Sutton in Holderness Enclosure, Bill.

A Message was brought from the House of Commons, by Mr. Hewitt and others:

With a Bill, intituled, "An Act for enclosing and dividing several Lands and Grounds in the Parish of Sutton in Holderness, in the County of York;" to which they desire the Concurrence of this House.

The said Bills were severally read the First Time.

Evenwood Moor Enclosure, Bill.

The Earl of Marchmont reported from the Lords Committees to whom the Bill, intituled, "An Act for enlarging the Times appointed by an Act passed in the Second Year of the Reign of His present Majesty, for dividing and enclosing a certain Moor, or Common, within the Manor of Evenwood and Chapelry of Saint Helen's Auckland and County of Durham, for certain Arbitrators therein named to make their Awards, and for certain Commissioners therein mentioned to set out, divide, and allot, the said Moor or Common," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Draycott Enclosure, Bill.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing the Common Fields, Common Meadows, Common Pastures, Common Grounds, and Commonable Lands, in the Manor of Draycott, in the Parish of Wilne, in the County of Derby," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Greetham Common Bill.

The Lord Willoughby of Parham also reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing the Open and Common Fields, Heath, and Waste Grounds, within the Manor and Parish of Greetham, in the County of Rutland," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Mackenzie & al. Magistrates of Dingwall against Col. Scott & al.

Counsel were called in, to be heard, in the Cause wherein John Mackenzie of Brae and Donald Marison are Appellants, and Colonel John Scott and others are Respondents.

And the Counsel for the Appellants having been fully heard:

The Counsel on both Sides were directed to withdraw.

Ordered, That the further Hearing of the said Cause be adjourned till Monday next; and that the Counsel be called in precisely at Twelve o'Clock; and that, when the said Hearing is finished, their Lordships will also, on Monday next, proceed to hear the Cause upon the other Appeal of the same Parties, and His Majesty's Advocate for Scotland Appellants, against the same Respondents; and that the Counsel be called in, and acquainted therewith.

Whereupon the Counsel were again called in, and acquainted therewith by the Speaker.

And then they were again directed to withdraw.

D. of Bedford, Lands in Tavistock to vest in him, Bill.

After reading, and considering, the Report of the Judges to whom was referred the Consideration of the Bill, intituled, "An Act for vesting certain Lands, Tenements, Rents, and Hereditaments, in the Parish of Tavistock, in the County of Devon, and elsewhere, in his Grace John Duke of Bedford; and for settling and assuring, in Lieu thereof, a Rent Charge of greater Value, to be issuing out of Lands and Tenements belonging to the said Duke, for the Purposes in the Bill mentioned."

Mackenzie et al. Magistrates of Dingwall against Col. Scott & al.

After hearing Counsel, as well on Friday last as this Day, upon the Petition and Appeal of John Mackenzie of Brae Baillie, and Donald Morison Treasurer, of the Borough of Dingwall for the Year immediately preceding Michaelmas 1758; complaining of Part of an Interlocutor of the Lords of Session in Scotland, of the 8th of August 1759; and of Six whole Interlocutors of the said Lords, of the 12th of December 1759, the 29th of February, the 13th of June, the 23d of July, and Two of the 5th of December 1760; and praying, "That the same might be reversed, varied, or altered; or that the Appellants might have such Relief in the Premises as to this House should seem just:" As also upon the Answer of Colonel John Scott, Kenneth Bayne of Tulloch, Kenneth Mackenzie Provost, Andrew Robertson Treasurer and Town Clerk, Colin Mackenzie late Baillie, and Thomas Mackenzie of Highfield Baillie, Alexander Mackenzie late Baillie, John Mackenzie late Baillie, John Robertson late Dean of Guild, Donald Morison late Treasurer, John Dingwall Writer in Edinburgh, William Mackenzie of Balmaduthie Advocate, William Mackenzie of Struthgarvie, Alexander Mackenzie of Muirhouse, and Murdoch Mackenzie in Dingwall, Counsellors, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Certificate of the Election of the E. of Sutherland to be One of the Sixteen Scots Peers.

This Day the Deputy Clerk of the Crown in Chancery delivered a Certificate of the Name of the Peer of Scotland, who, by virtue of His Majesty's Proclamation, is chosen to sit and vote in this House; which is as follows; (videlicet,)

"May it please your Lordships,

"We do hereby certify, that, by virtue of His Majesty's Royal Proclamation, dated the Tenth Day of January 1763, a Certificate under the Hands and Seals of Thomas Gibsone and Alexander Tait Esquires, Two of the Principal Clerks of Session attending the Election after-mentioned, in virtue of the Lord Clerk Register's Commission to them granted, hath been delivered into the Crown Office in Chancery; whereby it appears, that the Right Honourable William Earl of Sutherland was elected and chosen to sit and vote in the House of Peers, in this present Parliament, in the room of John Marquis of Tweeddale, deceased.

"Given under our Hands, this 15th Day of March, 1763.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing several Commons and Waste Grounds within the Manor and Township of Lowton, in the County of Lancaster," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

The Lord Sandys reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing the several Open and Common Fields, Common Meadows, Commons, and Waste Grounds, within the Manor and Parish of Scropton, in the County of Derby," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Carmarthenshire Roads, Bill.

The Lord Sandys also reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing, widening, and keeping in Repair, the High Road leading from the Fourteen Mile Stone in the Parish of Mothvey in the County of Carmarthen, through Llandovery, to Llydiad y Gwyn in the Parish of Llandilo-vawr, and from thence, by Cledsulch and over Duless Bridge, to the Town of Llandilovawr, and from the said Town, along the Post-Road by Rhwyradar, through the County Botough of Carmarthen, and Village of Saint Clears, to Tavern Spite in the Parish of Kiffig at the Borders of the County of Pembroke," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Barnstaple Roads, Bill.

After hearing Counsel, as well Yesterday as this Day, upon the Petition and Appeal of James Grosett of London Merchant; complaining of an Interlocutor of the Lords of Session in Scotland, of the 16th of February 1762; and praying, "That the same might be reversed, varied, or altered; or that the Appellant might have such other Relief in the Premises as to this House should seem just:" As also upon the Answer of Sir James Murray, Receiver General of His Majesty's Customs in Scotland, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Interlocutors reversed.

The House (according to Order) proceeded to take into Consideration the Motion made Yesterday, for dispensing with the Standing Order, requiring Fourteen Days Notice to be given of the Time of the Meeting of Committees on Private Bills, so far as that the Commitee to whom the Bill, intituled, "An Act to discharge certain Manors and Lands in the County of Bedford, the Estates of the most Noble George Duke of Marlborough, from certain Trusts and Agreements created and entered into by the said Duke, whereby the said Estates were to be settled on Lord Charles Spencer, Brother to the said Duke, and his Issue, in strict Settlement; and for settling other Lands and Hereditaments, in the County of Oxford, in Lieu thereof; and likewise for varying and carrying into Execution certain other Trusts and Agreements of the said Duke, for the making a Settlement of certain Manors and Lands in the County of Lincoln upon Lord Robert Spencer, now an Infant, another Brother of the said Duke and his Issue, in like strict Settlement; and for other Purposes," is committed, may meet on an earlier Day than is appointed, in regard of the approaching Conclusion of the Session.

And Consideration being had thereof accordingly:

Sir Wm. Maynard's and Jesus College, Bill:
