Die Lunæ, 3 Julii, 1643.

PRAYERS.

Restoring Horses.

RESOLVED, &c. That the Horses belonging to Mr. Lancelot Lake, seized by some Officers of Colonel Marten, by Warrant or Commission from Colonel Marten, be forthwith restored: And the particular Officers, or others, in whose Charge or Custody they are, are hereby streightly enjoined and required to deliver and restore the said Horses: And the House doth intend to take this Business into further Consideration.

Person sent for.

Resolved, &c. That Captain *, who seized the Horses of Mr. Lancelot Lake, and affronted and abused Mr. Recorder, a Deputy Lieutenant, be forthwith sent for, as a Delinquent.

Affairs at Hull.

A Letter from the Committee at Lincolne, of the First of July; and a Letter inclosed, from the Committee at Hull; concerning the securing the Persons of Sir Jo. Hotham and Captain Hotham, by those of Hull; were this Day read.

Upon the Occasion of these Letters, Mr. Pym reported from the Committee for the Safety of the Kingdom, that Mr. Hatcher and Sir Wm. Strickland, Members of this House, the Mayor of Hull, and Sir Matthew Boynton, be nominated and appointed Committees, entrusted with as full Power for the Safety and settling the Town: And that the executive Part of commanding over the Soldiers be entrusted with Sir Mathew Boynton:

Ordered, That Sir Wm. Strickland, Mr. Hatcher, Members of this House, the Mayor of the Town of Hull, and Sir Mathew Boynton, shall be appointed and nominated Committees for the Government of the said Town; and that Sir Wm. Strickland and Mr. Hatcher be enjoined forthwith to go down to provide for the Safety of the said Town, together with the rest of the Committee.

Resolved, That Sir Mathew Boynton shall be appointed Colonel of the Garison in that Town, to be ordered by the Advice and Consent of the rest of the Committee.

Resolved, &c. That the Lords Concurrence be desired herein: and that his Excellency the Earl of Essex be desired to grant a Commission to Sir Mathew Boynton to be Colonel of those Forces, in manner as aforesaid.

Resolved, &c. That both the Burgesses, that serve for the Town of Hull, shall be added to the Committees of Hull.

Assembly of Divines.

Resolved, &c. That Mr. Nye, one of the Divines of the Assembly, shall, upon some urgent Occasions, be dispensed with for his Attendance upon the Assembly, for some time.

Cholmeley's Goods.

Ordered, That the Committee appointed for the Safety of Hull do restore unto Sir H. Cholmeley such Goods of his as were seized by Sir Jo. Hotham the late Governor of that Town.

Judicial Appointment.

Ordered, That an Ordinance be prepared, and brought in, to require and enjoin Sir H. Compton to nominate such a Person to the Place of Prothonotary, in the Place of Mr. Gulston, as this House shall appoint; and for the constituting of the said Person, so nominated, to execute the said Office, and to receive the Perquisites thereof: And likewise, to provide that no Judge or other publick Officer, now residing with or about the King, shall bestow any Place or Office belonging unto him, or any of them, or in their Gift; and that, if they shall, the House will put them out: And that such as have been put in since the King went from the Parliament shall be put out.

Mr. Hill, Mr. Strode, and Mr. Prideaux, are appointed to prepare an Ordinance to this Purpose.

Message to Lords.

Mr. Noble is appointed to carry up to the Lords the Ordinance for the Excise, together with the Schedule annexed: He is likewise to desire a Conference, upon some Information from Hull and Lyncolne.

Restoring a Horse.

Ordered, That Captain Rich, and his Officers, or such others, in whose Custody the Horse of Mr. Baker is, do forthwith restore the said Horse to Mr. Baker.

Affairs in Shropshire.

Ordered, That the difference between Sir Jo. Corbett and the Gentlemen of Shropshire be referred to the Consideration of the former Committee for Shropshire Business.

Preacher appointed.

Ordered, That Mr. Newcomen be desired and nominated to preach on Friday next, at the Fast, in the room of Mr. Gattacre, who is unable to perform it, by Indisposition of Health.

Member admitted.

Upon a Report from the Committee for Absent Members, it is Ordered, That Sir Jo. Lee be forthwith admitted into the House.

Colonel Washbourne.

Resolved, &c. That Lieutenant Colonel Washbourne shall discharge the Place of Command . . the Forts and Out Guards, during the Sickness of Colonel Moore, in the same manner as Colonel Moore did; until the House take further Order.

Answers from Lords.

Mr. Noble brings Answer that the Lords do agree to give a present Conference, as is desired; and will send Answer to the Ordinance for Excise, by Messengers of their own.

Sir Rob. Harley brings Answer, that the Lords do agree to Mr. Newcomen to preach at the Fast, on Friday next.

Clause of Abjuration.

Ordered, That Mr. Rous and Mr. Niclas, and Mr. Hill and Mr. Young, do prepare the Clause of Abjuration, to be inserted into the additional Ordinance for Sequestrations.

Message from Lords.

A Message from the Lords, by Sir Edw. Leech and Dr. Health;

The Lords desire, at this Conference, that they may communicate some Letters which they received from my Lord General, which occasioned the Return of the Committees.

Answer.

Answer returned by the same Messengers, that this House has considered their Lordships Message; and do agree, that, at this Conference, the Lords may communicate these Letters, as is desired.

Listing Horses.

Ordered, That the Committee appointed to consider of the Ordinance for listing of Horses do presently withdraw, to consider of the Amendments, sent down from the Lords to the said Ordinance.

Message to Lords.

Mr. Morley is appointed to go to the Lords, to desire them to sit awhile; and that the Conference desired upon the Informations from Hull may be put off a little while, in regard of some intervenient Occasion happened by the coming of a Gentleman from thence: He is likewise to desire them, to speed their Answer concerning the Great Seal; and, to issue out their Proclamations for summoning the Queen to answer the Articles of Impeachment: To give their Answer to the Ordinance concerning Sir Peter Ricaut's Adventure in the East India Company: And likewise, to give their Answer to the Ordinance, long since sent up, for the Indemnity of Sir David Watkins.

Letters read.

The Copies of Two Letters from Sir Jo. Hotham (one to the Parliament) one to his Son, and a Letter from the Committee at Hull, of the last of June; and likewise a Letter to Sir Jo. Hotham; were all this Day read.

Grant to Mowyer.

Ordered, That Two hundred Pounds shall be given to Captain Mowyer, Captain of the Ship Hercules, in Acknowledgment of his faithful and good Service to the State; and that a Letter be written unto him of Encouragement, by the Committee for the Navy: And the House doth recommend it to the Committee for the Navy, to take care for a speedy Satisfaction of his Arrears.

Hull Committees.

Resolved, &c. That Sir Wm. Alanson shall be added to be one of the Committees at Hull.

Answer from Lords.

Mr. Morley brings Answer, that the Lords do agree to sit awhile, and to put off the Conference for some small time, upon the Reasons delivered; and, as to the other Messages delivered by him, they will take them into Consideration, and send Answer by Messengers of their own.

Conference with Lords.

Sir Beauchamp St. John is appointed to go to the Lords, to acquaint them, that this House is now ready to come up to the Conference desired, if their Lordships shall please.

Sir Beauchamp St. John brings Answer, that the Lords are now ready to give a present Conference, as is desired.

Sir Wm. Armyn, Sir Wm. Alanson, Sir H. Heyman, Mr. Strode, are appointed Managers, and Reporters, of this Conference.

The Narrative from Hull made here by Sir Wm. Alanson, to be first delivered at this Conference; and then the Letter of Advice from hence to Sir Jo. Hotham; the Letter from him to his Son; the Letters prepared to be sent to the Parliament, signed by many of the Officers of the Garison; the Letter from the Committee at Hull; to be read: And then the Votes of this House, upon the whole Matter, to be read; and the Lords Concurrence to be desired.

Ordered, That Mr. Durand Hotham be forthwith summoned to attend the House; and that his Papers and Letters be seized: Mr. Browne to take care herein.

Offices, &c. bestowed by the King.

Ordered, That the Committee appointed to prepare an Ordinance, concerning such as have had Offices bestowed upon them from the King, since his going from his Parliament, shall bring in a Clause, in that Ordinance, for annulling and making void such Honours, as have been bestowed upon any Persons, since the King withdrew himself from the Parliament.

Ireland.

Ordered, That the Declaration * * To-morrow concerning Ireland.

Listing Horses.

Ordered, That the Lord General be desired to grant out Commissions for the listing of Horses about London, Westminster, the Suburbs, and Twelve Miles Compass, according to the Purport of the Ordinance for listing of Horses, as it was sent up to the Lords from this House: And it is referred to the Committee for listing of Horses, to make Choice of some Messenger, to be sent with a Copy of this Ordinance to his Excellency my Lord General.

Isle of Ely.

A Letter from Mr. Torrell Jocelyn, of the last of June, from the Hermitage of the Isle of Ely, representing the Dangers of that Isle, by the corrupted Ministers, and the corrupted Trained Bands, was this Day read; and it is ordered, that it be referred to the Committee for the associated Counties, to consider of purging the Isle of scandalous Ministers, and likewise the corrupted Trained Bands; and to consider of making Pay to the Garison, and of any other Matter that may conduce to the Safety of the said Isle.

Scandalous Ministers.

Ordered, That Mr. White do bring in an Ordinance To-morrow, to enable all the Committees in the several Counties to sequester the Livings of scandalous Ministers, and to put religious and learned Men in their Places.

Oath of Abjuration.

The Committee brought in an Oath of Abjuration, to be administred to such as are suspected to be Papists, for Trial of their Recusancy: and to be inserted into the additional Ordinance for Sequestrations, was this Day read; and, by Vote upon the Question, assented unto; and ordered to be referred to the Committee for Sequestrations to insert in it.

Persons sent for in Custody.

Resolved, &c. That Wm. Lee, Wm. Sharpe, Jo. Collington, and Wm. Crofts, be summoned and brought in safe Custody, to answer such Matters as shall be objected against them.

Proceedings concerning Hotham.

Mr. Durand Hotham was called in; and the Letter of Advice to Sir Jo. Hotham, and the Cover to that Letter, were shewed to Mr. Hotham; who did confess, that he wrote both the Cover and the Letter; and being demanded who gave him Intelligence, he said, he did not remember; and being demanded who gave him Advice to write that Letter, answered, No Man gave him that Advice.

Ordered, That Mr. Durand Hotham do remain in the Serjeant's Custody, until this House take further Order.

St. James's Guards.

Ordered, That it be referred to the Committee for the Safety of the Kingdom, to consider of removing the Guards from St. James's, if they shall see Cause.

King's Children.

Ordered, That Mr. Holland do take into his Possession, the Monies lately paid by him into the Hands of the Lady Roxborough, to be disposed of, as was formerly ordered, for providing the Children's Apparel.

Browne's Sequestration.

Ordered, That it be referred to the Committee for Accounts, to consider of the Bonds whereupon Four hundred Pounds is due to Mr. Browne, one of the late Conspirators, and fled; and to take the best Care for bringing in the Monies upon those Bonds; and that one half be allowed towards the Payment of the Forces under Sir Wm. Waller; and the other half towards the Payment of the Garison Soldiers in Dover.

Plymouth Lecturer.

Ordered, That Mr. Geo. Hughes be recommended unto the Town of Plymouth, to be their Lecturer to preach there.

Gatford's Sermon.

Ordered, That the Sermon preached and printed by Mr. Gatford, be referred to the Consideration of the Committee for Cambridge, where Mr. Rous has the Chair.
