A letter from Mr. Lowndes [fo. 14] of the 10th instant with a report from the Commissioners of the Customes upon two Virginia Bills, approving the same, and further signifying that the Lord High Treasurer [fo. 89] had no objection to the laying the Jamaica Revenue Act before her Majesty, was read; [fo. 97] and thereupon ordered that a representation be prepared for laying the said Act before her Majesty accordingly.

A letter from Mr. Attorney General relating to the want of laws in the plantations for barring the estates tailes and the remainders depending on them, was read.

Mr. Attorney General's report on four Bills.
Two of the said Bills return'd to him by Mr. Jennings for further information.
Mr. Jennings [fo. 31, 99] being returned out of Yorkshire and attending, Mr. Attorney General's report upon four Virginia Bills [fo. 68] sent him the 24th of April last, was read; and their lordships not agreeing intirely with some of his objections to two of the said Bills, a letter was writ to him thereupon, and Mr. Jennings was desired to attend him therewith, as also with the said Bills, in order to give him further information therein.

Mr. Perry about writing to the Governour to forbear personal resentments &c. Whilst the complaints are depending.
Letter thereupon.
Mr. Perry attending [fo. 73, 245] and desiring that their lordships would be pleased to write to Colonel Nicholson that he forbear any personal resentment, prosecution or molestation whatsoever against any person upon his own account whilst the complaint against him is depending, a letter was writ and signed accordingly.

New ingineer appointed.
A letter from the Board of Ordnance [fo. 44, 104] of the 8th instant signifying that they had appointed Captain John Rednap, ingineer, for New England and New Yorke in the room of Colonel Romer, was read, and a letter, in answer thereunto, was signed.

Three Orders of Councill of the 3rd instant upon a representation of the 18th of the last month [fo. 90] relating to the Acts of Bermuda, past in 1690, 1691, 1693, and 1694, viz.:—

An order for repealing four of them were read, and directions given for preparing a letter to transmit the same to Colonel Bennet.
Order of Council about an instruction to the Governour in lieu of Habeas Corpus Act.
And another order directing the Board to prepare an instruction for the said Colonel Bennet in the same manner as was done for the Governour of Barbados in lieu of the Habeas Corpus Act. One of those repealed by the foregoing order was read, and the said instruction prepared, and a representation signed [fo. 115, 116] to lay the same before her Majesty.

Letter to be writ to the Governour about Pemaquid and salary.
An Order of Councill of the 3rd instant upon a representation of the 10th of the last month [fo. 83] upon Colonel Dudley's letters directing this Board to prepare letters from her Majesty to Colonel Dudley relating to the building Pemaquid fort and the settling a salary for the Governour and Lieutenant Governour of the Massachusets Bay, was read, and directions given for preparing a letter accordingly [fo. 229].

Copy of an Order of Councill of the same date upon a representation of the 13th of the last month [fo. 87, 113] relating to commissions for tryal of pirates in America, directing Mr. Attorney and Mr. Sollicitor General to prepare commissions accordingly, was read.

Letter to the Governour not to molest Wallace.
A letter to Colonel Nicholson [fo. 67] in pursuance of the minutes of the 7th June last, directing him not to give Mr. Wallace, one of the complainants against him, any molestation upon account of his said complaints, was signed and delivered to the said Wallace.
Jamaica.
Representation upon Revenue Act.
A representation [fo. 94] upon an Act past at Jamaica in November last [M. fo. 287] for raising a revenue to her Majesty for the support of the government of that island, was signed.
Newfoundland.
Memorial from Mr. Thurston about the convoy's being taken by the French.
Letter to be writ to Mr. Lowndes thereupon.
A memorial from Mr. Thurston [fo. 63] signifying that the Coventry man of war, convoy to the Newfoundland fleet, on board of whom was the money for paying the soldiers there, has been taken and carryed into Brest, and praying their lordships' consideration thereof, being read, directions were given for preparing a letter to Mr. Lowndes [v. infra] to lay the same before the Lord High Treasurer, and further ordered that a duplicate of the heads of inquiry and additional instructions which had been sent to Mr. Burchett [fo. 29] the 4th May last be again sent to him to be given to the commander of the convoy appointed for Newfoundland.

Letter to Mr. Lowndes about the convoy's being carried into Brest.
A letter to Mr. Lowndes [v. supra], as ordered yesterday, upon Mr. Thurston's memorial relating to the Newfoundland convoy's being carryed into Brest, was agreed and ordered to be sent.

Sir Thomas Lawrence attending communicated to their lordships two proposals made to Colonel Seymour, Governour of Maryland, relating to the furnishing her Majesty with plank, timber, masts &c., and to the building of men of war in Maryland, and the producing pitch and tar in Maryland and Virginia, copies whereof were ordered to be taken.

Mr. Jennings, about Bills.
Mr. Jennings [fo. 94] acquainted their lordships that he had attended Mr. Attorney General, as directed the 15th instant, and that he had cleared some difficulties Mr. Attorney had relating to the Virginia Bills that had been refer'd to him, whereupon directions were given for preparing a representation [fo. 114] upon the collection of Virginia Bills received from Colonel Nicholson.
New Yorke.
Suit of clothing &c. given to Patrick Wardrope.
Patrick Wardrop, an old soldier who had served 28 years at New Yorke, having been some while since returned from thence as an invalid, attending; ordered that the suit of the cloathing returned from New Yorke and brought to the Board the 25th May, 1703, by Mr. Thrale, be delivered to the said Wardrope.

Ordered that copies of the Lord Cornbury's letters relating to the Earle of Bellomont and Captain Nanfan's accounts [fo. 102] be made, as also a list of the papers therewith transmitted, and then that the said original letters and papers be sent to Mr. Lowndes [fo. 113], and that he be desired to move the Lord Treasurer that the said accounts be refer'd to such persons conversant in the accounts of the army as his lordship shall be pleased to direct.
Mr. Champante acquainted therewith.
Mr. Champante attending in relation to Captain Nanfan's accounts, he was acquainted with the foregoing order; whereupon he promised to bring to their lordships a memorial in behalf of Captain Nanfan, which he prayed might be also recommended to the Lord High Treasurer.

Letter to the Governours in favour of Captain Rednap the ingineer.
Letters to the Lord Cornbury [fo. 95] and Colonel Dudley in favour of Captain John Rednap, who is sent as ingineer to New England and New Yorke, were signed.
Virginia.
Memorial from Mr. Jennings desiring a consideration for his trouble.
Mr. Jennings [fo. 149] presented to their lordships a memorial praying their lordships' consideration of his expences and charges in coming to England and attending here in reference to the Virginia Bills, which was read, and ordered that in the next letter to Colonel Nicholson he be advised to pay Colonel Jennings 100l. (besides the 100l. that he received at his coming away) out of the two shillings per hogshead.

Order of Council about prisoners taken by the French of Canada.
Extract of Colonel Dudley's letter about skirmish at Deerfield sent to Secretary Hedges.
An Order of Councill of the 17th instant, directing the Board to give an account to one of her Majesty's Secretaries of State, of the English prisoners that have been lately taken by the French of Canada, was read; and thereupon the copy of paragraph D of Colonel Dudley's letter of the 20th of April last, was sent to Mr. Secretary Hedges.

Colonel Blakiston's opinion upon the difference between Colonel Seymour and the late President of Maryland and upon the want of arms there.
Colonel Blakiston attending, and being acquainted with what Colonel Seymour writes about a difference between Mr. Tench, President of the Councill, and himself, relating to a moyety of the 12d. per hogshead on tobaccoes, he said that Mr. Tench's demands were very unreasonable, that he could have no title to the said moyety, the ships not being cleared till after Colonel Seymour arrived. As to what Colonel Seymour writes relating to want of armes, he said that there being a fund settled by Act of Assembly for providing armes, he doubted not but they had 1,000l. at present in bank for that purpose.

Plantations General.
Letter to all the Governours to enclose the Queen's circular letter about prizes, and additional instructions about navigating English ships.
Her Majesty's circular letters to all the Governours and proprietors in America relating to her Majesty's and the Lord High Admiral's shares of prizes, which had been prepared by this Board and sent to Mr. Secretary Hedges the 31st of May last [fo. 53], as also the additional instructions [fo. 82] relating to the number of seamen allowed to navigate English ships during the war, sent also to Mr. Secretary the 7th of the last month, being now received back, ordered that letters be prepared forthwith for transmitting the same to all the Governours accordingly, and that those to the proprietors here in town be sent to them.

Colonel Blakiston's memorial about qutota for New York.
A memorial from Colonel Blakiston, agent for the province of Maryland, relating to their quota for New Yorke, was read; and thereupon ordered that the Act past in 1701 for raising 300l. in part of the said quota, be looked out in order to their lordships' consideration of that matter.

Order of Council confirming Revenue Act.
An Order of Councill of the 3rd instant upon a representation [fo. 87] of the 13th of the last month confirming an Act past at Bermuda in 1698 for raising a publick revenue for the support of the government of those islands, was read; and ordered that it be transmitted to Colonel Bennet.

The draught of a letter to Colonel Bennet [fo. 113] was agreed and ordered to be transcribed.

A memorial from Mr. Lodwick praying for their lordships speedy representation upon an Act past at New Yorke declaring the illegality of the proceedings against Colonel Nicholas Bayard and Alderman John Hutchins for pretended high treason and for reversing and making null and void the said judgements and all proceedings thereon, which he lately left here, was read. Whereupon ordered that the said Act be sent to Mr. Attorney General for his opinion in point of law [fo. 117], and that Mr. Lodwick have notice thereof.

The proceedings of a court of Admiralty [fo. 102, 116, 141] held at New Yorke the 8th April, 1704, relating to the Eagle gally, Captain John Davidson, commander, as also a journal of particular account of all transactions which have happened relating to the seizure of the said ship not taken notice of in the proceedings abovementioned, being received from Colonel Byerly, were laid before the Board, and thereupon ordered that the said papers, as also the Lord Cornbury's letter [fo. 102] of the 26th of June last be sent to Mr. Attorney General for his opinion thereupon, and that notice thereof be given to Sir Jeoffry Jeoffries on the one side, and to Mr. Barker in behalf of Mr. Byerly on the other.
