Liberty to & Prisoner.

Upon the humble Petition of Tho. Verney, now a Prisoner in the Fleete;

It is Ordered, upon the Question, That the said Mr. Tho. Varney shall have the Liberty of the Prison.

Receiving Informations.

Sir Marten Lumley, Mr. Cage, Mr. Gourdon, Sir Nevile Poole, Sir Wm. Litton, Sir Harbottle Grimston, are presently to withdraw; and to receive such Informations as shall be given unto them by Mr. Middleton, Deputy Lieutenant of the * * *.

Blacklock's Petition.

Ordered, That the Matter of the Petition of Laurence Blacklock, Stationer, be referred to the Committee for the Navy: Who are to consider, and take Order for his Payment.

Indictment for neglecting Church.

The humble Petition of Tho. Dye, William Cobb, and Rich. Meeke, who are imprisoned at Norwich, upon an Indictment, for not coming to Church, was this Day read: And

It is Ordered, That the Judges of the King's Bench, or any One of them, be moved to grant a Certiorari for removing the Indictment; and a Habeas Corpus for removing their Persons.

Message to Lords.

Mr. Wheeler is appointed to go to the Lords, to desire a Conference concerning the Propositions.

He carried up the Order concerning Captain Billingsley, in Service under the Lord Grey, to be excused for his Service in Ireland: The Order for the Arrears of the personal Entertainment to Captain Thorneton: The Lancashire Order concerning the Deputy Lieutenants to have Power to seize the Estates of Malignants: And Four Irish Orders concerning Sir Wm. Cole; Mr. Whettcombe; a Ship to carry over Provisions to Carrickfergus.

Answer.

Mr. Wheeler brings Answer, That, as to the Orders carried up by him, the Lords will send Answer by Messengers of their own.

And they will meet at a present free Conference, as is desired.

Seizing Horses.

A Message from the Lords, by Serjeant Whitfeild, and Serjeant Glanvile;

The Lords, desire to put this House in mind, that, at a Conference not long since, the Lords did give divers Reasons that the Ordinance for siezing Horses might be repealed: They daily receive Complaints against the Seizing of Horses: And do therefore desire, That this House would consider of those Reasons, and join in Repealing of that Ordinance.

Resolved, &c. That this House doth agree with the Lords in repealing and revoking the Ordinance for Seizing of Horses, directed to Mr. Browne and Mr. Beard, and others.

Answer returned by the same Messengers; That this House has considered their Lordships Message; and do concur with the Lords, in revoking the Ordinance for Seizing of Horses.

Resolved, &c. That this Debate concerning the Seizing of Horses, shall be resumed so soon as the Conference is ended.

Indemnity for Seizing Horses.

Whereas One Bay Stone Horse, and a grey Gelding of Mr. Clement Paston's, were seized at the Maidenhead in the City of Norwich, being suspected to be sent against the King and Parliament; and, being appraised at Twenty-four Pounds, were delivered to Captain Fines, for the Service of the King and Parliament; It is this Day Ordered, That the Deputy Lieutenants of the said City of Norwich, or any others, who were Actors in the Seizing and Disposing of the said Horses, are and shall be free, and indemnified, against the said Mr. Paston, or any other, concerning this Business.

Recruiting Horses, &c.

This Committee is to consider of some Order, and to present it to the House, for Recruiting of the Army with Horses: And are to consider of the particular Complaints offered to the House by Mr. Whittlock, Sir John Hippisley, and Captain Lee, against the Commissaries employed by the Ordinance for Seizing of Horses, or such as are employed under them: And are to meet, To-morrow Morning at Eight of Clock, in the Court of Wards.

Ordered, That Mr. Owen, Master of the Company of Merchant Taylors Hall, Mr. Nashe, Mr. Gardner, Mr. Antrobus, Wardens of the said Hall be summoned forthwith to attend the House.

Proceedings against Butter.

Resolved, &c. That Nath. Butter, now a Prisoner in the Fleete, be forthwith removed from thence, and sent a Prisoner to my Lord General to Windsore; to be tried by the Council of War, for an Intelligencer: And Mr. Nicoll is required to take Order for the Sending him away; and the Letters with him.

Staying Horses.

Ordered, That Mr. Whittacre do stay the Horses that he hath sent to stay this Morning.

Ordered, That Sir Wm. Portman and Mr. Bassett be summoned forthwith to attend the House.

Combes Petition.

Ordered, That the humble Petition of George Combes, who was employed in Sommersettshire, by Order of this House, be referred to the Committee for the Safety of the Kingdom, to give Order for the Petitioner's Satisfaction.

Horsham Minister.

Whereas Mr. Collins, the late Incumbent of the Town of Horsham in Sussex, is lately dead: It is Ordered, That Mr. Chattfield, their Lecturer, do supply the Cure in the mean time; and received the Profits, until the Houses take farther Order: And that Mr. Goodwyn bring in an Ordinance for the Lords Concurrence to this Purpose.

Dick's, &c. Petition.

Ordered, That the humble Petition of Lodovick Dick and Tho. Cunningham, Captains of a Ship and a Frigate in Employment of the State, be referred to the Committee for the Affairs of Ireland; to consider of this Petition; and to prepare an Ordinance for giving them due Satisfaction in pursuance of their Bargain.

Examining Thorolld.

Mr. Whittacres, Mr. Boxholme, Sir Wm. Armyn, Mr. Pierrepoint, are appointed to visit Sir Robert Thorolld, a Prisoner; and to examine him upon such Letters that are suspected to come to him, and are intercepted.

Removing a Prisoner.

Upon an Information this Day given to the House, against Mr. Henry Darrell;

It is Resolved, upon the Question, That Mr. Henry Darrell be removed out of the Serjeant's Custody, and sent Prisoner, by Ship, To-morrow, with the other Prisoners, to Yermouth; there to be kept a Prisoner in safe Custody till the House take farther Order: And that the Serjeant do take Order for the safe Shipping of him.

Records at Warwick.

Ordered, That the Writings, Papers, Books, and Records belonging to the Office of the Clerk Comptroller, be inventoried, and safe kept at Warwick Castle, or in the Town of Warwick, whither now they are brought; And that the Clerk Computroller shall have Liberty to appoint such fit Person as he shall think fit, to inventory the said Records, Books, and Writings; and to see them safe and well laid up.

Committing Assessors, &c.

Resolved, &c. That the Committee of Lords and Commons for Advance of Monies shall have Power to commit to such Prisons, and during so long time as they shall think fit, such Assessors or Collectors made upon the Ordinance of the Twenty-ninth of November, as they shall find negligent in the Service, or shall refuse to undertake it.

Seizures for Assessments.

Resolved, &c. That the Collectors made upon the Ordinance of the Twenty-ninth of November for Assessments, shall have Power to break open any Chests, Trunks, Boxes, Doors, or other things, whereby to take a Distress for the Sums of Money assessed upon any Person, and unpaid, and the Time limited for Payment, by the said Ordinance, elapsed: And also, if they find any Chests, Money, or other Goods, in the Hands of any Persons, which shall be proved, or confessed, to belong to any Person assessed, that has not satisfied the Assessment, That the said Collectors shall have Power to seize such Chests, Money, or Goods, for satisfaction of the Sums assessed.

Raising Volunteers.

Mr. Rigby, Mr. Rolles, Mr. Blakiston, Sir Peter Wentworth, Sir H. Heyman, Sir Wm. Strickland, Mr. Cage, Mr. Prideaux, Mr. Heveningham, Sir Hen. Mildmay, Mr. Strode, Mr. Holland, Mr. Bosevile, Mr. Purefreye, Mr. Marten, Mr. Gourdon, Sir Tho. Barrington, Mr. Serjeant Wilde.

This Committee is appointed to consider of this Ordinance presented to the House, concerning the Raising of an Army of Volunteers: And are to rectify it and amend it; and to present it to the House: And are to meet, this Afternoon at Five of Clock, in the Court of Wards.

Raising Money.

Resolved, &c. That the House be forthwith resolved into a Committee to consider of the present Raising of Money.

Raising Money.

Upon Mr. Serjeant Wilde's Report from the Grand, Committee;

It is Resolved, &c.

1. That Money shall be raised for Supply of the Commonwealth, after the yearly Value of Lands:

2. That the Rate shall be Twelve Pence in every Pound, according to they yearly Value:

3. That this Rate of Twelve Pence in the Pound be paid within Six Months.

4. That this Rate be paid Monthly, viz. Two Pence per Month:

5. The First Payment to be the First of March next.

Ordered, That the Grand Committee for Advancing of Monies do meet To-morrow Morning at Nine of Clock.

Ordinances of Assessment.

Ordered, That Mr. Sam. Browne and Mr. Hill do, To-morrow, bring in the Ordinances for Assessing of Monies.

Persons refusing to associate, &c.

Ordered, That to the Order for the Deputy Lieutenants of Essex, &c. to seize on the Horses, Arms, and Ammunition, of such Persons as refuse to associate themselves with the rest of the Gentlemen of that County, or to contribute upon the Propositions, it shall be added, "That the Deputy Lieutenants for any Town or Corporation shall have the like Power."

Speaking against Parliament.

Upon an Information given against John Ketbe, of Curby, Clerk, for divers dangerous Words spoken by him against the Parliament;

It is Resolved, upon the Question, That John Ketbe, of Curby, Clerk, be forthwith sent for, as a Delinquent, by the Serjeant at Arms attending on this House.

Ditto.

Resolved, &c. That Mr. Chichley, be forthwith sent for, in safe Custody, to attend the House.

Message to Lords.

Sir Henry Mildmay carried up to the Lords Two Orders concerning Somersetshire; and the Order concerning the Stay of Waggons, &c. to go to Oxon.

Sir Henry Mildmay brings Answer, That the Lords will send Answer by Messengers of their own.

Persons to attend- King's Letters not to be published.

Ordered, That the Master and Wardens of the Company of the Grocers, and John Bunbury their Clerk, be summoned to attend the House To-morrow Morning: And that in the mean Time, they be injoined not to publish the Letter from his Majesty to the Sheriffs, and the private Halls.

Committee to meet.

Ordered, That the Committee concerning the Letters to the Sheriffs, and Masters and Wardens of the particular Companies, do meet To-morrow at Eight of Clock, in the Court of Wards.

Information against Coke.

The House was informed, that Sir Francis Coke, of Essex, should say, That this bloody Parliament they sought their own Ends, and endeavoured to get the great Places of the Kingdom into their own Disposal: And that, if my Lord Grey came thither to plunder the Country, he should be resisted.

Resolved, &c. That Sir Francis Coke be forthwith sent for, as a Delinquent, by the Serjeant at Arms attending on this House, for speaking Words, very derogatory to the Proceedings and Members of the Parliament.

Bushy Minister.

Ordered, That Mr. Browne be recommended to the Parishioners of Bushy, in the County of Hertford, to supply the Cure of that Parish; and that the Profits be sequestered unto him for that Service.

Guildford Records, &c.

Ordered, That the Mayor of Guildford do seize upon the Chartor and Records in the Hands of the Town Clerk, .. being sent for, as a Delinquent.

Ordered, That the Committee for the Safety of the

Money for Buckingham.

Kingdom do grant their Warrant to the Treasurers upon the Propositions, to pay to Serjeant Major Browne the Hundred Pound paid in by Sir Hennage Proby, of the County of Buck'; to be employed for the Service of that County.

Ordered, That Sir Thomas Sanders, upon his Payment of the Thousand Pounds payable to Sir Walter Pye, in the Hands of the Committee for the County of Buck', to be employed in the Service of that County, that he shall be indemnified and saved harmless by the Authority of both Houses.

Person discharged.

Ordered, That Mr. Francis Sanders, sent up, in safe Custody, from the Committee at Ailesbury, and committed Prisoner to Ely House, by Order of this House, be forthwith discharged from any further Imprisonment or Restraint.

Conference.

A Message from the Lords, by Sir Robert Riche and Mr. Page;

The Lords desire a present Conference, by Committees of both Houses, presently, in the Painted Chamber, if it may stand with the Conveniency of this House, concerning the Propositions.

Answer returned by the same Messengers; That this House will give a present Meeting, as is desired.

Mr. Glyn, Mr. Whitlock, Sir Thomas Barrington, and Sir Henry Mildmay, are appointed Reporters of this Conference.

Payment to Pennoyer.

Ordered, That the Treasurers and Receivers of the Adventurers Money for Ireland do, within One Month after the Date hereof, pay out of those Monies One hundred and Thirty-eight Pounds Ten Shillings to the Treasurer at Wars for Ireland, or his Agents; to be forthwith by them paid over to Mr. Wm. Pennoyer, Merchant, for Powder, Match, and Bullet, to be sent with Colonel Mervyn to Londonderry, for the Use of the Army there.

Privilege.

Ordered, That John Bell, Servant to Mr. Mountague, a Member of this House, arrested upon a mean Process by John Hoper, the Under Sheriff of the County of Huntingdon, be forthwith discharged from any further Restraint: And that the said Under Sheriff do attend the House, to shew Reason, Why he did contrary to the Privilege of Parliament.

Propositions to the King &c.

Mr. Glyn reports, That the Lords do agree to all the Propositions, as they were sent from hence. They do agree that the Title of the Bishops Bill be inserted in the Propositions among the other Bills. They have likewise passed the Bill for Bishops. They do agree to the Conclusion, with the Amendments; viz. Instead of these Words, "being granted for present, and really performed," these Words to be inserted, "being granted and performed."

Resolved, &c. That this House doth assent to the Amendments.

Mr. Glyn went up to the Lords, to acquaint them, That the House had assented to the Amendments: And was likewise to put the Lords in mind of the Bill against scandalous Ministers.

Disarming Malignants.

Whereas the Deputy Lieutenants of the County of Essex had Power, any Two of them, to disarm Malignants, &c. It is now Ordered, That they, or any One of them, shall have That Power.

House to Ld. General.

Ordered, That Sir Richard Everard do send up the Horse, of One hundred Pounds Value, belonging to Sir Benjamin Ayloff, to my Lord General the Earl of Essex.

Letter from Oxford to Watermens Company.

Mr. Serjeant Wilde presented to the House the Letter sent from Oxford to the Master and Wardens of the Company of Watermen, for the Calling of a Common Hall, and their Apprentices to appear there; which they delivered in to the House, in Obedience to the general Ordered in to the House, in Obedience to the general Order of this House, requiring the Master and Wardens of the several Companies to deliver in their several Letters: Which Obedience of the said Master and Wardens was well accepted of by this House.
