Report to the King from the Treasury Lords on the following draft of a royal letter for releasing the quit rents reserved on the Duke of York's two last patents. We have no objection to the passing of the said draft provided the same extend not to remit any rents for a longer time than the lands in question have been in the possession of said Duke, and that the discharge continue no longer than is the case with other lands vested in said Duke by the Acts of Settlement and Explanation. |

Prefixing: said draft. By the Act of Settlement the lands of Oliver Cromwell, Henry Ireton and other regicides named or which were assigned in satisfaction of any adventurers' arrears or other recompense or reward whatsoever were vested in the Duke of York freed from any new or increased rents, except in cases of lands which he should alien or grant otherwise than for lives or years, in which a moiety of the improved rent is reserved. By the Act of Explanation the said lands are continued in said Duke discharged of all rents reserved in the said two Acts, except as above excepted; and with further provision for making up to him out of profitable lands in cos. Dublin, Louth, Kildare and Cork any deficiencies arising to him from recoveries, evictions, moneys lent, etc., Considering his great losses by eviction from many profitable acres, the reprisals for which to him have proved of far less value than those which were evicted and that whilst such reprisals are by the said Acts to be discharged of all rents reserved, yet same is on condition that he cannot alien any part thereof for payment of debt without the same becoming presently liable to all the rents and payments by the said Acts imposed "and if he should only demise the same for lives or years, yet it may be occasion of great trouble to our said dearest brother if it should always be enquired into whether the full moiety of the improved value be reserved on such leases' therefore the King did by the patent under the great seal of Ireland dated Dublin, 1669, Oct. 16, for ever discharge all the payments, rents, duties and services reserved as above by the said Acts upon any of the said lands of said Duke, and further therein granted similar discharge to all persons claiming by grant under said Duke. |

Now the King considering the said Duke's [further] losses by [further] evictions, for which the Commissioners for executing the Act of Explanation could not set out reprisals by reason of the shortness of time allotted to them and the stock of reprisals being not then known and discovered (whereupon the said Duke has at his own expense discovered concealed lands) and further considering that in the two consequent grants dated, the one at Dublin, 1678, April 3 (of lands to him to the amount of 5,937 acres 0 roods 11 perches), and the other dated at Dublin, 1678–9, Feb. 18 (of 1,351 acres 3 roods 2 perches) (both the said grants being based on the royal signet and sign manual dated Whitehall, 1676–7, Mar. 28) there was no clause inserted for passing the said lands in reprise without any reservation of quit rents (by which omission the quit rent payable by soldiers and adventurers in Ireland is reserved out of all the said two lots of lands) therefore the King hereby orders a patent of grant, release and discharge to the Duke of York of all rents whatsoever by the said two Acts reserved on any lands "which have been lately passed to him in and by our two last letters patent as aforesaid," and of all rents which may hereafter arise and be reserved to the King by reason of any demises made by said Duke in which he do reserve less than a moiety of the improved value. |

The lands in the patent of 1678–9, Feb. 18, contain 1,136 acres 2 roods 10 perches in co. Tipperary (reserved rent 17l. 4s. 7½d.) and 215 acres 0 roods 32 perches in West Meath (reserve rent 4l. 7s. 1¼d.). As Farmers of the Revenue of Ireland we are entitled to a defalcation if these rents (the total being 134l. 7s. 4d.) be discharged. |
