Ordered, That it is referred to the Committee for Privileges, to consider whether a Habeas Corpus lies in the King's Bench against a Prisoner in The Tower, committed from this House; and the said Committee to meet To-morrow Morning, at Nine of the Clock, and report the same to the House.

Message from the H. C. with Ordinances.

A Message was brought from the House of Commons, by Sir Robert Pye Knight, &c. who brought up divers Orders and Ordinances, wherein their Lordships Concurrence is desired.

The Ordinance for Twenty-five Thousand Pounds for Ireland, out of the Excise, was read, and Agreed to.

The Ordinance concerning the Water Guards, was read, and laid aside.

Langham & al. and Lymbery & al.

Upon Report this Day of the Judges, "That they cannot in so short a Time as is allotted them be ready to deliver their Opinions concerning the Case delivered to them, in the Cause between Alderman Langham and Lymbrey:"

Therefore this House Ordered, That the Judges shall have further Time allowed them, till To-morrow Sevennight, on which Day they are to report their Opinions to this House; and in the mean (fn. 1) Time all Proceedings mentioned in the Petition are to be staid, and remain as they are.

Autrobus to be instituted to Leigh;

Ordered, That Sir Nath. Brent shall institute and induct Robert Antrobus Clerk, to the Vicarage of Leigh juxta Tunbridge, in the County of Kent; he producing his Presentation under the Grant of the Earl of Leycester.

and Byfield to Fulham.

Ordered, That Dr. Aylett shall give Institution and Induction to Adoniram Byfeild, to the Rectory of Fullbam, in the County of Midd.; presented thereunto by the Commissioners of the Great Seal.

Ordinance for sale of Bishops Lands.

Next, the House was adjourned into a Committee of the whole House during Pleasure, to consider of the Ordinance for selling the Bishops Lands.

And the House being resumed, the Amendments were reported to the House.

And after Debate;

The Question was put, "Whether to agree to Mr. Blackwell to be One of the Contractors, or no?"

It was Resolved in the Negative.

The Question was put, "Whether to agree that Sir Wm. Roberts shall be a Contractor, or no?"

It was Resolved in the Affirmative.

The Question was put, "Whether Thomas Ayres Esquire shall be a Contractor, or no?"

It was Resolved in the Affirmative.

The Question was put, "Whether Mr. Wm. Prynn shall be a Contractor, or no?"

It was Resolved in the Affirmative.

The Question was put, "Whether Robert Fenwick Esquire shall be a Contractor, or not?"

It was Resolved in the Negative.

The Question was put, "Whether Tymothy Middleton Esquire shall be a Contractor, or not?"

It was Resolved in the Affirmative.

The Question was put, "Whether Edward Cresset Esquire shall be a Contractor, or not?"

And it was Resolved in the Negative.

Ordered, That the further Consideration of the Amendments in this Ordinance shall be taken into Consideration To-morrow Morning, the First Business.

Ordinance for Powell to be Sheriff of Salop.

"The Lords and Commons assembled in Parliament do nominate and approve of Robert Powell Esquire, to be High Sheriff of the County of Salopp; and that the Commissioners of the Great Seal do issue unto him a Commission accordingly."

Ordinance for 25,000l. for Ireland.

"It is this Day Ordained, by the Lords and Commons assembled in Parliament, That Five and Twenty Thousand Pounds shall be paid in Course, out of the Receipts of Excise, to come in upon the several Ordinances of Parliament (after the Credit for Four Hundred Thousand Pounds, and Interest, granted to the City of London, and other Monies formerly charged, shall be first satisfied), with Interest, every Six Months from the Day of the Date hereof, unto Nicholas Loftus Esquire, Deputy Treasurer at Wars for Ireland, or his Assigns, to be employed for the present Service and Relief of that Kingdom, whose Receipt or Receipts for the same shall be to the Commissioners of Excise for the Time being a sufficient Warrant and Discharge in that Behalf: And for the better and more speedy Supply of the Forces there, be it further Ordained, That if any Person or Persons shall advance the said Twenty-five Thousand Pounds, or any Part thereof, by Way of Loan, that every such Person or Persons, their Executors, Administrators, or Assigns, shall be paid and reimbursed the several and respective Sum and Sums of Money which he or they shall advance, out of the Receipts of Excise as aforesaid, together with Interest, at the End of every Six Months, after the Rate of Eight Pounds per Centum per Annum, for so long Time as the same, or any Part thereof, shall be forborn; and that the said several and respective Sums of Money to be advanced for the Uses aforesaid be paid unto the said Nich. Loftus, or his Assigns, whose Acquittance or Acquittances under his Hand, testifying the particular and respective Sums advanced, together with the Receipt or Receipts, Acquittance or Acquittances, under the several and respective Hands of the several and respective Advancers and Lenders thereof, their Executors, Administrators, or Assigns, shall be a sufficient Warrant and Discharge unto the said Commissioners of Excise for the Time being, for Payment of the said Twentyfive Thousand Pounds, and Interest for the same, and every Part and Parcel thereof, accordingly."

Ordinance to continue the Committee and Treasurers at War.

(fn. 2) This Ordinance bears Date 3 Novem. 1646.

"It is Ordained, and be it Ordained, by the Lords and Commons in this present Parliament assembled, That the Committee of Lords and Commons, and Treasurers at Wars named, instituted, and appointed, by an Ordinance of Parliament of the 28th of March, 1645, and continued for Nine Months longer, by an Ordinance of Parliament of the 15th of January last, and the Power and Authority given and appointed by the said Ordinances, and either of them, to the said Committee, Treasurers, and Persons, jointly or severally, or to any of them, named or mentioned in both or either of the said Ordinances, shall endure and have Continuance, to the Intent following, and to no other Intent or Purpose; namely, That the said Committee and Treasurers may hereby have Power, according to the said Ordinances, to take Order for the collecting and receiving the Monies therein mentioned to be collected and received, which are assessed and are yet unpaid, and to dispose and issue the same, and all other Monies in the Hands of the said Treasurers or Collectors, according to the true Intent of the said Ordinances; and that the aforesaid Treasurers at Wars be allowed all such Pay and Allowances as are mentioned and expressed in both or either of the said Ordinances: This Ordinance to continue until the First of January next, and no longer."
