Prayers.
Moor's Estate.
MR. Smith reports from the Committee to whom the ingrossed Bill from the Lords, intituled, An Act to enable Francis Moor, Esquire, to sell the Manor of Bay-house, and Lands in West Thorock, in the County of Essex, and to purchase and settle other Lands, in lieu thereof, was committed, That they had considered the Bill; and had directed him to report the same to the House, without any Amendments: And he delivered the same in at the Table.
Smith's Estate.
An ingrossed Bill from the Lords, intituled, An Act to enable Trustees to sell the Estate of Edward Smith, Esquire, deceased, to raise Money for the Payment of his Debts, and to make Provision for his Children, who are Infants, was read the Third time.
Resolved, That the Bill do pass: And that the Title be agreed to.
Ordered, That Mr. Christie do carry the Bill to the Lords; and acquaint them, That this House hath agreed to the same, without any Amendments.
Earl of Walgrave's Estate.
An ingrossed Bill from the Lords, intituled, An Act to enable the Trustees of the Right honourable James Lord Walgrave to make Leases, and grant Copyhold Estates, for the Payment of the Arrears of Annuities of Henry Lord Walgrave his Father, deceased, was read the Third time.
Resolved, That the Bill do pass: And the Title agreed to.
Ordered, That Sir Jos. Tredenham do carry the Bill to the Lords; and acquaint them, That this House hath agreed to the same, with some Amendments: To which they desire their Concurrence.
Cripps' Estate.
A Bill for the Sale of the Estate of John Cripps, Gentleman, in the County of Kent, and settling another Estate, of greater Value, in lieu thereof, to the same Uses, was read the First time.
Resolved, That the Bill be read a Second time.
Breeding of Cattle.
Sir John Dorrell reports from the Committee to whom the Bill for the Encouragement of Breeding and Fatting of Cattle, was committed, That they had made several Amendments to the Bill; which they had directed him to report to the House: And which he read in his Place, with the Coherence; and afterwards, delivered in at the Clerk's Table: Where the same were once read throughout; and then a Second time one by one; and, upon the Question severally put thereupon, agreed unto by the House.
Ordered, That the Bill, with the Amendments, be ingrossed.
Burton's Estate.
An ingrossed Bill from the Lords, intituled, An Act for the better enabling Sir Tho. Burton, Baronet, to sell Lands for Payment of Debts, was read the Third time.
Resolved, That the Bill do pass: And the Title agreed to.
Ordered, That Mr. Carter do carry the Bill to the Lords; and acquaint them, That this House hath agreed to the same, without any Amendments.
Aulnage Duty.
Sir Rob. Davers, according to the Order of the Day, reports from the Committee to whom the Bill for transferring the Collection of the Duty of Aulnage to the Custom-house, and giving a Recompence to the Crown for the same, was re-committed, That they had heard the Counsel for the Duchess of Richmond and her Farmers; and were of Opinion, That the Duties mentioned in the Bill are a full and sufficient Recompence to the Duchess of Richmond: And that they had also considered and settled the Clause A, which was recommitted to the said Committee: And then delivered the Bill with the Amendments, in at the Clerk's Table: Where the same were once read throughout; and then a Second time one by one; and, upon the Question severally put thereupon, with some other Amendments, made in the Chair, agreed unto by the House.
Ordered, That the Bill, with the Amendments, be ingrossed.
A Message from the Lords by Sir Miles Cooke and Sir John Hoskyns;
Fountaine's Estate.
Mr. Speaker, The Lords have passed a Bill, intituled, An Act for divesting the Manors and Lordships of Bushwood and Lapworth, and several other Lands, Tenements, and Hereditaments, in the County of Warwick, out of Andrew Fountaine, Esquire; and vesting the same in Trustees, for raising and paying a Debt due upon Mortgage thereof, taken in the Name of the said Andrew Fountaine: To which they desire the Concurrence of this House.
Old-street Prebend.
And also, a Bill, intituled, An Act to enable Henry Halsted to make a Lease for the Improvement of his Prebend of Old-street, in the Church of St. Paul in London: To which they desire the Concurrence of this House.
Duke of Lempster's Nat.
And also, a Bill, intituled, An Act for Naturalizing of Mainhard Duke of Lempster: To which they desire the Concurrence of this House.
Davile's Estate.
Also the Lords have agreed to the Bill, intituled, An Act to enable Wm. Davile to sell some Lands for Payment of his Debts, with some Amendments: To which Amendments they desire the Concurrence of this House.
And then the Messengers withdrew.
Conference on Tryals for Treason.
Mr. Mountague acquaints the House, that he having, according to the Order of Yesterday, been to desire a free Conference with the Lords, upon the Subject Matter of the last free Conference; the Lords do agree to the same, in the Painted Chamber, immediately.
Ordered, That the Members that managed the last free Conference, do manage this free Conference.
And the Managers went to the free Conference accordingly:
And being returned;
Mr. Mountague reports from the free Conference, That the Managers had attended the same; and had acquainted the Lords with the Amendments made by this House to the Clause A, added by their Lordships to the Bill for Regulating of Tryals in Cases of Treasons; and had delivered the Bill, with the Clause and Amendments, to their Lordships.
Call of the House.
Then the House, according to the Order of the Day, was called over: And such as made Default to appear, their Names were noted down.
And afterwards, the Defaulters were called over a Second time; and several of them excused.
And a Motion being made, and the Question being put, That Sir Scroope How be excused;
It passed in the Negative.
And a Motion being made, and the Question being put, That Sir Scroope How have a Fortnight's time to attend the Service of the House;
It passed in the Negative.

Ordered, That Sir Hen. Vane have Leave to go into the Country for a Fortnight, for Recovery of his Health.
Ordered, That Mr. Campion have Leave to go into the Country for a Fortnight upon extraordinary Occasions.
Ordered, That Mr. Harris have Leave to go into the Country for a Month, upon extraordinary Occasions.
Ordered, That Sir Wm. Thomas have Leave to go into the Country for Three Weeks, for Recovery of his Health.
Ordered, That Sir John Brownlow have Leave to go into the Country for a Month, for Recovery of his Health.
Punishing Mutiny and Desertion.
Ordered, That the ingrossed Bill for paying the Army, according to the Musters of effective Men; and for the better Paying of Quarters; and likewise for preventing false Musters, and punishing Mutineers and Deserters; be read the Third time To-morrow Morning.
Bankrupts.
Ordered, That Mr. Osborne, Sir Robert Edon, Sir Jonath. Jennings, Sir John Key, be added to the Committee to whom the Bill for the better Relief of Creditors, and more equal Distribution of Bankrupts Estates, is committed.
Earl of Salisbury's Estate.
Ordered, That Sir John Moreton, Mr. Weld, be added to the Committee to whom the Bill for the better securing the Portions, Debts, and Legacies, given and owing by James late Earl of Salisbury, is committed.
Malicious Informations.
Ordered, That Mr. Hawtry, Mr. Morgan, be added to the Committee to whom the Bill for the better Preventing of malicious Informations in the King's Bench, is committed.
