Die Mercurii, 2 Novembris, 1642.

PRAYERS.

Westminster Dean and Chapter.

ORDERED, That none of the Rents, Revenues, or Profits, of the Dean and Chapter of Westminster, assigned for the Maintenance of the Scholars, and Almsmen of the Foundation of the said Collegiate Church of Westminster, be stopt, or the Payment thereof interrupted, notwithstanding the Order of both Houses for sequestring the Rents, Profits, and Revenues of Archbishops, Bishops, Deans, Deans and Chapters: And that the Receiver of the College do receive the Rents as formerly; and the Steward, the other Provisions.

Bishops, &c. Sequestration.

Ordered, That the whole Matter and Manner of sequestring the Rents and Profits of Archbishops, Bishops, Deans, Deans and Chapters, be referred to the Committee for the King's Revenue; and likewise to provide, that the Allowances assigned for Scholars, Almsmen, and other charitable Uses, may not be interrupted or diverted: And likewise to provide for the Indemnity of such Tenants as shall, in Obedience to the Order of both Houses, forbear to pay their Rents payable to * * * *.

Grant to Michell.

Ordered, That Mr. Michell, a Minister, lately come out of Ireland, shall have Twenty Pounds bestowed upon him out of the Contribution Monies for Ireland: And that Sir Robert Pye, and Mr. Wheeler, Treasurers for the Contribution Monies at Westminster, do forthwith pay unto the said Mr. Michell the said Twenty Pounds.

Horses discharged.

Ordered, That Richard Shank, Carrier of Dorchester, who has his Horses stayed, shall have his Horses forthwith discharged.

Distressed Persons from Ireland.

Ordered, That the Six-and-twenty Pounds, collected at the last Fast but one, in the Parish of Westminster, be paid into the Hands of the Committees for Contributions at Westminster; to be disposed of to such distressed English as are come out of Ireland, and now lying about this Town.

Redriffe Volunteers, & c.

Ordered, That Captain Robert Mounton be recommended to the Earl of Northumberland, to be Captain of the Volunteers raised in the Parish of Redriffe: And that he shall have Power to set up Posts and Chains for the Defence of that Town, in such Manner as Southwarke had.

Dep. Lieuts. of Surrey.

Ordered, That Sir Jo. Evelyn, Sir Rich. Onslow, Mr. Drake, Mr. Jo. Goodwyn, Mr. Sandys, do meet together, and bring in the Names of fit Persons to be Deputy Lieutenants for the East Part of the County of Surrey; and likewise to consider of some Course to be held with such as refuse to go out.. the County, to serve the Commonwealth: And are to bring in their Report To-morrow Morning: And are to meet this Afternoon, at Two of Clock, in the Court of Wards.

Price's Impeachment.

Ordered, That Sir Peter Wentworth, Mr. Rous, Mr. Rigby, Mr. White, be required .. search the Studies, Libraries, and Papers of Dr. Jo. Price: And that they prepare an Impeachment against him.

Price committed.

Resolved, upon the Question, That Dr. Jo. Price be forthwith committed Prisoner to Newgate, there to remain during the Pleasure * * *; for composing and publishing a Book very much derogatory to the Proceedings of Parliament.

Prisoner discharged.

Resolved, upon the Question, That Mr. Tho. Smyth, of Cripplegate Ward, Merchant, upon Sight of a Certificate under the Hands of Alderman Warner, and Alderman Towse, Treasurers for the Propositions, that the said Mr. Smyth has paid in Two hundred Pounds upon the Propositions; and likewise upon his Offer in his Petition, to maintain Ten Men sufficiently armed for Twelve Weeks, if the Service shall so long continue; be forthwith discharged from any farther Restraint.

Members accede to Convenant.

Mr. Littleton, Serjeant Cresweld, declared themselves in the Affirmative, to the Vote concerning the Earl of Essex.

Cresweld, &c. thanked.

The House takes Notice of the good Service done by Serjeant Cresweld, in the Country, upon the Matter of Contributions, and other Services of the Parliament: For which they return Thanks; and do Order, That he should prepare a Letter of Thanks to the Mayor of Exon, for his good Service done upon the Propositions; and for his Kindness to the Earl of Essex, Lord General, when he was in the Field.

Innovations in the Church.

A Message from the Lords, Sir Robert Riche and Mr. P ....;

The Lords do return this Bill, intituled, "An Act for the Suppressing of Innovations in Churches and Chapels, and for the better Observation of the Sabbath, and the Advancing of Preaching, &c. with some Amendments: The which they have passed, with some Amendments: The which Amendments were the Amendments from this House.

Ordered, The Bill to be amended accordingly.

Answer returned by the same Messengers; That the House does agree to all the Amendments.

Ditto.

Ordered, That Mr. Prideaux do prepare a short Bill to prevent the Inconveniencies that may arise by the Time's being elapsed in the Bill of Innovations.

Person committed.

Wm. Danke, against whom there came a Letter, with Informations against him, was called in: Who denied all the Particulars informed against him in the Letter.

Resolved, upon the Question, That Wm. Danke be forthwith committed Prisoner to Newgate; there to remain during the Pleasure of the House.

Reward to Mariners.

Resolved, That the common Mariners of the Merchants Ships, who receive not above Twenty Shillings a Month, employed in this Summer's Service, shall have a Month's Pay bestowed upon them, over and above their Wages.

House will sit.

A Message from the Lords, by Serjeant Whitfield and Serjeant Glanvile;

The Lords do intend to sit this Afternoon, at Three of Clock, about the pressing Affairs of this Kingdom: And they do desire this House would do the like, if it may stand with the Conveniency of this House.

Ordered, That this House do meet this Afternoon, at Three of Clock.

Answer returned by the same Messengers; That this House has resolved to sit this Afternoon, at Three of Clock.

Fortification of Chichester.

The Lords and Commons, in this present Parliament assembled, taking Notice of the Weakness of the City of Chichester, and the Willingness of the Inhabitants to fortify the same in these Times of Danger; do Order and Ordain, and hereby give full Power and Authority to the said Inhabitants, to make any such Fortifications in or about the City, for the Security thereof, as they in their Discretions shall think fit. And they do further Order, That whereas Seven Pieces of Ordnance, upon their Intreaty, have been delivered unto them by Sir Wm. Lewis, out of the Castle of Portsmouth, that they may retain them for their Use, during these Times of Danger: And the said Sir Wm. Lewis, for the Delivery of the said Ordnance, shall hereby be saved harmless, and indemnified. And it is further Ordered, That the said City of Chichester may have Ten Barrels of Powder out of the Magazine at Portsmouth, for the Use and Defence of the said City.

Post Meridiem

Indemnity for fortifying the City.

MR. Hill, Mr. Vassall, Mr. Rigby, Mr. Prideaux, are to prepare an Order to save the City harmless, for the Fortifications they have made, and for the Men they have raised, and set forth; and to bring it in To-morrow Morning.

Person to attend in Custody.

Resolved, That Peter Cole of Cornehill shall be forthwith summoned to attend the Service of the House, in safe Custody.

Taking of Scarborough Castle.

Resolved, upon the Question, That the Taking in of the Castle of Scarborough, by Sir Hugh Cholmeley, is an acceptable and good Service to the Commonwealth, and for the Safety thereof: And that he shall be protected, and saved harmless, by both Houses of Parliament: And that the Sheriff of the said County be aiding and assisting unto him.

Persons sent for.

Upon the Report from the Committee for the Customs;

It is Resolved, upon the Question, That Tho. Colston, Francis Creswick, Wm. Lissett, of Bristoll, Merchants, be forthwith sent for, as Delinquents, for refusing to attend the Committee of the Customs, &c.. upon the Summons and Order * * *

Maimed Soldiers.

..Wheeler, .. Holland, .. Pye, .. Glyn, .. Lumley, .. Ashe, .. Bell, .. Prideaux, .. Whittacre, .. Jennour, .. Maynard, the Citizens of London, are appointed to consider how the maimed Soldiers of the Army may be provided for in the Hospitals of the Savoye, the Charterhouse, St. Katherine's, St. Thomas, and the rest; and to inquire into the Abuse of the Government of these Hospitals, and to take some Care and Means for rectifying the said Abuses: Sir Tho. Soame and Mr. Jennour are especially required to take Care of this Business: And likewise to consider how the maimed Soldiers, in the mean time, may be provided for, and disposed of. And are to meet To-morrow, at Eight of Clock, in the Court of Wards.

Liberty to a Prisoner.

The humble Petition of Mr. Jo. Fountaine, Counsellor at Law, was this Day read: And

It is Ordered, That he shall have Liberty to go with a Keeper to Church, to serve God, at St. Margaret's, Westminster.

Members accede to Covenant, &c.

Mr. Maynard declared himself in the Affirmative to the Question concerning the Earl of Essex, and offered to give Forty Pounds unto the Cause.

Mr. Whittlock declared himself in the Affirmative to the Vote, concerning the Earl of Essex.

Listing a Horse.

Mr. Sandys is injoined to list the Horse he offered for the publick Service, with the Commissary here at London.

Declaration to the Scotts.

Mr. Pym presented from the Committee for the Safety of the Kingdom, a Declaration to be sent to the Scotts, concerning their Assistance: The which was read; and, by Vote upon the Question, assented unto (the Question being first put, Whether the Question shall be now put); and ordered to be sent to the Lords for their Assent.

Affairs of the Kingdom

A Message from the Lords, by Serjeant Whitfield and Serjeant Glanvile;

The Lords do desire a present Conference, by a Committee of both Houses, presently, in the Painted Chamber, if it may stand with the Conveniency of this House, concerning the Affairs of the Kingdom.

Sir Jo. Wray went to the Lords, to desire that this House might have Liberty to propound something at this Conference, concerning the great Affairs of the Kingdom.

Answer; The House has considered their Lordships Message; and will give a present Meeting as is desired.

Resolved, upon the *, That this Declaration shall be an Head of the Conference: And that the Lords Concurrence be desired: And that it may be sent by the Committee for the Safety of the Kingdom, into Scotland, by an express Messenger.

Mr. Pym, Sir H. Vane, Mr. Glyn, Mr. Whitlock, are appointed Reporters and Managers of this Conference.

Person in Custody.

Ordered, That Sir Alexander Ratcliffe, now in Custody here in London, be not discharged till the House be first acquainted herewith; and that they give farther Order herein.

Irish Affairs.

Ordered, That the Letters from the Lords Justices in Ireland, concerning Drugs, be referred to the Consideration of the Committee for Irish Affairs.

Ly. Richardson's Trunks.

Ordered, That the Delivery of the Trunks of the Lady Richardson be referred to the Committee for Dispatches and Informations, to cause them to be discharged and delivered, if they shall not see good Cause to the contrary.

Affairs of the Kingdom.

Sir Jo. Wray brings Answer that the Lords do agree, that at this Conference this House may propound something, concerning the great Affairs of the Kingdom, as is desired.

Address to the King.

Mr. Pym reports, That the Earl of Northumberland reported, That the Committee for the Defence of the Kingdom, had considered of the present State of the Kingdom; and had considered of some humble Address to be made to his Majesty, for the Sparing of the Effusion of more Blood: But they would do nothing, until they had first acquainted the Lord General, and the Members of both Houses in the Army. That they had received a Letter from the Earl of Essex: The which was read: And that the Lords thought it fit to refer it to the Committee for the Safety of the Kingdom, to prepare an humble Address to his Majesty for an Accommodation, if this House shall so think fit.

Resolved, upon the Question, That it be referred to the Committee for the Safety of the Kingdom, to prepare Heads of an humble Address to be made unto his Majesty, for composing the Differences and Distractions of the Kingdom; and settling the Peace of the Kingdom; and to present them to the House.

E. of Essex' Services.

Ordered, That, To-morrow at Ten of Clock, the Motion concerning the Acknowledgment of the good and worthy Service done by the Earl of Essex the Lord General, be taken into Consideration: And that Mr. Speaker put the House in mind hereof.

Person committed.

Resolved, upon the Question, That Captain Fulkes, lately run away from the Army, be forthwith committed Prisoner to the Gatehouse; there to remain during the Pleasure of this House.

Ditto.

Resolved, That Sir Alexander Ratcliffe, taken in Essex, be committed to the Serjeant's Custody: And that the Consideration and Examination of all the Matters concerning him be referred to the Committee for the Defence of the Kingdom.

Provisions for Ireland.

That the Dispatch of the Ships and Provisions made by Mr. Kurle at Hull; and the Examination of the State of his Accounts concerning those Provisions; be referred to the Committee for the Affairs of Ireland; to even the Accounts, and to dispatch away those Ships and Provisions to the Places assigned.

Preparation of Forces.

Whereas we the Lords and Commons have ordered &c. [a]: To prevent all Misconstructions or Neglects, whereby our just Defence may be hindered; we do Declare, That the Preparation of Forces, and all other necessary Means, for the Defence of the Protestant Re. ligion, the Privileges of Parliament, the Laws and Liberties of the Subject, shall be prosecuted with all Vigour.

This Declaration to be forthwith printed.

Proposition for Peace, &

Mr. Pym went up to the Lords, to acquaint them, that this House doth agree with them to the Proposition made at the last Conference, concerning Peace: And to desire them to join with this House in this Declaration.
