Her Majesty's warrant to Mr. John Roos, engraver of her Majesty's seals [fo. 241], dated the 17th of July, 1708, requiring him to make new seals for the provinces of New Hampshire, the Massachusets Bay, New York, New Jersey, Maryland, Virginia, Jamaica, Barbadoes, and the Leeward Islands and Bermuda according to such directions as he shal receive from this Board, was read; and the said Roos attending at the same time, directions were given him accordingly.

Letter to Mr. Secretary Boyle.

Their lordships took into consideration Captain Vetch his paper, mentioned in the minutes of the 27th of the last month [fo. 259, 265], relating to the reduction of the French settlements on the Continent of America. And the said Captain Vetch acquainting their lordships that he intended to take the opportunity of going to New York with the Lord Lovelace, unless it be thought necessary he should stay longer here in relation to the foresaid paper; their lordships gave directions for preparing a letter to Mr. Secretary Boyle thereupon.

A letter from Mr. Dummer of yesterday's date [fo. 272], giving an account of the sailing of the Antego packet boat to and from the West Indies, as also of the good success of Commodore Wager against the galleons, was read.

A letter from the Earl of Sunderland of the 29th of the last month [fo. 278], referring to this Board a memorial from Mr. Vaughan, agent for New Hampshire, was read, and the papers therein referr'd to were laid before the Board, and are as follows, vizt.:—

A letter to Mr. Secretary Boyle upon Captain Vetch's proposal for reducing the French settlements on the Continent of America [fo. 262, 273], as directed in yesterday's minutes, was signed.

Circular letter for accounts of stores of war.

A circular letter to all the Governors in her Majesty's Plantations, pursuant to an Order of Councill of the 25th of the last month [fo. 260; N. fo. 158], (mentioned in the minutes of the 30th ditto), requiring them to send accounts of stores of war remaining in their respective Governments, was signed.

Newfoundland.

Return from Chichester about number of fishing ships.

A return from the Comptroller and Collector of the Customes at Chichester to an order of the Commissioners of her Majesty's Customes, signifying that there are no fishing ships sent from thence to Newfoundland, was read.

Jamaica.

Letter from Brigadier Handasyd.

A letter from Brigadier Handasyd, Governor of Jamaica, dated the 17th of June, 1708 [fo. 282], was read, and the papers therein referr'd to were laid before the Board, and are as follows, vizt.:

Whereupon a letter to Mr. Secretary Boyle, acquainting him with what Brigadier Handasyd writes in paragraph K of the foresaid letter, relating to the number of merchant ships and French men-of-war at the Havana, was signed.

Papers of publick proceedings.

Affidavits against Capt. Fane to be sent to the Admiralty.

Lord Cornbury's complaint against the said Captain.

Their lordships took into consideration the papers of publick proceedings referr'd to in Mr. Crow's letter mentioned in yesterday's minutes, and read the same. Whereupon ordered that a letter be writ to Mr. Burchet [fo. 273], inclosing copies of the affidavits relating to the irregular proceedings of Captain Fane [vide supra], commander of her Majesty's ship the Lowestaffe, taking notice of a former complaint made against the said Fane by the Lord Cornbury, mentioned in the minutes of the 29th of April, 1707 [L. fo. 141].

Barbadoes' Agents to attend.

Ordered that Mr. Tryon and the other Agents of Barbadoes have notice to attend the Board on Tuesday morning next.

Account of stores of war.

Further ordered that the account of stores of war [fo. 271] be sent in a letter from their lordships to the Board of Ordnance.

Memoriall from Col.

Lloyd about intended escheat of negroes, &c.

Collonel Richard Lloyd attending, presented to the Board a memorial relating to Brigadier Handasyd, the Governor of Jamaica's, having put a stop to the intended escheat of his negroes &c. [fo. 176], and desiring that there may be and order to the said Governor to do what the said Lloyd's agents in that island shall desire ad corroberandum titulum, as in the case of Mr. Whitchurch, was read; and their lordships agreed to take the same into consideration at a convenient opportunity.

Mr. Micajah Perry attending [fo. 274], and desiring that Mr. William Bird may be constituted a Counsellor of Virginia in the place of Mr. John Lightfoot, deceased; their lordships agreed to recommend the said Bird accordingly.

Complaints from Antigua.

Mr. Dummer attending according to appointment [fo. 269], and being asked several questions in relation to the complaints from Antigua, referr'd to in Mr. Secretary Boyle's letter of the 4th instant (mentioned in the minutes of the 9th instant), he said that he was wholly a stranger thereto.

Jamaica.

Privateers.

Then being asked what he knew touching the privateers at Jamaica (mentioned in his letter of the 2nd instant, which was read the 3rd ditto) [fo. 263], he said that those privateers, intercepting the Spanish sloops as they return from trading with our vessells, would infallibly ruin the Jamaica trade [fo. 279], and being asked, he promised to give their lordships in writing his proposal for preventing the same.

Leeward Islands.

Mr. Cary &c. about complaints from Antigua.

Letter to the Governor.

Mr. Richard Cary and Mr. Duport also attending [fo. 269], being asked the like questions in relation to the fore-mention'd complaint from Antigua, they said they had no account thereof; whereupon ordered that the draught of a letter be prepared to Colonel Park for enquiring into the said complaints.

Letter to Mr. Solicitor General.

Their lordships, taking into consideration an Act past at Nevis the 22nd of June, 1705, for Establishing of Courts &c., and finding that a former Act with the same title past at Antegua the— was repealed by her Majesty, ordered [fo. 284] that a letter be writ to Mr. Sollicitor General for his opinion, whether the repeal of the Antego Act does not supercede and make void the Act past at Nevis, and whether the said Nevis Act does not remain in force till there be a particular and express repeal thereof by the Queen.

A letter from Mr. Secretary Boyle, of the 11th instant, in answer to one from their lordships of the 4th ditto [fo. 265, 275], relating to the proposal of Captain Vetch, referring the same to this Board, was read; whereupon ordered [fo. 275] that the said Vetch have notice to attend their lordships on Monday morning next.

Letter to Mr. Secretary Boyle thereupon.

Captain Vetch attending [fo. 274, 316], and being asked if he was willing to stay here till some determination should be made upon his proposal for reducing the French settlements on the Continent of America, he said that he was ready to attend that service, and being further ask'd what he thought would be necessary to be allowed him for his expense during his said stay here, he said that he left that to their lordships, and ten shillings per diem being proposed as sufficient, he said that he was willing to accept thereof, whereupon a letter to Mr. Secretary Boyle signifying the same [fo. 273], was agreed and signed.

A letter to Colonel Park, Governor of the Leeward Islands [fo. 274, 411], as agreed at the last meeting, was signed.

Virginia.

Representation proposing a new counsellor.

A representation, proposing Mr. William Bird [fo. 274, 295] to be a member of her Majesty's Councill in Virginia, in the room of Colonel Lightfoot, deceased, was signed.

Letter from Mr. Secretary Boyle referring a memoriall from Mr. Vryberge complaining of a pass given the ship San Antonio.

Sir William Hodges to attend.

A letter from Mr. Secretary Boyle, of the 11th instant [fo. 293], referring to this Board a memorial from Monsieur Vryberg, Envoy Extraordinary from the States General to her Majesty, complaining of a pass granted the ship San Antonia, of Bilboa &c., and inclosing a copy of the said pass, as also the 9th Article of a proposal for a trade to Spain, with observations thereon, and minutes of Councill relating thereto, was read; whereupon ordered [fo. 279] that Sir William Hodges have notice to attend the Board on Wednesday morning next.

A letter from the Lord Cornbury, Governor of New York, relating to Mr. Mackenie and Mr. Hampton, two Presbiterian ministers, preaching without licence, dated the 14th October, 1706, was read.

Another letter from his lordship of the 10th of February, 1707/8, inclosing minutes of Assembly of New York and New Jersey; also giving an account of a murder committed at New York by some Indians, was read.

A letter from Mr. Heming, Consul at Madera [L. fo. 393; fo. 278], relating to his having got off the imposition of 400 rees per pipe of wine, and the resolution of the factory there for levying a tax of 50 rees per pipe for defraying accidental charges &c., dated the 10th of June, 1708, was read.

Letter from him about consulship of Madera and Lisbon.

Another letter from the said Mr. Heminge, of the 30th of June, relating to Mr. Milner's having obtained a new patent for uniting the consulship of Lisbon to that of the Maderas [L. fo. 394; fo. 281], was also read.

Memorial from Mr. Vaughan with addresses.

Stores of war.

A letter from the Earl of Sunderland of the 29th of July, 1708, referring to the Board a memorial from Mr. Vaughan, agent for New Hampshire [fo. 263; 329], relating to the ill circumstances of that province, together with several addresses from the Councill and Assembly &c., of the said province &c., which had been read the 3rd instant, were again read; whereupon their lordships gave directions that a copy of the list of stores of war demanded by the said Vaughan for that government, mentioned in the minutes of the 15th of the last month, be sent to Colonel Romer [fo. 249, 303], and that he deliver his opinion to the Board in writing on Fryday next, and that he be desired to give an account of what stores there were remaining in New Hampshire when he came from thence.

Irregularities of privateers on the Spanish coast.

Mr. Dummer attending, according to appointment [fo. 272, 286], presented to their lordships a memorial proposing a method for preventing irregularities that are or may be committed by our privateers on the Spanish coast in the West Indies, which was read.

Sir William Hodges.

Monsieur Vryberge's memorial about passes.

Sir William Hodges attending [fo. 276, 288], and being acquainted with Monsieur Vryberg's memorial, relating to the pass granted to a Bilboa ship mentioned in the minutes of the 16th instant, and being asked several questions thereupon, he said that passes to Spanish ships to come to this kingdom were absolutely necessary, without which it would be impossible to carry on the trade with Spain, which was thought so beneficial to this kingdom, that the Parliament pass'd an Act for opening the same. And as for leaving out the word Holland in the said passes, he did not think it of any great importance, though perhaps it might affect some particular persons, who are concerned with the Dutch merchants in that trade. But whether the word Holland be in the said passes or no, he did not see that the Dutch had any reason to complain, for the said passes were only a protection to such ships as have them at sea from her Majesty's ships of war and our privateers. And that if the Dutch did not approve of such ships coming into their ports, as contrary to their placarts, they might either prohibit the same or seize them when they are in port; and he added that a Spanish ship wherein he was concerned, and which had a pass from her Majesty trading from Bilboa to Cadiz, with British manufactures, was taken by the Dutch, and afterwards retaken by the French, which is a juster subject of complaint than what Monsieur Vryberg now makes. Then he said that he would consult with other Spanish merchants and give their lordships a fuller account on Tuesday morning next.

Consulships of the Maderas and Lisbon.

Then their lordships ask'd his opinion of the Consul at the Maderas being independant of the Consul at Lisbon [fo. 278], mentioned in Mr. Hemming's letter read yesterday; whereupon he said that the Consul at Lisbon was always Consul General, and had power to make sub-delegates in the Maderas and elsewhere, which sub-delegates have as much power in the place where they reside as the Consuls themselves, and therefore he thought that the dependency of the Consulship of the Maderas on that of Lixabon would be no prejudice to trade, that it was always thus, till Sir Jeffry Jeffrys got it alter'd in favour of his friend Mr. Hemming, and he added that he has heard that the said Heming is very unfit for that place.

Their lordships, taking into consideration what Brigadier Handasyd writes in his letter of the 17th of June, 1708 [fo. 266], relating to counsellors for that island, read the 4[th] instant; ordered that Sir Gilbert Heathcote, Sir Bartholomew Gracedieu, and Mr. Benjamin Way [vide infra] have notice to attend the Board on Fryday morning next.

Sir Bartholomew Gracedieu about counsellors.

Sir Bartholomew Gracedieu attending, according to appointment [vide supra], in relation to councillors for Jamaica, and being asked the characters of Mr. Valentine Mumby, and Mr. Francis Oldfeild, and Mr. Robert Hotchkyn, recommended to be members of Councill there, he said that Mr. Mumby was a person of a considerable estate, of good parts, and had been long resident on the said island; that Oldfeild had also a good estate, but was not above four or five and twenty years of age; that as to Hotchkyn, he was a stranger to him.

Sir Gilbert Heathcote.

Representation proposing Mr. Mumby to be of the Council.

Sir Gilbert Heathcote likewise attending, and being asked what he knew concerning the aforesaid Mumby, he gave much the same character of him as Sir Bartholomew had done; as to Oldfeild, he knew him not; and as to Hotchkyn, he had no objection to his being appointed a member of the said Councill. Whereupon ordered [fo. 285] that the draught of a representation be prepared, proposing the aforementioned Mumby to be of the Council of Jamaica, in the room of Mr. John Ascough, who is come to England, and does not design to return thither again.

Letter from Mr. Solicitor General upon Acts for establishing Courts, &c.

A letter from Mr. Solicitor General of the 18th instant, in answer to one writ him the 11th ditto [fo. 272], upon two Acts, the one past at Antego, the other at an Assembly of all the Leeward Islands, for establishing Courts and settling due methods of justice &c., was read; whereupon their lordships agreed to consider the said Acts on Monday morning next.

Barbadoes.

Representation for a new counsellor.

Their lordships, taking into consideration what Mr. Crow writes in paragraph G of his letter of the 18th of May last [fo. 266] relating to counsellors; ordered [fo. 183, 285] that the draught of a representation be prepared proposing Mr. John Hallet to be a member of her Majesty's Councill of Barbadoes.

Solicitor General's report upon Mr. Cox's petition about Naval Office.

Mr. Solicitor General's report, upon the petition of Mr. Samuel Cox [fo. 181], relating to his being turned out of the Naval Office in Barbadoes by Mr. Crow, was read.

Convoys for ships of Bremen.

Ordered that the Secretary write to the members of the Hambrough Company, for their answer to the letter writ them the 20th of May last (mentioned in the minutes of the 3rd of June following) [fo. 168, 302], relating to the allowing of English convoys to the ships of Bremen.

Another representation proposing John Hallet, esquire, to be a member of her Majesty's Councill in Barbadoes [fo. 284, 296], in the room of Tobias Frere, deceased (as directed in the last minutes), was also signed.

A letter to Brigadier Handasyd, Governor of Jamaica [fo. 279], relating to the great obstruction given to the Spanish trade by our privateers in the West Indies, was agreed and signed.

Leeward Islands.

Act about Courts under consideration.

The said Act sent to Mr. Solicitor General.

Upon consideration of the Act past at Nevis the 23rd of February, 170¾, entituled An Act for the establishing of Courts and settling due methods for the administration of justice in this island, ordered that the same be sent to Mr. Solicitor General for his opinion thereupon, in point of law [fo. 288]; and that the secretary at the same time do acquaint him that the like Act has been past throughout the Leeward Islands.

Copy of an Order of Council of the 11th of July, 1708 [fo. 221], upon a representation of the 28th of June foregoing, relating to Mr. John Rayner's being Attorney General of New York, was read.

Regulation relating to the trade of New Spain.

A translation of the regulation made by the Duke of Anjou [fo. 289], relating to the trade of New Spain, under the protection of two French men-of-war sent thither with quick silver, was communicated to the Board by Sir William Hodges.

Letter to Lord Baltimore and Mr. Penn for their agreement about boundaries.

Ordered that the secretary do write to the Lord Baltimore [fo. 288, 381], and to Mr. Penn, to acquaint them that unless they come to an agreement relating to the boundaries between the provinces of Maryland and Pennsylvania, and lay the same before their lordships by the 12th of October next, their lordships will proceed to make their report on that matter, as the same lies before them.

The draught of a letter to Mr. Solicitor General [fo. 286, 384] upon an Act past at Nevis in February, 170¾, for establishing of Courts &c., was agreed and ordered to be transcribed.

Passes for Spanish ships.

Sir William Hodges attending, as he had promised the 18th instant [fo. 279], he acquainted their lordships that he had consulted the most considerable Spanish merchants, in relation to the pass complained of by Monsieur Vryberg (mentioned in the minutes of the 16th instant), and that they were all of opinion that it would not be any prejudice to our trade that the word Holland be left out of the said passes, and that they had therefore no objection why the said passes might not be limited to ports of Great Britain only.

Sir William Hodges then presented to their lordships the extracts of several letters from the Havana, giving an account of Monsieur Du Cass's squadron, and of their trade in those parts, as also extracts of letters from Cadiz, giving an account of the great scarcity of corn in Andaluzia, and those parts of Spain &c., which were read. He further communicated to their lordships an abstract of a new regulation made by the Duke of Anjou [fo. 286] for carrying on their trade to the West Indies.

A letter from the Officers of Ordnance of the 24th instant [fo. 279, 302], in answer to one writ them the 17th instant, inclosing an account of powder and other ordnance stores sent to New Hampshire the 30th of July, 1692, was read.

A letter from Colonel Bennet, Governor of Bermuda, dated the 12th of June, 1708, was read; and the papers therein referr'd to were laid before the Board, and are as follows, vizt.:
