Kerr and Pollock against Wallace & al.

The Answer of Janet Wallace and Thomas Buchanan, to the Appeal of Thomas Kerr and Robert Polloch Merchants, was brought in.

Ord's Bill.

The Earl of Marchmont reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting divers Lands and Hereditaments in the Parish of Igborough, in the County of Norfolk, Part of the settled Estate late of Henry Ord Esquire, deceased, in Trustees, to convey the same to James Nelthorpe Esquire and his Heirs; and to lay out the Money to be paid for the same in the Purchase of other Lands and Hereditaments, to be settled to the Uses therein mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made some Amendments thereto; which, together with the Reasous offered to the Committee for dispensing with the Standing Order requiring an Agreement for the Purchase of another Estate to be settled in Lieu of that to be sold, upon this Bill, he was ready to report, when the House will please to receive the same."

Ordered, That the said Report be received Tomorrow.

Then it being moved, "That the said Standing Order be dispensed with in this Case:"

Ordered, That the said Motion be taken into Consideration To-morrow; and the Lords to be summoned.

Portesham, Enclosure Bill.

The Earl of Shaftesbury reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing several Common Fields, Commons, Common Heaths, and Waste Grounds, in the Parish of Portesham, in the County of Dorset," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Shenley Brookend, Enclosure Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for dividing and enclosing the Open and Common Fields in the Manor of Shenley Brookend, in the Parish of Shenley, in the County of Bucks."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. that the Lords have agreed to it.

A Message was sent to the House of Commons, by Mr. Harris and Mr. Daval:

To acquaint them, that the Lords have agreed to the said Bill, without any Amendment.

Skipsea, Enclosure Bill.

A Message was brought from the House of Commons, by Sir George Savile and others:

With a Bill, intituled, "An Act for confirming Articles of Agreement, for enclosing Common Fields, Commons, Pastures, and Waste Grounds, in the Townships or Hamlets of Dringhoe, Upton, and Brough, in the Parish of Skipsea in Holdernesse, in the East Riding of the County of York;" to which they desire the Concurrence of this House.

Doncaster and Salter's Brook, Road Bill.

A Message was brought from the House of Commons, by Sir George Armitage and others:

With a Bill, intituled, "An Act for continuing the Term and Powers of an Act, made in the Fourteenth Year of the Reign of His late Majesty, intituled, "An Act for repairing the Road from Doncaster, through the Parish of Peniston in the County of York, to Salter's Brook in the County of Chester, and also the Road from Rotherham in the said County of York, to Hartcliffe Hill in the said Parish of Peniston; and for making the said Act more effectual," so far as the same relates to the said Road between Doncoster and Salter's Brook;" to which they desire the Concurrence of this House.

Sudbury Road, Bill.

A Message was brought from the House of Commons, by Mr. Holt and others:

With a Bill, intituled, "An Act for repairing and widening the High Road leading from the North End of Ballingdon Bridge in Sudbury in the County of Suffolk, to The South Gate in Bury Saint Edmunds in the said County;" to which they desire the Concurrence of this House.

Rotherham, Enclosure Bill.

A Message was brought from the House of Commons, by Sir George Savile and others:

With a Bill, intituled, "An Act for enclosing and dividing the Common Fields, Moors, and Common Grounds, in the Township of Rotherham in the County of York;" to which they desire the Concurrence of this House.

Bum-Boats, to prevent Thests, &c. by, Bill.

A Message was brought from the House of Commons, by Mr. Cooke and others:

With a Bill, intituled, "An Act to prevent the committing of Thests and Frauds by Persons navigating Bum-Boats and other Boats upon the River Thames;" to which they desire the Concurrence of this House.

The said Five Bills were severally read the First Time.

Report of Commissioners of the annexed forfeited Estates in Scotland, delivered.

The House being informed, "That Mr. Rowe, from the Treasury, attended:"

He was called in; and delivered, at the Bar,

"Copy of the Report of the Commissioners and Trustees of the annexed forfeited Estates in Scotland, to the Lords Commissioners of His Majesty's Treasury; which, by an Act of the Twenty-fifth Year of His late Majesty, is directed to be laid before both Houses of Parliament, dated 26th November 1761."

And then he was directed to withdraw.

And the Title thereof being read, by the Clerk:

Ordered, That the said Report do lie on the Table.

Account of Ships employed in the Whale Fishery.

The said Mr. Rowe, also attending from the Commissioners of the Customs in Scotland, was called in; and delivered, at the Bar, pursuant to the Direction of an Act of Parliament,

"An Account of what Number of Ships from Scotland have been employed in the Whale Fishery to Davis's Streights and The Greenland Seas; with their respective Names and Burdens; from whence they were fitted out, and at what Port they were discharged; and also what Quantity of Oil and Whale Fins each Ship has imported, from the 10th of October 1760."

And then he was directed to withdraw.

And the Title thereof being read, by the Clerk:

Ordered, That the said Account do lie on the Table.

Court of Session in Scotland, Adjournment, Bill.

Hodie 1^a vice lecta est Billa, intituled, "An Act for enabling the Judges of the Court of Session in Scotland to make an Adjournment of the said Court for such Time, betwixt the Twentieth Day of December and the Fifteenth Day of January Yearly, as they shall judge most convenient, not exceeding Twenty Days."

Kingston upon Hull, small Debts, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for the more easy and speedy Recovery of small Debts, within the Town and County of the Town of Kingston upon Hull."

Ordered, That the said Bill be committed to the Consideration of the Lords following:

Their Lordships, or any Five of them; to meet on Friday next, at Ten o'Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.

Wettstein, Leave for a Nat. Bill:

Upon reading the Petition of Luke Wettstein; praying, "That Leave may be given to bring in a Bill for his Naturalization:"

It is Ordered, That Leave be given to bring in a Bill, according to the Prayer of the said Petition.

Accordingly, the Lord Delamer presented to the House a Bill, intituled, "An Act for naturalizing Luke Wettstein."

The said Bill was read the First Time.

Register of Parish Poor Infants, Bill.

A Message was brought from the House of Commons, by Mr. Rose Fuller and others:

With a Bill, intituled, "An Act for the keeping regular, uniform, and annual Registers of all Parish Poor Infants, under a certain Age, within the Bills of Mortality;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Sproatley, Enclosure Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for dividing, allotting, and enclosing, the Open Fields, Pastures, and Pieces or Parcels of Meadows and Pasture Ground, in the Lordship of Sproately in Holdernesse, in the County of York."

Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed:

Their Lordships, or any Five of them; to meet on this Day Sevennight, at the usual Time and Place; and to adjourn as they please.

Quorndon; Enclosure Bill.

The Lord Delamer reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing the several Open and Common Fields, Meadows, and Commons, within the Lordship or Liberty of Quorndon, in the County of Leicester," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ward against Browne & al.:

The House being informed, "That Mr. George Cannon attended, in order to deliver in Copies of Papers and Proceedings, relating to a Cause depending in this House, wherein James Ward is Appellant, and Thomas Browne and others are Respondents:"

Pleadings proved:

He was called in, and delivered the same at the Bar; and attested upon Oath, "They were true Copies, he having examined them with the Originals in the proper Offices in Ireland."

And then he withdrew.

Kerr & al. against Wallace & al.

The House being moved, "That a Day may be appointed, for hearing the Cause wherein Thomas Kerr and Robert Pollock Merchants are Appellants, and Janet Wallace and Thomas Buchanan Respondents:"

It is Ordered, That this House will hear the said Cause, by Counsel, at the Bar, on the First vacant Day for Causes after those already appointed.

Ram's Bill.

The House proceeded to take into Consideration the Amendment made by the Commons to the Bill, intituled, An Act for discharging certain Leasehold Houses and Tenements, comprised in the Marriage Settlement of Humfreys Ram Esquire, from the Trusts of that Settlement; and for settling Freehold Houses, of greater Value, in Lieu thereof."

And the said Amendment, being read Three Times by the Clerk, was agreed to.

And a Message was sent to the House of Commons, by Mr. Harris and Mr. Daval, to acquaint them therewith.
