Abstract

The cause of Portington's complaint against Parrish remains unknown. He entered bond to prosecute the case on 13 June 1637 and Dr Duck was due to present the libel on 28 November. On 3 February 1638 a commission headed by Ralph Hopton, esq, was appointed to examine Portington's witnesses from 28 to 30 March at William Brook's Talbot Inn at Hatfield, Yorkshire. No indication of sentence survives.

Summary of proceedings

Dr Duck acted as counsel for Portington and Dr Talbot for Parrish. There were proceedings before Lord Maltravers and Sir Henry Marten on 14 October 1637 and on 28 November 1637 Dr Duck was required to give the libel. On 3 February 1638 Dr Duck nominated on behalf of Portington, Ralph Hopton, esq, Henry Lee, esq, Fra. Bellasis, gent, and John Wright, gent, while Dr Talbot nominated Gilbert Gregory, esq, William Copley, Bryan Cooke and William Crashaw, gents, to meet from 28 to 30 March 1638 at William Brook's Talbot Inn at Hatfield, co. York. On 12 February Sir Henry Marten's verdict was to be heard on the taxing of expenses.

Notes

Roger was the eldest son of Robert Portington, esq, and Isabel, daughter of Sir Richard Darley of Buttercrambe, co. York, knt. He was appointed to the commission of the peace for the West Riding in October 1638. During the civil wars, Roger Portington was a royalist major in the regiment of Sir William Savile. His younger brother Robert was also in arms for the king as a lieutenant-colonel.
