Prayers.

Lord Loughborough's Navigation.

MR. Swinfein reports from the Committee to which the Bill sent from the Lords, for enabling the Lord Loughborough to make a navigable Passage from Bristow Causey into the River of the Thames, some Amendments agreed by the Committee to be made to the Bill: Which Amendments he read, with the Coherence, in his Place; and after, delivered the same in at the Clerk's Table. Which Amendments were twice read; and all of them, except the Amendment to the * Line of the * Skin, upon the Question, severally agreed to. The which Amendment was, upon the Question, rejected.

Ordered, That the Bill, with the Amendments, be returned back to the Lords: And Mr. Swinfein is to carry them up.

Carr's Estate.

Mr. Milward reports from the Committee to which the Bill for settling the Estate of Sir Robert Carr Baronet was committed, That the Committee had met Six or Seven several times; and had, the First time of their Meeting, heard Counsel on both Sides at large, as to the Stating of the Case; and given Liberty from Day to Day, at the several Times of their Meetings, for the Lady Carr to appear in Person, to produce Witnesses to be examined, and be heard, What further she had to offer by her Counsel, if she pleased; in which she had not only made Default, but her Servants and Agents in the Country had disobeyed and contemned both the Orders of the House, and the Committee; and refused to attend the Committee, or to permit any Access to be had to Sir Robert Carr: And that the Committee had examined several Witnesses; and found the Matter of Fact, in relation to the Fraud, Force, and Practice, used in obtaining the Deeds from Sir Robert Carr, to be fully proved: And that they had thereupon proceeded; and had agreed to the Bill, with Amendments to be made thereto: Which he read, with the Coherence, in his Place; and after delivered the same in at the Clerk's Table: Which were twice read; and, with the Addition of these Words, "or by Sale thereof, or so much thereof," after the Word "*," in the Amendment of the * Line of the * Sheet, the said Amendments were twice read; and, upon the Question, severally agreed to.

A Petition of Dame Mary Carr, Wife of Sir Robert Carr, was read; and debated.

And the Desire of the Petition being, That she might have Liberty to produce Witnesses, and be heard, by Counsel, at the Bar of the House;

The Question being put, That the Cause shall be heard at the Bar of the House;

It passed in the Negative.

Resolved, &c. That the Bill, with the Amendments agreed to, be ingrossed.

Ordered, That * Lavington be sent for in the Custody of the Serjeant at Arms attending this House, for his Contempt, and Breach of Privilege, in disobeying the Order of the Committee of the House; and not permitting Colonel Williams, a Member of this House, to have Access to Sir Robert Carr Baronet.

Higgon's Petition.

A Petition of Sir Thomas Higgons, a Member of this House, was read.

Resolved, That Leave be given for a Bill to be brought in, for Relief of Sir Thomas Higgons, according to the Desire of his Petition.

Navy Debt.

Resolved, That the Report of Sir Richard Ford, touching the Victuallers of the Navy, be heard Tomorrow Morning at Ten of the Clock.

Leave of Absence.

Ordered, That Mr. Bagenall have the Leave of this House to go into the Country.

Sutton Marsh.

Ordered, That Colonel Williams be added to the Committee to whom the Bill for settling Sutton Marsh on the Most Noble Charles Lord Duke of Richmond, is committed.

Hallage Duty.

Ordered, That the Report of the Bill for regulating the Duty of Hallage, be heard on Thursday Morning, at Ten of the Clock.

Arrest of Judgment.

The House proceeded to the reading the Amendments to the Bill to prevent Arresting of Judgment, and Superseding of Execution: Which Amendments, being twice read, were, with the Addition of these Words, "argued in Court," after the Word "Demurrer;" and of these Words, "or personal," before the Word "Confession;" and "of the Party," after the said Word "Confession;" were, upon the Question, severally agreed to.

Ordered, That the Bill, with the Amendments agreed to, be ingrossed.

Debtors Relief.

Ordered, That these Members following be added to the Committee to whom the Bill for Relief of poor Prisoners is committed; viz. Francis Lord Vaughan, Sir Tho. Strickland, Mr. Robert Thomas, Sir John Vaughan, Sir Herbert Price, Sir Edmond Bowyer, Major General Langherne, Mr. Walter Strickland, Mr. John Lowther, Colonel Wm. Morgan, Mr. Arthur Owen, Colonel Kirkby.
