Earl of Manchester, Speaker.

E. of Eath to take the Covenant.

Ordered, That the Earl of Essex, Earl Pembrooke, and the Earl of Suff. do see the Earl of Bath take the Covenant; who withdrew themselves accordingly.

Marston to be instituted to Meriden.

Ordered, That Dr. Aylett, or his lawful Deputy, are hereby authorized and required, upon Sight of this Order, to give Institution and Induction unto Thomas Marston Clerk, to the Vicarage of Meriden, in the County of Warwick, and Diocese of Coventry and Litchfeild, void by the Resignation of Jonathan Grant Clerk, the late Incumbent; the said Mr. Marston producing his Presentation thereunto, under the Hand and Seal of Will'm Wheate Esquire, the lawful Patron, salvo Jure cujuscunque: And this to be a sufficient Warrant in that Behalf.

Gwynns, a Pass to Ireland, and Leave to collect Contributions, on Account of their Distresses.

The Petition of Arthur Gwin and Roger Gwin, was read.

Upon the said Petition of Arthur Gwin and Roger Gwin, Ministers, read this Day in the House; shewing, "That the said Arthur hath his Mother and Two Children Captives with the Irish Rebels; and that Roger Gwin hath his Wife and Five small Children in the City of Corke."

It is Ordered, &c. That the Petitioners be permitted to pass into Ireland, and to return back, with their said Company, without the Lett or Hinderance of any Person whatsoever; and that such good-minded People as please may give their Charity to the said distressed Persons, for their Relief and Comfort in their said Journey.

E. of Bath freed from his Restraint.

Report was made, "That the Earl of Bath hath taken the Covenant."

And thereupon it is Ordered, That the Recognizance of the said Earl of Bath and his Sureties is hereby vacated and made void, as in like Case hath been.

Lord Mayor to prevent the Infection spreading, as much as possible.

Ordered, by the Lords in Parliament, That the Lord Mayor of the City of London is hereby desired to take special Care, that speedy Course be taken, by his Command, for the preventing of the spreading of the Sickness, as much as in him lyeth, within the City and Liberties, by the careful looking to the visited Houses, and not suffering infected Persons to go abroad; and that some Mark be set upon the Doors, or other Notice given, that People may be warned of the said Danger.

Mrs. Dutton's Cause.

The Cause of Mrs. Dutton was brought to a Hearing at the Bar; and the Certificate of the Committee in Com. (fn. 1)

Ordinance for Sequestration.

The Ordinance of Sequestration to be perused by this House To-morrow Morning.

Treasurers at Goldsmiths Hall, for issuing Money contrary to an Order of this House.

Michaell Herring and Richard Wareing, Treasurers at Gouldsmiths Hall were this Day at the Bar; who confessed, "That they had paid off, some Monies after the receiving of the Order of this House, and before that of the House of Commons was sent them, and some since."

And being required to produce the said Order of the House of Commons, they did deliver it; which was read, (videlicet,)

Order of the H. C. authorizing them to do it.

"Die Jovis, 27 Augusti, 1646.

"Ordered, upon the Question, by the Commons assembled in Parliament, That the Treasurers at Gouldsmiths Hall, London, be, and are hereby, required, enjoined, and authorized, to pay the Monies charged upon them by this House, to be by them issued for Colonel Sanderson's Regiment of Reformadoes, and all other Sums of Money that are, or shall be, by this House charged upon them, or required to be issued out by them, notwithstanding any Order or Orders of the House of Lords to the contrary; and this House doth Declare, That the said Treasurers shall, for any Sums that at any Time they shall issue upon Order of this House, be by this House saved harmless, and kept indemnified.

Message from the H. C. with an Order to continue the Commissioners of the Great Seal.

A Message was brought from the House of Commons, by Sir Wm. Lewis and others:

To desire that the Lords will pass an Order for the Continuance of the Commissioners of the Great Seal for One Month longer:

"Ordered, by the and Commons assembled in Parliament, That the Great Seal shall be continued in the Hands of the present Commissioners of the Great Seal for One Month longer."

Put to the Question,

Rejected.

"That such of their Lordships as would have the Order pass as it came from the House of Commons, to say "Content"; others to say, "Not Content"."

Passed in the Negative.

Answer:

That this House will return Answer by Messengers of their own.

Commissioners not to be Members.

Ordered, That Three Commissioners that are not Members of either House of Parliament shall be Commissioners of the Great Seal hereafter.

Message from the H. C. to expedite the Ordinances for the Western and Northern Associations, to i a e the Moiety of the Excise there; and Wright's.

A Message from the House of Commons, by Sir William Lewis and others, in hæc verba:

Ordered, That Sir William Lewis do go to the Lords To-morrow, and put them in Mind, and earnestly press them, to pass the Order for the Moiety of the Excise of the Western Counties, for the Maintenance of their Garrisons; and likewise to pass the like Order for the Moiety of the Excise for the Northern Association; the Ordinance for the Five Thousand Pounds advanced by Mr. Nathan Wright.

Answer:

That the Lords will take this Message into speedy Consideration, and return Answer by Messengers of their own.

Treasurers at Goldsmiths Hall to deliver an Accompt of Monies issued contrary to the Order of this House.

The said Mr. Waring and Mr. Herring, Treasurers at Gouldsmiths Hall, were called in again to the Bar; and were commanded by this House, "That they bring in a Particular of the several Sums of Money that they have paid since the Order of this House was sent unto them, and this to be done between this and Thursday next; and likewise that they bring a Copy of the Order or Ordinance whereby they are authorized or enjoined to obey the Committee of Gouldsmiths Hall, for the issuing out of Monies, against the said Time."

The House was adjourned during Pleasure.

Ordinances for Western and Northern Associations to have a Moiety of the Excise there.

And the Ordinance for the Moiety of the Excise in the Western Association, for the Maintenance of their Garrisons there, and that for the Moiety of the Excise for the Northern Association, was taken into Consideration.

The House was resumed.

And the Ordinances were reported fit to pass, with some Amendments; which were read, and passed by Vote; and Ordered to be sent to the House of Commons, for their Concurrence.

Ordinance to continue the Treasurers at War, &c.; and Wright's.

Ordered, That the Ordinance for Nathan Wright, and that for the Treasurers at Wars, to be considered of To-morrow Morning.

Lord Howard of Est. to search for the E. of Berks Goods brought from Ewe Elm.

Whereas the House did order, on the 28th of August last, "That no Goods of the Earl of Berks, in Ewe Elme, formerly made over to the Lord Howard for the securing of a Debt due unto his Lordship, should be removed thence;" contrary to which, some Persons have brought the said Goods up to London: It is Ordered, by the Lords in Parliament assembled, That the said Lord Howard, or such as his Lordship shall ap point, may make Search for the said Goods, and seize them to his Lordship's Use; and that the Parties that brought the said Goods up to London shall, upon Sight of this Order, attend this House, that such further Direction may be given therein as shall be meet.
