three Hundred Sixty Pounds with Interest, due to him as his Arrears for his Service to the Parliament, may be paid him, out of the Composition of some of those Delinquents arising out of those Six Counties, who are come to compound for their Estates at Gouldsmithes Hall."

And it is Ordered, To be recommended to the House of Commons.

Johnson versus Nason, in Error.

Ordered, That the Errors between Johnson versus Nason shall be argued, by Counsel at this Bar, the 3 Dec. next, at Ten of the Clock in the Morning.

Answer from the H. C.

Doctor Aylett and Doctor Heath return with this Answer from the House of Commons:

That they will give their Lordships a Free Conference, presently, as is desired: To all the rest, they will give an Answer by Messengers of their own.

Heads for the Conference about the Ordinance for Sale of Bishops Lands.

The Speaker, at this Conference, is to let the House of Commons know, "That this House hath passed the Ordinance concerning the Sale of the Bishops Lands, according to the Alterations delivered at the late Conference, to shew their great Desires to hasten a Business of that great Concernment: But their Lordships hope that Alderman Foukes may be taken into further Consideration for the future, he being a Person that hath deserved so well of the Parliament, in regard the Comptroller of the Excise hath Five Hundred Pounds per Annum allowed him for his Salary, and his inferior Clerks allowed Salaries besides, and yet doth not so much Business as will lye upon Mr. Alderman Foukes."

Message to the H. C. with an Ordinance; and about the D. of Buck's Petition.

A Message was sent to the House of Commons, by Doctor Aylett and Doctor Heath:

1. To deliver to them the Ordinance concerning the Exchequer at Chester, and desire their Concurrence therein.

2. To put them in Mind of the Petition of the Duke of Bucks.

Adjourn.

The Lords went to the Conference; and the House was adjourned till 10a cras.

Order for 20£. to Johnson from Banbury.

"Ordered, by the Lords and Commons assembled in Parliament, That the Committee of Lords and Commons for Advance of Monies at Habberdashers Hall do forthwith pay unto Richard Johnson, the Trumpeter that brought the News of the Surrender of Banbury Castle, Twenty Pounds, bestowed upon him for this and other Services."

Order for 20£. to Heath and Curtis from Ragland.

"Ordered, by the Lords and Commons assembled in Parliament, That the Sum of Twenty Pounds be bestowed upon Mr. Heath and Mr. Curtys, that brought the News of the Taking of Ragland Castle, and equally divided betwixt them; and that the Committee of Lords and Commons for Advance of Monies sitting at Habberdash'rs Hall do pay the said Twenty Pounds to the said Messengers accordingly."

Declaration for Payment of 200,000£. to the Scots.

"Be it Declared, by the Lords and Commons in Parliament assembled, That the First One Hundred Thousand Pounds which shall be raised, either by the Sale of Bishops Lands, or by the Credit of the Ordinances which are passed for that Purpose, shall be paid to our Brethren of Scotland, upon the marching of their Army and Forces out of this Kingdom, at such Time and Place as shall be agreed upon; and the next Fifty Thousand Pounds so raised at the End of Three Months after the former Payment; and Fifty Thousand Pounds more, raised as aforesaid, at the End of Nine Months after the First Payment: But in case the latter One Hundred Thousand Pounds shall be with more Speed procured, the same shall be sooner paid unto them, although there be no Engagement for a more speedy Payment than at the Times formerly expressed."
