Popish Schoolmaster.

A Motion made by Mr. Pymme, from the Committee of Religion, concerning one Symon Dormer, a Popish Schoolmaster in Suffolke. - Moveth, he may be sent for.

Ordered, He shall be sent, by Warrant, by the Serjeant,. to appear before the Committee for Religion, and there to attend. He to appear forthwith, and to bring his Licence for teaching with him.

New Writ.

Mr. Brooke moveth for a new Writ, for a Knight, in the Room of Lord Cavendish, being now, by the Death of his Father, Earl of Devonshyre.

Wines.

The Committee for Relief of the French Merchants of Wines : - All, that will come, to have Voice : And to go up presently into the Committee Chamber, to resolve of some Things, for perfecting a Report to the House.

Subsidies.

The Committee for the Accounts of the Subsidies, and Fifteens, to meet upon every Saturday, till it be finished.

Affairs with France.

Mr. Attorney being come, to give Satisfaction to the House from the Duke of Buckingham;

Resolved, He shall be brought in, with the Mace, and then stand at the Bar. He to be heard, and then to withdraw.

Mr. Attorney and Mr. Whitfeild came to the Bar.

Mr. Attorney: - That the Lords, upon my Lord Admiral's Petition for Leave, had granted him Liberty to give Satisfaction to this House, concerning the Re-seizure of the Peter. -

That the Lord Admiral, by him returneth Thanks to this House, that he hath Means, upon a Doubt made, to clear -

That he confesseth, the second Stay of the Ship to be done by himself, but by the King's express Direction. -

That this Ship, called the Peter, amongst others, brought in to Plymouth. -

A Commission directed to divers Commissioners, to enquire into the Goods within the Ships. They dismissed divers, but the Peter, amongst divers other, brought to London. -

Upon the King's Advocate's Allegations, divers Ships adjudged Prize; others in Suspence, whereof this One. 28o Dec. the King advised about these with his Privy Council; and then an Order made, by the King's Direction, by the Board, both for this Ship, and all other, that all Ships, belonging to the French King, or to any other of his Allies, should be restored; but coloured Goods to be stayed. That the Duke wrote to Five or Six learned Civil Lawyers, for their Opinions. 26o Jan. this Ship discharged. 27o Jan. Lieutenant of the Tower acquainted the Duke, that all the Ships in general were the King's Enemies Goods, and only coloured by the King's Friends : and gave his Reason for it. The Duke particularly asked him for the Peter, whether he thought, that Information would reach to her. That the King, being herewith acquainted by him, commanded a Stay of her for the present. That he advised with Sir H. Martyn, who told him, upon new Information proved, the Ship might be lawfully stayed ; but thereof he could not judge, till he had seen the Proofs. 15o Febr. the Lords resolved, this Ship should be discharged, upon Security to abide the Order of the Admiralty. -

The Consequences hereof past, and future. This concerneth the King, and the Owners of the Ship. It is yet pendente lite. Not now a particular or personal Cause, but a national Controversy; so a Matter of State, wherein , the King hath used his Ambassadors; and great Hope of concluding all this Business, to his Honour, and Benefit of his Subjects. -

That the Re-seizure of this Ship no Cause of the Arrest of our Goods and Ships in Fraunce ; for Bruit of this Re-seizure here at Christmas. The Decree in Roane grounded upon Delays here; selling their Goods under the Value, &c. whereas none of the Goods of this Ship sold. Our prejudicating this Cause here may do us Hurt abroad : Will hinder the Seizing of Victuals, &c. carried by the King's Proclamation into Spayne. That they have already procured a Staple at Callice, to carry Spanish Goods into the Low Countries.

Upon Question, the further Debate and Resolution hereof deferred to Thursday next.

The former Committee to consider of that now alleged by Mr. Attorney, for the better Preparation of it against Thursday: To meet, for that Purpose, To-morrow in the Afternoon, Two Clock, in the Court of Wards.
