Capt. Zachary's Petition for 200 l.

The Earl of Warwicke reported a Paper from the Committee of the Admiralty, concerning the Widow of Captain Zachary; desiring "she may have Two Hundred Pounds paid her, towards Reparation of her Loss, and Charges sustained."

It is Ordered, To be recommended to the House of Commons.

Gilby and Holder, a Pass.

Ordered, That Mr. Anthony Gilby and Mr. Tho. Holder, with a Servant, shall have a Pass, to go beyond the Seas.

Capt. Cupid's Petition, for Arrears.

Upon reading the Petition of Captain Humfry Cupid; desiring "he may have some Part of his Arrears paid him, to relieve his languishing Necessity."

It is Ordered, To be recommended to the House of Commons.

Ordinance to clear Howard of his Delinquency.

The Earl of Northumb. reported from the Committee, "That they have considered of the Ordinance concerning Mr. Charles Howard; and they have thought it fit to make some Alterations therein, which they offer to their Lordships Consideration."

The said Ordinance with the Alterations were read.

And it being put to the Question, "Whether to approve of this Report now read?"

It was Resolved in the Affirmative.

Then the Ordinance, with the said Alterations, was read the Third Time.

And the Question was put, "Whether to agree to this Ordinance, with the Alterations now read?"

It was Resolved in the Affirmative.

Protest against it.

Memorandum, That, before the putting of the Question, these Lords following desired Leave of the House to enter their Dissent, if this Question was carried against their Vote; which was granted:

Protest against the Ordinance to take off Howard's Sequestration, and clear him of his Delinquency.

"That, before the putting of this Question, Whether the Ordinance above aforesaid shall pass, we desired, and had, the Liberty of Protestation against it, for these Reasons:

"1. The great Necessity of the Kingdom at this Time for Money is such, as all due Means are requisite to the procuring of it; and by this Ordinance there is only Four Thousand Pounds payable, which appears by the Place where it is consigned to be paid, that it is only for his Brother's Wardship, no Sum particularly being expressed therein for his Delinquency; and for that he conceived it to be a Precedent of ill Consequence at this Time, that any One who is declared by Ordinance of Parliament a Delinquent, as by this very Ordinance he conceives Mr. Howard is, should at this Time be discharged without paying or expressing a Sum particularly for such Discharge.

Ordinance for Deputy Lieutenants in Anglesey, &c.

The Ordinance for making Deputy Lieutenants in the Isle of Anglesey, and the County of Carnarvan, was read, and Rejected.

Hayes and Saunders, in Error.

Ordered, That the Writ of Error, between Hayes Plaintiff and Joseph Saunders Defendant, shall be argued Four Days after the Beginning of the next Term.

Platt and Selby.

Ordered, That the Cause between Mr. Platt and Mr. Selby shall be heard on Tuesday Morning next, the First Cause.

Ordinance for the Garrisons in the Western Association to have a Moiety of the Excise.

The Ordinance for the Moiety of the Excise in the Western Association, for the Pay of the Garrisons, was read, and Ordered to be committed to the Consideration of these Lords following:

Any Two, to meet when they please.

Ordinance about 10,000 l. lent for Wales.

The Ordinance for Interest, at the End of every Six Months, for the Ten Thousand Pounds for NorthWales, was read, and Agreed to. (Here enter it.)

Sir T. Bendish, a Pass.

Ordered, That Sir Thomas Bendish, of Bumpsted, in the County of Essex, Baronet, shall have a Pass, to go to Newcastle, to look after some Debts owing him there.

Message to the H. C. about the following Particulars.

A Message was sent to the House of Commons, by Doctor Aylett and Sir Edward Leech:

1. To deliver to them the Ordinance of Mr. Charles Howard, and desire their Concurrence in the Alterations.

2. To desire Concurrence, that Colonel Ketwith may be Governor of St. Mawe's Castle.

3. To recommend to them the Petition of Walter Owen and others, Reformados.

4. To recommend to them the Petition of the poor Widows.

5. To recommend to them the Petition of Captain Cupid.

Ordinance for Interest for the 10,000 l. lent for North-Wales.

"Whereas, by an Ordinance of both Houses of Parliament, of 20 Martii, 1645, Ten Thousand Pounds, with Interest after the Rate of Eight Pounds per Centum, for the Service of the Forces designed for North-Wales under the Command of Colonel Mitton, is ordained to be paid in Course, out of the Receipts of the Excise, but no Provision is thereby made for the Payment of the said Interest at the End of every Six Months; by reason whereof, Lenders are much discouraged from advancing Money upon the Credit of the said Ordinance, by Means whereof the said Service is much retarded: It is therefore Ordained, by the Lords and Commons in Parliament assembled, That every Person and Persons, their Executors, Administrators, and Assigns, who shall lend or advance any Sums of Money upon the Credit of the said Ordinance, shall be paid their respective Interests for the same, after the Rates of Eight Pounds per Centum, out of the Receipts of the Excise, to come in upon the Ordinance of 11th September, 1643, at the End of every Six Months from the Time of such their lending or advancing, until the said Ten Thousand Pounds become due in Course; and that then they, and every of them, shall be paid their Principal Monies which they shall so lend or advance, together with such remaining Interest, after the Rate aforesaid, as shall be then due for the same, out of the said Receipts of the Excise so to come in as aforesaid; and the Commissioners of Excise for the Time being are hereby authorized and enjoined to make Payment of the said Principal and Interest to such Lenders and Advancers, their Executors, Administrators, and Assigns, accordingly, whose Receipt or Receipts for the same shall be a sufficient Discharge to the said Commissioners of Excise for the Time being, and every of them respectively, for Payment of the said Principal and Interest accordingly."
