868. [f. 148v] Summary of the statute (fn. 1) by which rents may be recovered in the city of London.
869. Form of the writ (fn. 2) to be issued to the mayor and sheriffs in a case of non-payment of arrears of rent.
870. Note: the form (natura) of this writ appears in a plea held in the Husting on the Mon. after or before 6 Dec. 19 Ed. II between the abbot of Waltham and Adam le Treyer concerning a wharf called Holyrodewharf.
871. [f. 149] (fn. 3) In the time of King Edgar [959–75] thirteen knights 'satis amabiles' obtained from the king derelict land in the eastern part of London. It was granted on condition that each of them should fight three duels, one on land, one below [ground] and one in the water and this was done on one day on what is now called Estsmethfeld. On that day the king named the body the 'knyghtegilda' and defined its limits: from Aldgate to the place where the bars (barre) now are, towards the east on both sides of the lane towards the gate now known as Bishoppesgate to the house of William the priest, afterwards of Geoffrey the Tanner then of the heirs of Coluere and then of John Esby now 'de Bursere' and to the south to the Thames as far as a horseman riding into the river at low tide can throw a lance. So all Estsmethfeld with part of the lane on the right going to Doddyngpond in the Thames and the land which now has the hospital of St. Katherine with the mills and the outer wall and the new ditch (fossatum) of the Tower stand part of the fee. The wall and the ditch were built by the bishop of Ely as justiciar during Richard's absence in Jerusalem and by this Holy Trinity lost ½ mark of rent and the mill was removed because it was in the way and the greater part of a garden destroyed but Edward I gave them 5½ marks p.a. The knights had no further charter from Edgar, Aethelred or Cnut but their heirs obtained one from Edward the Confessor [See also after 872].
872. [1042–4] King Edward to Bishop Aelfweard and Wulfgar, portreeve, declares that his men of the gild of English 'cnihtas' are to have their sake and soke within borough and without over their lands and over their men and as good laws as they had in the days of King Edgar and of the king's father and of Cnut. (fn. 4)

871 contd. The priory was founded in 1108. In 1125 certain burgesses of London, descendants of the noble English knights, namely Ralph son of Algod, Wlunard le Douerisshe, Orgar le Prude, Edward Hupcornhille, Blakstan, Alwin his relative, Alwin and Robert his brother sons of Leofstan, Leofstan the Goldsmith and Wizo his son, Hugh son of Wlgar, Algar Secusne, Orgar son of Deremann, Osbert Drinchepyn, Adelard Hornepitesune came to the chapter house and gave to the priory the land and the soke of the 'Anglisshe cnihtegild'. And to establish this they laid Edward the Confessor's charter on the altar and formally offered the church of St. Botolph without Aldgate; witnesses, Bernard prior of Dunstable, John prior of Launde, Geoffrey chamberlain de Clynton, Peter and Nicholas Ci(m)and, [f. 150] William the clerk, Edward son of Alfward, Hugh son of Ralph, his dapifer and chaplain, Edward de Southwark and William his son, Leuegar the priest, Eilwin son of Syredus, Haco the deacon, Algar the priest, Aschellus and many others. The donors sent Orgar le Prude to Henry to obtain his confirmation [See after 875].
875. [1126] Notification by Henry I addressed to Richard bishop of London and to the sheriff and reeve and all of London and Middlesex confirming the grant by the cnihtengild of the land and of the church of St. Botolph to Holy Trinity; witnesses, Adeliza the queen, Geoffrey the chancellor, Geoffrey de Clinton, William de Clinton; at Woodstock. Enrolled in Memoranda Book 'C' (fn. 6) at the Guildhall.

871 contd. Henry sent Alberic de Ver and Roger the nephew of Hubert to invest the church with its possession. After the collation of the church of St. Botolph, Holy Trinity had the church and its large garden and a canon was appointed to supervise the property and to administer the sacraments to the parishioners. This was in accordance with a letter of Innocent III.
876. Letter of Innocent III permitting Holy Trinity to serve the churches of St. Botolph, St. Katherine and St. Michael [f.150v] by two of their canons: at the Lateran 18 May 1201.

871 contd. Before the acquisition of the soke Laurence Houndsditch paid 6s. 8d. p.a. to the Knyghtgylde and Prior Norman became seised of this rent from a tenement from which Robert de Retherhethe and Agnes his wife, daughter of Laurence Salamon son of Laurence Houdesditch, gave [a further] 3s. rent.
877. [1294–1302] Agreement between Stephen prior and convent and John de Cambio of Canterbury, clerk, that the prior and convent have granted to John a piece (placea) of land; abutments, the tenement of Agnes de la More on the east, a tenement of the aforesaid John on the west, the tenement of John le Cofferer on the south and between the great garden of the priory on the north; the grantee, his heirs and assigns to cause to be made their own fence (propriam clausuram) and maintain it; the piece contains 12 perches in length and 10 perches in width; rent 9s. 3d. p.a.; the said John ex Cambio [f. 151] granted to the prior and convent a certain piece (quandam particulam) of the above-mentioned tenement lying between the great garden on the east and the new garden of the priory on the west and between the land of the said John on the south and that of the bishop of London on the north, containing in length 30½ perches and in width 5 perches; exchange sealed by both parties; witnesses, Edmund Trentmars, Peter Berneval, John Pottere.

Indenture made between the prior and convent and John de Norton, citizen, and Alice his wife witnesseth that the prior and convent has granted to them a certain piece of the priory garden; abutments, the tenement of the said John on the west and the said garden on the east; in width 2½ ells and in length extending to the fountain which is between the two tenements on the south and the great garden of the prior and convent on the north, which length is 46½ ells; rent 2s. p.a.; the easement to the spring being protected in perpetuity (aisiamento fontis … salvo imperpetuum) so that the costs and repairs shall be, in perpetuity, shared between the two parties to the indenture, their heirs and assigns; whoever defaults in this respect shall lose the easement; John and Alice pledge for themselves and their successors all their built-up tenement next to this plot that the prior may distrain therein for the rent of 2s. 897. Note: that John Cory at the instigation (excitione) of substantial men of the City with the agreement of Prior Nicholas asked Michael Northburgh, bishop of London, to consecrate a toft at the rear of the said land (unum toftum aretro dictam terram) as a burial ground so that this field is called the cemetery of Holy Trinity. In which place Edward III with the consent of the prior and convent founded the abbey of St. Mary Graces A.D. 1359 (fn. 36) and so the rent of 2s. 6d. [mentioned in 951] was paid by the abbot.
953. Total of this parish £8 6s. 8½d. and yet it is tithed at £14 10s. 1d. as appears in the king's exemplification.
954. [f. 166v] Agreement made in 1412 between William Wodeward, founder, John Kokyr, incumbent (ico[nim]os) of the church of St. Botolph without Algate, John Cornwaleys, Robert Borford, John Byrd, John Edward, John Bray, Thomas Brygth and other parishioners and William Haradon, prior of Holy Trinity and rector of St. Botolph by the mediation (medianter) of Thomas Axbrygg, canon, concerning a chantry in the church for the soul of John Romeney, once citizen and potter (ollarii), of London, whose executors had left the custody of it to the prior, which custody was in fact exercised by the parishioners. The prior conceded the custody to the parishioners reserving to himself and to Holy Trinity an annual quit rent. The parties chose two men, John Cornwaleys for the parishioners and Richard Osberne, clerk of the Chamber at the Guildhall, for the prior and convent, to examine the evidences and they found that the prior and convent were seised by John Romeney of an annual quit rent of 6s. 8d. from one of his houses now inhabited by John Haverill; abutments, the tenement of Henry atte Hook on the west and that once of John Romeney now of John Hamerton on the east; and also of 8d. p.a. from two shops once belonging to John Romeney situated between the tenement of John Hamerton on the west and Spytillane on the east; and also of 2s. 10d. p.a. from three other tenements of John Romeney which Nicolas Taillour and John Wiryng had by a lease of the prior and convent situated between the tenement of John atte Lee on the north and those of the prior and convent and of the abbess of the Poor Clares (Sancte Clare) on the south; and also of 13s. 4d. p.a. from the same tenements which William atte Hale bequeathed to the prior and convent as appears in his will (fn. 37) enrolled in the Husting of Common Pleas, Mon. 20 Nov. 1368. The parishioners promised to pay the total annual rent of 23s. 6d. [f. 167] For this agreement the prior and convent agreed to pay to John Dalby the chantry priest and his successors. 26s. 8d. p.a., to be paid by Thomas [Axbridge] and his successors from the profits of the church of St. Botolph except at any time when the said church be let to farm by the prior and convent. The prior and convent grant all the brewhouse equipment (omnia utensilia et vasa sua bracine) in the tenement which John Haverill holds to the parishioners on condition that all the aforementioned obligations are performed and, if they are not, the prior and convent have the power to enter the house and remove the equipment; witnesses, William Norton, alderman and others.
955. Licence was granted to Edmund son of Henry III to assign certain tenements held of Holy Trinity to the abbey of the Poor Clares. Release to Juliana abbess of St. Mary without Alegate of the order of St. Clare, of all claims for the priory or for the church of St. Botolph which the prior had, saving to Holy Trinity the canonical portion according to the papal statute if any of the parishioners of Holy Trinity dwelling outside the bounds of St. Mary's seek burial in that abbey and a rent of 16s. 9½d. p.a. The tenements, which Edmund made over to the abbess were held of Holy Trinity at the above-mentioned rent and were once held by Master Thomas de Bredstre, William the Shoemaker (Sutor), Alexander son of Geoffrey le Coureur and Hodierna his wife, William de Waltham, Helen his wife, Adam le Windraker (fn. 38) and Alice his wife, and Thomas de la More and also those of Solomon le Tuler and John Golcorn. The prior and convent granted tithes to the abbey as it had obtained exemption of all such payments from Boniface VIII. [f. 167v] Holy Trinity freed all their men who lived within the ambit of the abbey. The limits of abbey contained in length on the west side from the tenement formerly of Gilbert de Thotenham, potter, to that of Simon the Tiler, 15 perches 7 ft. and within the limits (distantibus) 5 perches 3 ft. from the outer door of the sisters on the west side from the south side of the tenement which was formerly Solomon's as far as the tenement once of Peter Berneval near (sub) the tenements of Ranulf Alan and Nicholas John, potters, and John Goldcorn, 14 perches 6 ft. Also on the east side next the field of Eadmund Trentemars from the tenement of Peter Breneval [sic] as far as the tenement formerly of Gilbert the Potter (Potater) 27 perches and in width on the south side from the said field to the king's street 24 perches and on the north side next the tenement of P. Breneval from the aforesaid field to the tenements of John Goldcorn and John Poter 20 perches. Release by Katherine abbess of the monastery of St. Clare, after a lawsuit, of rights in a certain plot with a little house built upon it and to a rent of 12d. p.a. therefrom; abutments, the tenement formerly of Robert de Gadesby on the north and the enclosed field? (ceptum) of St. Mary's on the south and its tenement situated next to the outer gate of the monastery on the west and the earth wall (murum terrenum) lying next to the little garden of St. Mary opposite the gate leading to the dwelling in which the lady de Clare (domina de Clara) lived a short time ago, on the east, containing in length 20 ells and in width 10 ells; the prior and convent to have the right to enter and distrain; [f. 168v] sealed; dated London 16 Nov. 1374.

958. [f. 169] Composition made between Nicholas prior and convent and the abbey and convent of St. Mary Graces; starts with a memorandum as to how the abbey was founded by Edward III at the time of the pestilence and records the inadequacy of space for the burial of the victims and the consequent consecration of a new cemetery near the Tower of London; the establishment of this Cistercian house within the parish of St. Botolph without Algate, led, as this church was annexed to Holy Trinity, to a conflict between the two houses on oblations and tithes upon which Simon bishop of London adjudicated; it was decided that 100s. p.a. should be paid to Holy Trinity in compensation, to be paid by the sheriff out of the farm of London and Middlesex; in return, all the tithes and oblations from certain tenements should not be paid to the parish church but to the abbey; [f. 169v] namely, a toft lying on the east next to a common field between Hoggestrete on the north and the garden of St. Mary Graces on the south containing 147 ells in length and in length on the west side extending from Hoggestrete to the garden of John de Cory, clerk, and across a certain plot also for the cemetery up to the holding of the abbot on the south, 123 ells 2ft. with the thickness of the earth wall in Hoggestrete and the north end of the plot contains 93 ells and the south end contains 65 ells; the lands and tenements formerly of Helen Cros and Nicholas de Dedynton where the monks were living on the 'buttancia' on 'le Tourhill' containing in width 24 ells upon which a gateway opening on to Tower Hill had been built; also the tenements formerly of John de Basyng and Geoffrey de Henewade situated between those of Helen and Nicholas on the north and that of John de Parys on the south containing along Tower Hill 26¼ ells; also a tenements formerly of John Brawstok abutting on the south on (super) the street which leads from Tower Hill towards Duddyngespond situated between the tenement once of Richard de Parys on the east and the west and containing in width 24½ ells 2 ins.; also a tenement once of Peter atte Vyne abutting on the same street situated between the tenement of Richard de Parys on the west and that of William de Box on the east and containing in width 127/8 ells; also a tenement once of Henry de Sutton, William Baconn and Alice his wife, of Richard le Porter and Lucy his wife and Matilda Sewtyng sister of Lucy and Geoffrey Waterleder abutting on the same street situated between the tenement of William Box on the west and that of William Game on the east containing in width 703/8 ells 7 ins.; and also a tenement of William Game situated between tenements of the said William on the west, east and north containing [f. 170] in width 3¾ ells; all these tenements are in the county of Middlesex and extend from Tower Hill on the west and from the said street on the south towards the cemetery and garden of the abbot and convent of St. Mary Graces except one piece of a tenement once of Geoffrey Waterlader which extends above the common field on the north. Cession by Holy Trinity of all tithes, oblations and other spiritual obventions from burials etc. and the bishop decreed that if St. Mary Graces should acquire more lands etc. in the parish all parochial rights were to be reserved to Holy Trinity; sealed by the bishop and chapter of St. Paul's and by Holy Trinity; dated 20 Mar. 1364.

960. Note: Othwerus once custodian of the Tower of London and his successor Aschuillus disputed control over part of the soke of the Englyschkynztengyld with Holy Trinity. Prior Norman asked King Henry that justice be done to which the king agreed but the matter was not settled before his death. In the second year of King Stephen's reign the prior aided by Matilda, Stephen's wife, Algar bishop of Coutances, Roger then chancellor, Arnulf archdeacon of Sées (Sagiensi), William Martel dapifer, Robert de Curcy, Alberic de Ver, Geoffrey de Mandeville, Hugh le Bigot, Adam de Balnai, Andrew Buch(iun)te and many others, citizens of London, approached the king who agreed that a day be appointed to settle the matter. It was shown that the part of the soke in dispute belonged to the rest of the soke and had so belonged since the time of Edward the Confessor and this was proved by the oaths of twenty-one men; Orgar the monk surnamed le Prude, Ailwin son of Rad(uin)fi, Estmund, Alfric Cheic, Brictred Cuherd, Wlfred, Semar, Batun, Alsius, Berman, Wlpsus the Smith (Faber), Alfwin Halle(n), Leues(in)e the Smith, Wlwinus Abbot, Ailwin the clerk, Algar brother of Geraldus, Wlfric the Butcher (Carnifex), Elfiet Cugel, Wlfric, Edric Modlieuesune, Godwin Balle and many others were ready to testify but this number was judged sufficient.

964. Record of a disagreement between Holy Trinity and Ailward priest of St. Peter in the bailiwick of the Tower in the third year of Henry II's reign 1157, when Ralph was prior and Hugh de Mateni (fn. 42) archdeacon, the cause of which was that Ailward took off for burial the body of Godlune wife of Eilricus 'rusticus' of Smethefeld claiming her as his parishioner when Witthulfus the priest of St. Botolph had performed the last rites. Holy Trinity went to the archdeacon but Ailward appealed to him without the knowledge of the convent and the official was persuaded to allow the burial in the cemetery of St. Peter, [f. 172] The dispute as to parochial boundaries was settled and all Smethefeld and all the street and all the ponds of Dudyngspond were adjudged to be in the parish of St. Botolph as it had been in the time when Robert had been priest of St. Botolph and Derman(n)us priest of St. Peter to which Archbishop William had testified as appears in the following.
965. [1125–36] Letter from William (fn. 43) archbishop of Canterbury to W. (fn. 44) the dean, the archdeacon and the chapter of St. Paul's ordering that the parish of St. Botolph be vested in Prior Norman which parish has been adjudged his in the chapter before the archbishop.
966. [1128–34] Letter from Gilbert bishop of London to William and Haco (Hacone) the dean ordering them to do justice to the canons of Holy Trinity concerning the parish of St. Botolph of which Derm(m)anus the priest of the Tower (sacerdos de Turre) has unjustly deprived (aufert) them; also the entire chapter of St. Paul's is admonished to help them to recover the parish as quickly as possible.

Note: that the day following the chapter which had been held on Wed. in the 4th week of Lent 1157 the 'rusticus' came into the church of Berkyngchirch and divided the oblation, as had been ordered, and gave to Withulfus, in the presence of Prior Ralph and Walter and Elias, canons, and Ralph the dean and Master James, a cloak (pallium), a roe-buck? (che(v)sam) and six sheep.
969. Note: that in 1166 Robert the Philosopher brought Holy Trinity again into the case of the parish of Smethefeld, having obtained a royal writ, saying that his church had been unjustly deprived of three sheep while he was absent in the king's service in the army of Toulouse (Tologe). Many times the prior was called before Archdeacon Nicholas also before Gilbert bishop of London, when it denied the claim and produced witnesses to show that the deceased woman was a parishioner of St. Botolph and Robert was induced to renounce his claim and this was done at Westminster on 9 May on the same day that a plea was heard between Earl Alberic and his wife which went on appeal to the pope.

[c. 1166] Letter of Nicholas archdeacon of London to all faithful reciting the cause of dissension as to whether Smithfield was in the parish of St. Peter in the Tower (in pedeplanis Turris) or in the parish of St. Botolph and that Robert had renounced his claims and that it was in the parish of St. Botolph without Algate.

Note: that King Stephen and Matilda his wife gave to Ralph prior and convent of Christchurch London 6 librates in the manor of Braching in exchange for a mill of the convent and for that part of land which Earl Geoffrey occupied to make a vineyard in which place Queen Matilda founded the hospital of the poor.
