Maryland.

Read an Order of the Lords Justices in Council, dated August 27th, 1752, referring to the Board for their consideration the petition of the Right Hon. Arthur Onslow and John Sharpe, Esquires, guardians of the Right Honourable the Lord Baltimore, a minor, praying that their Excellencies will postpone the taking of the petition of the Proprietors of Pennsylvania relative to the ascertaining of limits into consideration till his lordship attains the age of twenty one.

Maryland.

Their lordships agreed that the said order of reference should be taken into consideration on Thursday next, the 9th instant, the day appointed for the consideration of Mr. Penn's petition and that the Secretary do write to the agents for Lord Baltimore's guardians to acquaint them therewith.

New York.

Read a letter from Peter Wraxall, Esquire, to the Earl of Halifax, dated at New York, July 25th, 1752, transmitting:—
The case of Peter Wraxall, Esquire, with respect to Mr. Clinton's refusal to admit him to the offices of town clerk, clerk of the peace, etc. (to which offices he was appointed by his Majesty) with proofs annexed.

The draught of a representation to their Excellencies, the Lords Justices, upon this affair having been transcribed pursuant to the minutes of the 21st of July last, was laid before the Board and signed.

Wednesday, November 8. Present:—Earl of Halifax, Lord Dupplin, Mr. Fane.

Nova Scotia.

Mr. Kilby, agent for the settlement of Nova Scotia, attending, laid before the Board a memorial prepared by him in order to be presented to the Lords Commissioners of his Majesty's Treasury, proposing that £15,321 12s. 2d. may be issued to him for payment of certain demands made by Messrs. Baker, Townshend and Woodford, for victualing the troops in Nova Scotia, and also for the discharge of certain bills of exchange drawn by Governor Cornwallis for the service of the said colony, which memorial their lordships were pleased to approve and to direct Mr. Kilby to present the same to the Lords Commissioners of his Majesty's Treasury for their directions thereupon.

New York.

The draught of a letter to Mr. Clinton, Governor of New York, transmitting to him a copy of the Board's representation to the Lords Justices upon Mr. Wraxall's memorial and directing Mr. Clinton to answer to Mr. Wraxall's charge against him for selling the office of town clerk of Albany for £300, having been prepared, was laid before the Board, agreed to and ordered to be transcribed.

Trade.

Africa.

The Secretary laid before the Board the copy of a letter from the Committee of the Company of Merchants trading to Africa to their agent Mr. Melvill at Cape Coast Castle, dated November,.. 1752, which copy had been delivered to him by Mr. Hollier, Secretary to the said Committee.

Their lordships upon consideration of the said letter were pleased to make some additions thereto and directed the Secretary to acquaint Mr. Hollier therewith for the information of the Committee.

New York.

Read a letter to the Board, dated Fort George in New York, the 2nd August, 1752, not signed, but by the contents and circumstances of it, supposed to be from Governor Clinton relating to the succession to that Government when he shall leave the province.

Ordered that the draught of a letter to Mr. Clinton in answer thereto be prepared.

South Carolina.

Read a letter from Mr. Glen, Governor of South Carolina, to the Board, dated 27th July, 1752, acquainting their lordships with the death of James Wedderburn, Esquire, clerk of the Crown, Peace and Common Pleas in that province, and recommending David Graeme, Esquire, to succeed him.

Jamaica.
Copy of an Order of the Lords Justices in Council, dated 27th August, 1752, approving a representation of this Board for the confirmation of an Act passed in Jamaica in May, 1747, to entitle William Duckingfield, Escourt Duckingfield and Eliza Duckingfield, infants, to the same rights and priviledges with English subjects born of white parents.

Thursday, November 9. Present:—Earl of Halifax, Lord Dupplin, Mr. Fane, Mr. Townshend, Mr. Stone.

Proprieties.

Their lordships pursuant to the minutes of the 6th of October last and 7th instant, took into consideration the petition of the Proprietors of the province of Pennsylvania, praying that Commissioners may be appointed to ascertain the boundaries between the said province and his Majesty's territories in America, and also a petition of the guardians of the Right Honourable Lord Baltimore, Proprietor of Maryland, praying that all proceedings upon the said petition of the Proprietors of Pennsylvania may be staid untill his lordship shall attain the age of twenty one years; and the Right Honourable Arthur Onslow and John Sharpe, Esquire, guardians to the said Lord Baltimore, attending with Mr. Henley and Mr. Pratt, their counsel, and Mr. William Penn one of the Proprietors of Pennsylvania attending with Mr. Hume Campbell and Mr. Forester, counsel on his behalf, the said two petitions and also the Orders of Council referring the same to the consideration of this Board were read.

Mr. Henley in order to shew that Lord Baltimore's interest must be affected if Mr. Penn's petition should be complied with, stated to their lordships the limits described in their respective grants and explained to their lordships the points upon which disputes had heretofore arisen between them, urging several arguments to shew the impossibility of running the southern boundary of Pennsylvania without breaking in upon Lord Baltimore's right and therefore moved their lordships that the consideration of Mr. Penn's petition might be postponed till Lord Baltimore came of age.

Whereupon Mr. Hume Campbell in behalf of Mr. Penn declared in his name that although he could prove, if he was to enter into the merits of the question, that according to the words of Mr. Penn's petition Lord Baltimore was not interested, yet to shew that Mr. Penn did not intend to carry on this matter in an adverse manner and out of civility to his Lordship and respect to his guardians he was willing to consent that the further consideration of his petition should be deferred untill Lord Baltimore might come of age, which proposal being accepted by the guardians of Lord Baltimore their lordships appointed Thursday the… of April for taking Mr. Penn's petition into further consideration.

The parties being withdrawn their lordships ordered the draught of a report to the Lords of the Committee of Council upon Lord Baltimore's petition to be prepared, conformable to the agreement between the parties.

Virginia.

Read the following letters and papers received from Mr. Dinwiddie, Lieutenant-Governor of Virginia, viz:—
Letter from Mr. Dinwiddie, Lieutenant-Governor of Virginia, to the Board, dated the 5th of June, 1752, containing his observations upon some of the laws lately confirmed by his Majesty.
Letter from Mr. Dinwiddie to the Board, dated the 12th of July, 1752, transmitting the three following papers, viz:—
The humble address of the Council and House of Burgesses of Virginia to his Majesty relative to some laws lately repealed by his Majesty and praying that they may have leave to alter or amend laws confirmed by his Majesty without a suspending clause.
Reasons in support of the said address so far as relate to the repealed laws.
The humble representation of the judges of the general court of Virginia to his Majesty praying an enlargement of their salaries.

The draught of a representation to his Majesty transmitting the above-mentioned three papers having been prepared, was laid before the Board and ordered to be transcribed.
Letter from Mr. Dinwiddie to the Board, dated at Williamsburg, the 20th of July, 1752, transmitting the following publick papers, viz:—
Schedule of the journals of the Council and Acts of Assembly passed at Virginia in April, 1752, with other papers referred to in Mr. Dinwiddie's letter to the Board, dated the 20th of July, 1752.
Journal of the Council from the 15th of October, 1751, to the 22nd April, 1752.
Journal of the Council in Assembly from 27th February to the 20th April, 1752.
Journal of the House of Burgesses for the same time.
Fifty three Acts passed at Virginia the 20th of April, 1752.
List of vessels entered inwards and cleared outwards from Michaelmas, 1751, to Lady Day, 1752, at the several districts of the colony of Virginia.

Virginia.

Ordered that the above-mentioned Acts be sent to Mr. Lamb for his opinion thereupon in point of law as soon as conveniently may be.
Letter from Mr. Dinwiddie, Lieutenant-Governor of Virginia, dated the 28th July, 1752, acquainting the Board with the death of William Dawson, Clerk Commissary of that colony and one of the Council, and recommending seven gentlemen to succeed to vacancies that may happen at that Board.

The draught of a representation to his Majesty proposing that the Reverend Thomas Dawson may be appointed to his Majesty's Council in Virginia in the room of the said William Dawson, having been prepared, was laid before the Board, agreed to and ordered to be transcribed.

Read the following letters and papers from Lieutenant-General Fleming, Commander in Chief of the Leeward Islands, viz:—
Leeward Islands.
Letter from Lieutenant-General Fleming to the Board, dated St. Christopher's, the 18th June, 1752, transmitting the two following Acts lately passed in that Island with his observations upon them, viz:—
An Act to make more effectual an Act of Parliament of Great Britain intituled An Act for the better securing and encouraging the trade of his Majesty's sugar colonies in America so far as regards the island of St. Christopher's.
A supplementary Act to an Act intitled An Act to make more effectual an Act of the Parliament of Great Britain made and passed in the sixth year of his present Majesty's reign, intitled An Act for the better securing and encouraging the trade of his Majesty's sugar colonies in America so far as the same regards this island.
Letter from Lieutenant-General Fleming to the Board, dated the 19th of July, 1752, recommending Mr. Charles Pym Burt to supply a vacancy in the Council of Nevis in the room of Mr. Joseph Herbert and transmitting the following Act passed in the said island, viz:—
An Act to make more effectual an Act of Parliament of Great Britain intitled An Act for the better securing and encouraging the trade of his Majesty's sugar colonies in America so far as regards the island of Nevis.

Ordered that the aforementioned Acts be sent to Mr. Lamb for his opinion thereupon in point of law and that the Secretary do transmit copies thereof to the Secretary to the Lords Commissioners of his Majesty's Treasury for the consideration of that Board.

Virginia.

The draught of a representation to his Majesty proposing that the Reverend Thomas Dawson may be appointed of the Council in Virginia in the room of the Reverend William Dawson, deceased, having been transcribed pursuant to the preceding day's minutes, was laid before the Board and signed.

The draught of a representation to his Majesty transmitting an address of the Council and House of Burgesses of Virginia relative to their laws together with a paper of reasons in support thereof annexed thereto and also an address of the judges of the general court relative to an enlargement of their salaries having been transcribed pursuant to the preceding minutes, was laid before the Board and signed.

South Carolina.

The Secretary laid before the Board the following papers received from Mr. Crokatt, agent for the province of South Carolina, viz:—
Journals of Council from the 16th of December, 1749, to the 23rd of March, 1750–1.
Journal of the Upper House of Assembly from the 10th of January, 1748–9, to the 15th of March, 1750–1.
Journal of the Commons House of Assembly from the 21st November, 1749, to the 31st of May, 1750.
Sixteen Acts and an Ordinance passed between the 24th April and the 31st of August, 1751.

Ordered that the said Acts be sent to Mr. Lamb for his opinion thereon in point of law.

Read the following letters and papers from Mr. Glen, Governor of South Carolina, viz:—
Letter from Mr. Glen to the Board, dated February, 1752, expressing his concern at not having received any letters from the Board for upwards of two years.
Letter from Mr. Glen, Governor of South Carolina, to the Board, dated the 27th of July, 1752, relating to the necessity of building forts amongst the Indians particularly in the Cherokee country.
Letter from Mr. Glen to Mr. Hill, dated the 27th July, 1752, inclosing his observations upon the laws passed in the last session of Assembly, and transmitting:—

Journal of the Assembly from the 13th November, 1750, to the 31st August, 1751.

Ordered that the said Acts be sent to Mr. Lamb, for his opinion thereon in point of law.

Ordered that the above-mentioned letters be taken into consideration the 21st instant, and that the Secretary do write to Colonel Vanderdussen, mentioned in one of them, to desire his attendance on that day.

Jamaica.

Read the following letters and papers from Mr. Trelawney, Governor of Jamaica, viz:—
Letter from Mr. Trelawney to the Board, dated August, 1751, transmitting the plan of the Mosquito Shore Fort and a draught of part of the shore.
Letter from Mr. Trelawney to the Board, dated the 25th March, 1752, containing his observations upon the laws passed there in the last session and urging the necessity of a Chief Justice and assistant being appointed from home, and transmitting the following publick papers, viz:—
Minutes of Council from the 29th of March to the 14th of October, 1751.
Council in Assembly from January, 1750–1, to December, 1751.
Minutes of Assembly September to December, 1751.
Twenty three Acts passed in October, November and December, 1751.

Ordered that the Secretary do write to Mr. Lamb to hasten his report upon the said Acts.

Massachusets.

Read the following letters and papers received from Mr. Phips, Lieutenant-Governor of the Massachusets Bay, viz:—
Letter from Mr. Phips to the Board, dated the 27th June, 1752, relating to the dispute between that province and the province of New Hampshire with respect to Fort Dummer and inclosing:—
Copy of an Order of Council, dated the 6th of September, 1744, relating to the support of Fort Dummer and the garrison thereof.

Ordered that the draught of a representation to his Majesty upon the said letter be prepared.
Letter from Mr. Phips to the Board, dated the 18th September, 1752, acknowledging the receipt of instructions with respect to his future correspondence and the revisal of the laws, and also the Board's letter concerning a revisal of the King's Instructions to his Governors.
Letter from Mr. Phips to the Board, dated the 19th September, 1752, transmitting:—

Barbados.

Nevis.

Ordered that the Secretary do write to Richard Salter, Abel Dottin and John Gybbon, Councillors of Barbados, and also to Daniel Smith, a Councillor of Nevis, all of whom have been absent from the said Islands for several years without his Majesty's leave, acquainting them that unless they signify their intentions of returning immediately to their respective Islands or obtain his Majesty's licence to be absent for a longer time, their lordships shall recommend proper persons in their stead pursuant to his Majesty's instructions.

North Carolina.

Ordered that the Secretary do write to Mr. Child, Attorney General of North Carolina, now in England, to desire he would acquaint the Board whether he intends to return.

The draught of a report to the Lords of the Committee of Council upon the petition of the guardians of Lord Baltimore having been prepared pursuant to the minutes of the 9th instant, was laid before the Board, agreed to and ordered to be transcribed.

Massachusets.

The draught of a representation to his Majesty upon a letter from Mr. Phips, Lieutenant-Governor of the Massachusets Bay, relating to Fort Dummer, having been prepared pursuant to the minutes of the 10th instant, was laid before the Board, agreed to and ordered to be transcribed.

New York.

The draught of a letter to Mr. Clinton, Governor of New York, in answer to one lately received from him having been prepared pursuant to the minutes of the 8th instant, was laid before the Board, agreed to and ordered to be transcribed.

The draught of a report to the Lords of the Committee of Council upon the petition of the guardians of Lord Baltimore having been transcribed pursuant to the preceding minutes, was laid before the Board and signed.

Virginia.

The draughts of two letters to Mr. Dinwiddie, LieutenantGovernor of Virginia, ordered to be prepared by the minutes of the 12th of March and 14th of April, were laid before the Board, agreed to and ordered to be transcribed.

Jamaica.

Read the following letters and papers lately received from Mr. Trelawney, Governor of Jamaica, viz:—
Letter from Mr. Trelawney to the Board, dated 15th May, 1752, acquainting their lordships with the death of Hampson Needham, Esquire, a member of his Majesty's Council.
Letter from Mr. Trelawney to the Board, dated 15th August, 1752, inclosing:—
A state of the Island of Jamaica as to its' strength, trade and fortifications, and what laws have been made since 1734 relating to grants and for enforcing the cultivation of lands and encouragement of new comers; how far those laws have been executed and have proved effectual, etc.
Letter from Mr. Trelawney to the Board, dated 15th August, 1752, containing some particular observations with regard to the forts at Port Royal and Mosquito Point inclosing:—
Observations of Engineer Bontein concerning Liguanea, Kingston Harbour, etc.
Letter from Edward Trelawney, Esquire, to the Board, dated 15th August, 1752, proposing the repeal of a clause in the Act of 25 Caroli secundi, whereby a duty is laid on the commodities therein enumerated, and containing reasons in support of such proposal.

Ordered that the draught of a representation to the Honourable House of Commons be prepared upon the several points relative to the present state of Jamaica contained in their address to his Majesty, dated the 24th March, 1752.

Leeward Islands.

Read a letter from Lieutenant-General Fleming, Commanderin-Chief of the Leeward Islands, dated the 22nd August, 1752, acquainting the Board with the death of Governor Mathew.

Jamaica.

Read a letter from Charles Knowles, Esquire, Governor of Jamaica, to the Board, dated September 20th, 1752, acquainting their lordships with his arrival at that Island.

South Carolina.

Read a letter from Mr. James Crokatt, agent for the province of South Carolina, inclosing his memorial to the Board of Trade, dated the 10th instant, concerning Indian presents and transmitting the three following papers, viz:—
Copy of a memorial from James Crokatt to his Grace the Duke of Bedford, dated November 9th, 1749, concerning Indian presents.
Copy of a second memorial from James Crokatt to his Grace the Duke of Bedford, dated 22nd October, 1750, concerning Indian presents.
Copy of the report of the Right Honourable the Secretary of War by letter to his Grace the Duke of Bedford, dated the 13th November, 1750; also copy of his Grace the Duke of Bedford's opinion in relation thereto, dated 19th November, 1750, concerning Indian presents.

Ordered that these papers be taken into consideration on Wednesday next and that the Secretary do wait upon Mr. Secretary at War to desire the favour of his attendance.

Ordered that the consideration of the letter, lately received from Mr. Glen, mentioned in the minutes of the 10th instant, be postponed untill Wednesday next and that the Secretary do give notice to Colonel Vanderdussen accordingly.

Massachusets.

The draught of a representation to his Majesty upon a letter from Mr. Phips, Lieutenant-Governor of the Massachusets Bay, relative to Fort Dummer, having been transcribed pursuant to the minutes of the 16th instant, was laid before the Board and signed.

Virginia.

The draught of a letter to Mr. Dinwiddie, Lieutenant-Governor of Virginia, signifying his Majesty's remission of a fine imposed upon a youth in that colony for an assault, having been transcribed pursuant to the minutes of the 17th instant, was laid before the Board and signed.

South Carolina.

Ordered that the consideration of Mr. Glen's letters relating to Indian affairs appointed for to-morrow be further postponed untill another opportunity and that the Secretary do acquaint Colonel Vanderdussen therewith.

New Hampshire.

Read a letter from Mr. Wentworth, Governor of New Hampshire, to the Board, dated the 9th of June, 1752, relating to the Assembly's continuing still in disobedience to his Majesty's additional instruction with respect to the members chosen for certain new towns and districts.

Ordered that the draught of a representation to his Majesty thereupon be prepared.

Read a letter from Mr. Wentworth, Governor of New Hampshire, to Mr. Hill, dated the 15th September, 1752, acknowledging the receipt of the orders and instructions with respect to his future correspondence and the revisal of the laws.

New Hampshire.

Read Mr. Attorney and Mr. Sollicitor-General's report upon a question with a state of the case relating to the property of the waste and unimproved lands in the province of New Hampshire within the limits of the grant made by the Council of Plimouth to John Mason in the year 1629. Dated 7th August, 1752.

Read Mr. Attorney and Mr. Solicitor-General's report, dated 14th August, 1752, upon a question with a state of the case with respect to certain townships and tracts of land granted by the governments of the Massachusets Bay and Connecticut in New England, which townships and tracts of land are now part of the province of New Hampshire by the determination of the boundary line between that province and the province of the Massachusets Bay in the year 1738.

Ordered that the draught of a letter to Mr. Wentworth in answer to those received from him and also upon the points contained in the aforementioned reports of his Majesty's Attorney and Sollicitor-General be prepared.

Maryland.

Read a letter from Mr. Tasker, dated at Maryland, the 5th of May, 1752, acquainting the Board that upon the death of Samuel Ogle, Esquire, late Lieutenant-Governor, the administration of the government of that province devolved upon him as first member of the Council, and that he has entered into bond for the observation of the Acts of Trade and Navigation which is lodged in the Council office there, and sends a copy of it inclosed.

Ordered that the Secretary do write to Mr. Tasker directing him to transmit the original bond.

Connecticut.

Read a letter from Mr. Walcott, Governor of Connecticut, dated the 30th June, 1752, acknowledging the receipt of his Majesty's Order in Council of the 11th and the Board's letter of the 13th of March last, relating to new regulations and powers with respect to this Board, and giving the Board an account of the present state of that colony.

New Jersey.

Read a letter from Mr. Belcher, Governor of New Jersey, to the Board, dated the 9th of June, 1752, transmitting the following publick papers, viz:—

Ordered that an extract be made of so much of the first mentioned letter of Mr. Scott's as relates to the capture made by a Spanish vessel of the said Islands and also a copy of the deposition relative thereto in order to be transmitted to the Earl of Holdernesse, his Majesty's Secretary of State, and that the draught of a letter, accompanying the same, be prepared.

Ordered that the Secretary do transmit an extract of so much of Mr. Scott's answer to the general queries as relates to the state of the fortifications to the Secretary to the Principal Officers of his Majesty's Ordnance in order to be laid before that Board.

South Carolina.

Ordered that the consideration of the memorial of Mr. Crokatt, agent for the province of South Carolina relative to Indian presents, mentioned in the preceding minute, be postponed untill another opportunity.

Read a letter from Mr. Gybbon, one of his Majesty's Council in the Island of Barbados, to Mr. Pownall, dated the 26th instant, in answer to one from him relative to his being absent from his seat in the said Council without his Majesty's leave.

Ordered that the Secretary do acquaint Mr. Gybbon that their lordships shall have no objection to his remaining in England till the Spring.

Georgia.

The Secretary laid before the Board a paper received from Mr. Gray, agent for the inhabitants of Georgia, entituled:—
Proposals for establishing a government in his Majesty's province of Georgia.

Ordered that the said paper be again laid before the Board when the affair of his Majesty's province of Georgia shall come under consideration and that Mr. Gray have then notice to attend thereupon.

Several of the manufacturers and exporters of paper hangings attending, were called in and they presented to the Board the following paper, viz:—

The said memorial being read their lordships acquainted them that they should forthwith make a representation to his Majesty upon this affair, and the petitioners being withdrawn the draught of a representation to his Majesty thereupon was accordingly ordered to be prepared.

The draught of a representation to the Lords of the Council with an extract of a letter from Mr. Belcher, Governor of New Jersey, relative to the riots committed in that province, having been prepared pursuant to the minutes of the 22nd instant, was laid before the Board, agreed to, transcribed and signed.

New Hampshire.

The draught of a representation to his Majesty upon a letter lately received from Mr. Wentworth, Governor of New Hampshire, relative to the Assembly's refusal to pay obedience to his Majesty's instruction concerning the members chosen for certain new towns and districts, having been prepared pursuant to the minutes of the 21st instant, was laid before the Board, agreed to, transcribed and signed.
