Southcoate, shewing that said Captain's papers were taken from her at Tangier so that she was deprived of the benefit he designed her, great part whereof was the 350l. due to him from his soldiers; and all the pay of said soldiers since his death has been issued by the Paymaster at Tangier to the Col. and Major of the Regiment and proportionable parts thereof have been stopped but petitioner has had no account thereof: therefore prays that further pay may be stopped till she be satisfied what is due to her and also for an account of what the major has already stopped. Same by same to same of the address to the King from Lady Middleton, widow of Lord Middleton, late Governor of Tangier: petitioner shewing that 2½ years of his reward for that service was unpaid at his death which necessitated him to contract many debts and forced petitioner (left with two children) to sell his plate, pictures etc. . that at her return to England she was engaged to account to the late King for her lord's administration of Tangier and after five years spent in that matter was forced to submit to the defalcation of said 2½ years' pay and to take out the late King's pardon to free herself from public demands which she was utterly unable to satisfy: "that she had your Majesty's promise for her protection, but the late King's death and the wicked rebellions made her not to importune your Majesty:" that 3,000l. which is less than said arrears would enable her to live in retirement and make some provision for her children: that Lady Teviot and Lady Faireborne have been allowed considerably: therefore hopes for an equal share of royal bounty. Same by same to the Customs Commissioners of the petition of Thomas Wolstenholme, Customer of Bridgwater, for some further encouragement, he having only 10l. allowance for a clerk; and the rather because his brother acts as his clerk. Ibid, p. 243.
Same by same to the officers of the Board of Greencloth of the petition of the servants of the Queen Dowager, who had the right to eat at their Majesties' several waiters' tables: petitioners shewing that the [diet allowance for] said tables was suspended for a year and odd months in 1678; that Charles II ordered so much money to the Board of Greencloth as the tallies [sic ? for tables] amounted to, to be divided among petitioners: that about 8,000l. remains unpaid of the same; that petitioners are informed that the Lord Treasurer has ordered said 8,000l. out of the money for payment of the late King's debts but they are told by the persons who are to receive it that they have no right to any of it: therefore pray said money to be stopped till they be heard in it. Same by same to the Attorney General of the petition of Sir Thomas Norton, bart., showed that Charles I granted his father the tithe of grass, corn, oats etc. of Holm alias Biggen, co. Warwick, as amply as the late monastery of the Mendows of Leicester held same, said premises being recovered to the Crown by said grantee: that the tillage having for many years past been laid down the occupier refuses to pay said tithes so that petitioner and his father have paid rent without receiving any return: therefore prays a fresh lease for 500 years with explanatory terms to express that the small tithes are intended therein. Same by same to Lord Dartmouth of the petition of Ralph Milborne, shewing that Charles II in 1672 built a new fort called Cliffords Fort at a place called Pow Panns in co. Northumberland, near the mouth of the Tyne, being upon part of petitioner's lands, for which 100l. as satisfaction was offered to Jno. Butler, the then occupier of said lands and husband of petitioner's sister, but said Butler refused said 100l. and petitioner has never received any satis faction: therefore prays satisfaction. Ibid.
Same by same to William Blathwayte of the petition of William Tyack for the place of Escheator of the Leeward Islands in America, void since the death of Charles II; petitioner being settled in Nevis for several years. Ibid, p. 248.

Prefixing: said report dated Dec. 12 last. Petitioner was Receiver of Recusants' Forfeitures in Westminster and St. Giles in the Fields, and his allegations in his petition are true. He often complained of the neglect of the sheriffs in discharging goods after levy and I have verified same as also the sheriffs' complaints against some of the Exchequer officers. Petitioner was at the cost of several commissions detailed; and it appears by the bill of Goodenough, one of the undersheriffs, that he stopped the charge of an inquisition against Lady St. John's goods. Petitioner was at charge in several convictions and appraisements and the greatest part of the goods were pleaded off. He has paid no moneys into the Exchequer.
Same by same to the Warden and Commissioners of the Mint of the report by Sir Phi. Lloyd and James Hoare dated July 9 last on the petition of John Prescot ut supra, p. 196. Prescot had a writ for seizing Jackson's wool for the debt due to him but could not discover where said wool was until the undersheriff found same after Jackson was accused of clipping. Prescott offers to make further discovery of Jackson's goods. He may be allowed a proportion thereof towards the great debt due to him from Jackson. Ibid, p. 252.

Jan. 18. Henry Guy to the Earl of Ranelagh. Treasurer Rochester sent Mr. Shales to you about the money to be advanced for buying provisions of hay, straw, etc. for the encamping next spring which is to be deducted out of the soldiers' pay. As you and Shales have agreed upon it you are to advance him 400l. this day for that service and to continue to advance him 400l. weekly for same till further order. Out Letters (General) IX, p. 249.

Appending: said opinion by Sir Robert Sawyer. The general words in the pardon (ac omnia et singula indictamenta etc.) do not restore their goods and lands forfeited upon the attainder; for those being forfeited no words of pardon can restore them. There must be a special [grant] of restitution for that purpose. But in pardoning persons before attainder the very pardon without those general words prevents the incurring of the forfeiture of goods and lands.
Same to Mr. Hewer for an account how the last six months' pay [for the late Forces at Tangier] has been issued and to whom. Lieut.-Col. Churchill has desired that he may be paid to the time his Col. is paid. Have you any objection to this ? Ibid.

Appending: (a) petition of James Pearse, surgeon, concerning the smart money proposed to be given to the private soldiers of his Majesty's First Regiment of Foot Guards wounded in the late rebellion in the West. Is it the King's pleasure that there be precedents for those of the Earl of Dunbarton's and the Earl of Craven's Regiment, or what distinction is to be observed ? Also what degree of augmentation of royal bounty is to be awarded to the Gentlemen of the King's Horse Guards and Royal Regiment of Horse, I pray consideration of the services of my [medical] brethren therein, viz. Mr. Hobbs, who attended the General and the Horse Guards and returned with them; Mustow and Mr. Wyley, the one surgeon to Col. Trelawney, the other to Col. Kirke, they dressing the wounded men sent to Bridgwater from the day of the fight till the latter end of September; Mr. Bellamy and his servant, who took care of 38 wounded men sent to Bath from the beginning of July until the middle of August when the men were either cured, dead or sent to the Hospital in London; the wounded and sick of both places being now all come away and there remaining yet unpaid about 70l. for that service. The number of wounded sent to Bridgwater was 110 and those sent to Bath 38, making a total of 148. The total charge for medicines, diet, lodging and necessaries was 151l. 9s. 5d. whereof 80l. has been paid by Mr. Fox. I also pray that the allowance to the surgeons of the land Forces for medicine money may be settled.

Same to the Attorney General to report on (a) the enclosed information [missing] concerning lords of manors seizing upon the estate of criminals convicted (b) the report from the Mint Commissioners on Jona Howell's petition for 400l. for his charges in prosecuting clippers etc. Ibid.
Same to the Customs Commissioners. The Lord Treasurer thinks it best to let the logwood duty to farm. Enquire who will be the best chapmen for it. Ibid.
Same to Mr. Pepys. The Lord Treasurer to-day moved the King that Capt. Saunderson, commander of the Fubs yacht who is lately gone to Scotland with the Duchess of Lauderdale, may on his return call at Newcastle and take in all the moneys of the Excise and Hearthmoney collectors in Newcastle and Durham, which is computed to be about 4,000l. and to bring same to London. The King has so ordered. Give Saunderson instructions accordingly. (Same dated same to the Commissioners of Excise and Hearthmoney to send orders to the said collectors to deliver their moneys to Saunderson.) Ibid.

Jan. 28. Warrant from Treasurer Rochester to the Customs Commissioners to permit the, Customs free, transport of Navy stores as below on the Owners Adventure, William Hare master, to Nevis for the service of his Majesty's ship Dartmouth. Out Letters (Customs) X, pp. 92–4.
Prefixing: schedule of said stores as laden at Deptford the 26th inst. by the Navy Commissioners being boatswain's and carpenter's stores respectively.
Same by same to same and to the Commissioners of Excise to observe an order of the King in Council dated Whitehall, the 22nd inst. Ibid, p. 95.
Prefixing: said order made on a memorial of the Customs Commissioners who therein represented that they observed a greater number of wrecks than ordinary, more especially of wines and brandies which goods were generally taken into the possession of the Vice Admirals or their deputies or the lords of manors in right of their respective royalties and that they suspected some contrivance between the proprietors of the goods and the said personages to set up pretences of wreck on purpose to avoid the great duty on those commodities: and therefore desired that all such wrecked goods should remain in possession of the Customs officers till it be decided legally whether the goods were wreck or not. This being controverted on behalf of the Admiralty the King, upon full hearing of Sir Richard Lloyd, Col. Strode and Sir Robt. Holmes and others on behalf of the Admiralty and the said Customs and Excise Commissioners on the other behalf did order (for the avoiding of all controversy about the several distinctions of wreck in relation to the payment of the duties) that all wreck goods whatsoever as well such as should remain to the King in the right of his Admiralty as others should pay the duty of Custom and Excise without any allowance for salvage or other allowance whatsoever except as allowed by the Act of Tonnage and Poundage for damage, and further that all goods salved or coming on shore as wreck should remain in the custody of the Customs officers till the duty be paid or secured.
Money warrant for 1,200l. to Sir John Ernley in repayment of the like sum by him lent into the Exchequer the 27th inst.: with interest at 5l. per cent.
