Affidavits about cruelties committed by the French.
A letter from Colonel Bennet, Lieutenant Governor of Bermuda, of the 29th of October, 1708, with the copies of the affidavits of Samule Harvey and Elizabeth Stroud, relating to the cruelties and barbarities committed by the French on the inhabitants in the Bahama Islands [fo. 144, 146], were read; and the other papers referr'd to in the said letter were laid before the Board, and are as follows, vizt.:

A letter from Colonel Bennet to the secretary of the 12th of March last, relating to a design of the French and Spaniards, against the province of Carolina, together with an affidavit, and the translation of part of a French letter from Curaçoa, touching the said design, were read. Whereupon a letter to the Earl of Sunderland [fo.145, 216], inclosing an extract of the letter from Colonel Bennet and copies of the affidavits, was signed.

Letter from Mr. Burchet.
Guardships.
A letter from Mr. Burchet of the 30th [fo. 145], in answer to one writ him the 29th of the last month, relating to guardships for Virginia, signifying that the Garland, a ship of 40 guns, sail'd some time since for that colony, and has orders to cruise between the Capes; and that another ship for the same service is ordered to be bought at New England, was read.

The account of incident charges of this office, from Lady Day, 1709, to Midsummer following, were laid before the Board, and are as follows, vizt.:

Complaints against Col. Park.
Their lordships took into consideration the complaints against Colonel Park, Governor of the Leeward Islands, and read the three following papers relating thereto, mention'd in the minutes of the sixth, thirteenth and eighteenth of April last, vizt.:
Order of Council of the 31st of March, 1709, referring to this Board the address and petition of the merchants and inhabitants of Antego &c. [fo. 58], together with 22 articles of complaint against Colonel Park, Governor of the Leeward Islands.
Letter from the Earl of Sunderland of the 12th of April last [fo. 63], inclosing some additional articles of complaint against Colonel Park, Governor of the Leeward Islands.
Letter from the Earl of Sunderland of 15th April, 1709 [fo. 66], inclosing a petition from several merchants of Bristol, complaining of the conduct of Colonel Parke, Governor of the Leeward Islands.
Then agreed to proceed in the further consideration of the said complaints to-morrow morning.

Complaints against Col. Parke.
Mr. Nevin attending in relation to the complaints against Colonel Park, Governor of the Leeward Islands [fo. 96, 150], he acquainted their lordships that he had some more papers touching the said complaints, and that he had received information that five ships were arrived in Ireland, and did expect by them to have other papers to prove the said articles of complaint, and desiring to know whether he should lay what he has already, or stay till he receives those from Ireland, and then lay them altogether before the Board; he was told that he would do well to bring those he had already [fo. 152], which he promised to do to-morrow morning.
Representation thereupon.
Ordered that the draught of a representation be prepared for laying the said complaints before her Majesty [fo. 149, 153], with their lordships’ opinion, that it is just and reasonable the said articles be sent to Colonel Park for his answer thereunto.

The secretary acquainting their lordships that the Marquis of Carmarthen desired to know whether Fryday would not be a convenient day to attend their lordships [fo. 144]; ordered that he have notice the Board will be ready that day, to hear what he may have to offer in relation to the pirates at Madagascar.

A memorial from the Earl of Moreton, Mr. Egerton and others, inclosing a copy of a petition to her Majesty, in the name of the pirates at Madagascar, praying her Majesty's pardon, with an annex'd paper containing the names of the trustees proposed by the said pirates for receiving their effects &c., were read.

Order of Council.
Mr. Penn attending, communicated to their lordships an Order of Council of the 23rd of the last month [fo. 5], dismissing the Lord Baltimore's petition against an Order of the 13th of November, 1685, for settling the boundaries between Pennsylvania and Maryland, and confirming the said Order; whereupon directions were given for taking a copy of the said Order of the 23rd of the last month, to be enter'd in the books of this office.

Letter to Col. Parke in his behalf.
A letter from Mr. Bendysh, with a memorial, desiring a recommendation letter from their lordships to Colonel Park &c., in favour of Mr. Jurdin, who is gone to Antego to take possession of an estate left him there, were read; whereupon ordered that Colonel Park be writ to accordingly.

Affidavits against Col. Park.
The secretary acquainted their lordships that Mr. Nevin had this morning left with him five affidavits [fo. 150, 156], which he desired might be returned him [fo. 160], together with the former left here, when their lordships should have considered the same. The said affidavits are as follows, vizt.: the affidavits of James Field, Richard Cochran and Jeffry Duncombs, relating to soldiers being sent to seize Barry Tankard, esquire, for a contemptuous behaviour towards Colonel Park; the affidavist of Samuel Walker and Francis Carlisle touching what Colonel Park said in relation to the summoning of jurors; which affidavits were read.

Mr. Betts recommended to be of the Council.
And put on the list.
Lieutenant General Harvey attending, and desiring that Mr. Thomas Betts might be put upon the list of counsellors, in order to supply the first vacancy that may happen in Jamaica, he was acquainted that the Duke of Bolton had formerly recommended the said Betts, but that afterwards, upon his Grace's notifying to this Board that he would not interest himself in that matter, the said Betts was struck off the list. And Lieutenant General Harvey now recommending him as a fit person to serve her Majesty as a counsellor there, and acquainting the Board that the Duke of Bolton is satisfy'd that the said Bets should stand upon the list, his name was again incerted in the said list, to supply the first vacancy in that Council.

The draught of a letter to Colonel Park, as directed yesterday [fo. 151, 156], in favour of Mr. Richard Jurdine, was agreed, and ordered to be transcribed.

A copy of her Majesty's letter mandatory to Mr. Crow, Governor of Barbadoes [fo. 143], upon his refusal to readmit the three suspended councellors, and to swear such witnesses as they had to produce against him; dated the 2nd of July, 1709, was read.

Two affidavits of Jedidiah Hutchinson sworn before Mr. Pitt the 7th instant [fo. 152], relating to complaints at St. Christopher's against Colonel Parke, were read.

A caveat from Sir John Colleton against Mr. John Colleton in Barbadoes [K. fo. 71], praying that the said John Colleton may not be appointed a member of Council in that island, untill a cause that is depending between them shall be determined there, was read; whereupon ordered that the same be noted on the list of counsellors accordingly.

A memorial from New England, relating to the French settlements on Canada, lately received from Sir Stephen Evans, was laid before the Board and read.

Memorial from Mr. Graufenried &c. on the same subject.
Mr. Stanyan to attend.
A letter from the Earl of Sunderland of the 28th of the last month, referring to the Board a petition of George Ritter and Francis Lewis Michel, relating to the settling of a colony of Switzers upon Potomack River in Virginia, was read [fo. 161], and the said Michel and Christopher de Graffenried attending, they presented to their lordships a new proposal upon that matter, and desired to withdraw what had been referr'd to their lordships; and signifying that Mr. Stanyan, her Majesty's envoy in Swisserland, was apprized thereof, they were desired to bring Mr. Stanyan to the Board on Wednesday morning next.

A letter from Colonel Bennet, Governor of Bermuda, of the 1st of March, 1708/9, acknowledging the Board's letter of the 4th of August, 1708 [M. fo. 265], relating to accounts of remains of stores of war in the magazines of that island, was read.

Draft of representation to be prepared about new counsellors.
Whereupon ordered that the draught of a representation be prepared upon paragraph C of the said letter [fo. 161], relating to the want of counsellors in that island, proposing that Mr. Samuel Sherlock, Mr. Samuel Smith, Mr. William Outerbridge, Mr. Leonard White, and Mr. John Peasly be members of her Majesty's Council in that island, according to Colonel Bennet's recommendation in his letter of the 10th of February, 1707/8.

A letter from Brigadier Handasyd, Governor of Jamaica, dated the 6th of April last, together with the following papers referred to therein were read, vizt.:
A state of the case in relation to a judgment that passed at the Grand Court in Jamaica against the Naval Officer there, upon his seizing a Spanish brigantine &c.
An address from the Chief Justice and Judges at Jamaica to Brigadier Handasyd, in favour of a soldier under sentence of death for killing a man.
Paragraph I &c. about brigantine to be sent to the Lord High Admiral. and Paragraph K to Earl of Sunderland Whereupon ordered that paragraph I of the said letter, relating to the seizure of the brigantine aforementioned, and copy of the case touching the same be sent to the Lord High Admiral [fo. 160], and that the draught of a letter to the Earl of Sunderland be prepared for transmitting what Brigadier Handasyd writes in Par. K of the same letter, relating to the soldier above-mentioned, as likewise a copy of the said address.

Proofs to complaints against Col. Park to be returned to Mr. Nevin.
The secretary acquainting their lordships that Mr. Nevin had desired that the depositions he had laid before the Board to make good the complaints exhibited against Colonel Parke might be returned him [fo. 152, 180]; ordered that copies of the said proofs be first taken, and that the originals be then returned to Mr. Nevin accordingly.

Letter to Earl of Sunderland about a serjeant under sentence of death.
A letter to the Earl of Sunderland, relating to the case of a serjeant under sentence of death [fo. 159] for killing a man in Jamaica, mentioned in the minutes of the 11th instant, was signed.

Mr. Stanyan and others about colony of Switzers.
Mr. Stanyan, envoy to the Swiss Cantons, with Mr. Christopher de Graffenried, and Mr. Lowis Michell, attending, they presented to their lordships a new memorial relating to the settling a colony of Switzers mention'd in the last minutes [fo. 157, 164], which was read; and these gentlemen being asked under what terms they desired such a settlement should be made, they said that they could not propose any other than the enjoying the same priviledges as the rest of her Majesty's subjects in those parts did; and these gentlemen being withdrawn, their lordships agreed to take the same into consideration at the first opportunity.

Mr. Roos, her Majesty's seal cutter, attending, presented to their lordships two new large silver seals, one for Barbadoes, the other for the Leeward Islands, for which the secretary was directed to give him a receipt, and the same was done accordingly.

A third memorial from Monsieur de Graffenried and Mr. Louis Michel [fo. 161, 166], relating to their proposal for settling a colony of Switzers at Potomack in Virginia, was read; whereupon ordered that Mr. Micaiah Perry and Mr. Hyde, with one or two more of the principal merchants trading to Virginia, have notice to attend the Board on Tuesday morning next; further ordered that Colonel Blakiston have notice to attend at the same time.

A letter from Colonel Seymour, Governor of Maryland, dated the 18th of November, 1708, in answer to one writ him the 15th of April foregoing [M. fo. 111], relating to negroes imported into Maryland by the Royal Affrican Company and separate traders, was read; and the papers therein referr'd to were laid before the Board, and are as follows, vizt.:

Mr. Perry and Mr. Hyde about colony of Switzers.
They agree the same will be of advantage.
Mr. Perry and Mr. Hyde attending [fo. 164], as they had been desired the 15th instant, the referrence from the Earl of Sunderland of the 28th of June, relating to the settling of a colony of Switzers in Virginia, was read; as was likewise the translation of a proposal presented to their lordships by Mr. Graffenried and Mr. Michel upon that subject, the 15th instant; whereupon these gentlemen being ask'd their opinion in this matter, they said that the settling of such a colony as proposed would certainly be of great advantage in strengthening the frontiers, and increasing the trade, so that they did not see any objection could be made to it, and therefore they were of opinion it ought to be incouraged. Whereupon ordered [fo. 168] that the draught of a letter be prepared to the Earl of Sunderland for laying the same before her Majesty.

A letter from Brigadier Handasyd, Governor of Jamaica, dated the first of May last, was read, and directions given for adding a postscript to the letter to him, which was signed the 15th instant [fo. 69], which was done accordingly.

The draught of a letter to Colonel Jennings, President of the Council of Virginia [fo. 171], was agreed, and ordered to be transcribed.
Barbadoes.
Order of Council on Bently's petition about a lawsuit between him and Downes.
Agent summoned.
An Order of Council of the 18th instant [fo. 169], referring to this Board the petition of Mr. John Bently and Elizabeth his wife to her Majesty, relating to a law suit depending between the said Bently and Mr. Downs, Judge of the Court of Common Pleas, for the precinct of St. Michael's in Barbadoes was read; whereupon ordered that the agent to the said Bentley have notice to attend the Board on Wednesday next.

A letter to the Earl of Sunderland, relating to the settling of a colony of Switzers at Potomac in Virginia [fo. 167, 261], as directed at the last meeting, was signed.

Order of Council on the petition of Mr. D'Oyley touching the guardianship of his brother's children.
Copy of the said petition sent to Mr. Solicitor General for his opinion what may be done therein.
An Order of Council of the 18th instant, referring to this Board the petition of Robert D'Oyly, clerk, late of her Majesty's colony of Virginia, deceased, touching the guardianship of the said Cope D'Oyley's two sons, and praying that the said children may be sent over from thence, with their effects to this kingdom, to the care and tuition of the petitioner, was read, and the petitioner attending at the same time, and being asked several questions in relation to the said children, he said that there is yet a plantation belonging to them in that colony, but that the stock thereof, having been sold by order of the Court, under whose care the said children were, the same remains waste and uncultivated, their lordships having taken this matter into consideration, ordered [fo. 194] that a copy of the foremention'd petition be sent to Mr. Solicitor General, for his opinion what her Majesty may legally do in behalf of the petitioner.

Representation to be drawn.
Mr. William Walker and Mr. John Gellibrand, agents for Mr. Bently, attending, the Order of Council of the 18th instant [fo. 167, 173], referring to this Board the petition of the said Bently to her Majesty, touching a lawsuit depending between him and Mr. Downs, Judge of the Court of Common Pleas for the precinct of St. Michael's in Barbadoes (mentioned in the minutes of the 25th instant), was again read; and the said agents being asked several questions thereupon, Mr. Walker said that Mr. Roberts, one of the assistants in the said Court, had refused to act by reason of his being an agent for the sale of negroes, and thereby liable to the penalty of the Act of Parliament in that behalf; that another of the assistants in the said Court had also refused to attend the service thereof for fear of the small-pox. He added that, upon these delays, Mr. Bently petition'd Mr. Crow to appoint another assistant in the room of Mr. Roberts, for the dispatch of his cause, who, instead of complying with so just a request, referr'd the petitioner back to Mr. Downs, who is a party concerned therein, as appears by the copy of the said petition, and Mr. Crow's reference produced to their lordships by the said Walker. Then these agents being withdrawn, their lordships gave directions for preparing the draught of a representation thereupon.
Barbadoes.
Mr. Royle desiring papers to make use of at a hearing relating to Mr. Lillington.
Mr. Royle, one of the agents for Barbadoes, attending, he acquainted their lordships that there was to be a hearing before a Committee of the Councill on Saturday next, upon the complaints of Mr. Lillington [K. fo. 212], touching 2,000l., the said Lillington was formerly compell'd to pay in Barbadoes, and the said Royle, desiring that he might have the several papers in this office concerning that matter to make use of at the said Committee, he was told that if he would give the secretary a list of such papers [as] he should want, their lordships would then give directions to one of their own clerks to attend the Committee with the said papers accordingly.

Letter to Mr. Gough thereupon.
A petition from Mr. Roger Mompesson, Chief Justice of New York [fo. 127], to their lordships, praying that he may be continued in that station, was read; whereupon ordered that Mr. Goff (agent for that province) be acquainted that their lordships think it will be more regular to petition her Majesty, and that if it be then referr'd to the Board, their lordships will report their opinion thereupon.

A reference from the Commissioners appointed to receive and dispose of the money collected for the settlement of the poor Palatines [fo. 174, 179], upon a proposal for settling 200 families of them in Jamaica, was read; whereupon ordered that Sir Bartholomew Gracedieu, Mr. Harris, Mr. Whitchurch, Mr. Way, some of the proposers have notice to attend the Board on Tuesday morning next [fo. 176], as also Sir Gilbert Heathcote, Sir Theodore Jansen and Mr. Dolben.

Mr. Heysham and Royle appointed by an Act agents of the island.
Mr. William Heysham and Mr. Royle attending, communicated to the Board an Act past in Barbadoes the 16th of May, 1709 [fo. 233], appointing them agent for the said island, which Act was read.
