Letter read.

SIR Arthur Hesilrig reports from the Council of State, a Letter from Colonel James Heyne, from the Isle of Jersey, of the 27th Day of January 1651: Which was this Day read.

Act of Oblivion.

The House, according to former Order, resumed the Debate upon the Act of General Pardon and Oblivion.

A Proviso was tendered to this Act, in these Words; viz. " Provided always, and be it also Enacted, That out of this present Act be excepted the Sum of Two thousand Pounds Principal Monies, besides the Consideration for Forbearance thereof, lent and paid into the Chamber of London, by Richard Piggott, Citizen and Grocer of London, in the Months of June and July 1641, upon the Credit of an Act of Parliament for raising of Two intire Subsidies for the Payment of One hundred thousand Pounds, or thereabouts, then lent thereupon by several Citizens of London, intituled, An Act for the further Relief of his Majesty's Army, and the Northern Parts of this Kingdom: Which said Sum of Two thousand Pounds, with Consideration for the Forbearance thereof, shall remain and be chargeable upon the Arrears of the aforementioned Act; any thing contained in this present Act to the contrary notwithstanding." Which was this Day read the First time.

The Question being put, That this Proviso be read a Second time;

It passed with the Negative.

A Proviso was tendered to this Act; " Provided, that this Act, or any thing therein, be not construed to extend to the Pardoning or Discharging of any Assessment, Subsidies, Impositions, Imposts, or the Arrears of any of them; or of the Fee-farm Revenues of the late Crown, Court of Wards; or of any Debt or Income, in any kind whatsoever, due and payable to the State, which have been assigned, set-over, or appointed, for Security and Satisfaction of any Sums of Money owing by the State, as lent to them; or for Goods or Provisions furnished to the Use of the Publick; or any otherwise due and charged upon the said Rents, Assessments, or Incomes, by Act, Ordinance, or Order of Parliament, or Authority derived from them; until the said Debts, so charged, be thereby satisfied and paid; or the said Debts and Engagements be otherwise satisfied and discharged by the Parliament:" Which was this Day read the First Time.

The Question being put, That this Proviso be read a Second time.

The House was divided.

The Yeas went forth.

So it passed with the Negative.

Resolved, That this Debate be taken up on Tuesday Morning next, the first Business.

Scotch Affairs.

A Letter from the Commissioners of the Parliament in Scotland, from Dalketh in Scotland, of 31th Day of January 1651, was this Day read.

Resolved, That it be referred to the Council of State, to take these Letters into Consideration; and such of the Particulars therein, as are in their Power, in reference to Scotland, to use their best Diligence therein: And as to the Seals, and Ordering of the Forces there, and other Matters in the said Letter, that they do consider thereof, and present their Opinions therein to the Parliament, with all Speed.

Ordered, That the Lord General do forthwith take an effectual Course, to send down all the Officers, belonging to the Forces now in Scotland, to their several Charges there.

Report deferred.

Resolved, That the Report and Petition of Alderman Fowke, be taken into Consideration on This-day-sevennight, the first Business.

Ordered, That the Amendments to the Act for Naturalization, be reported This-day-sevennight: And that the Committee be impowered to present to the Parliament the Names of such Persons as they think fit to be inserted into the said Bill for Naturalization.

Ordered, That the Reports touching Dorcas Maleverer, the Relict of Colonel John Maleverer, deceased, * * * *.

Grant to Col. Horton's Brigade.

WHEREAS, by Order of Parliament of the 25th of March 1651, the Committee in the Act for Sale of Delinquents Estates, were impowered to make good the Promise made by the Parliament, of settling 1,000£. per Ann. upon Colonel Horton's Brigade, according to former Order of the House, out of the Delinquents Estates, by the said Act appointed to be sold, in such sort as they shall think fit, and for the most Advantage of the Commonwealth.

And whereas the said Committee, in Pursuance of the said Order of Parliament, did, by their Order of the 4th of September last, order, That, for the making good to the said Brigade the said Promise, Lands, of the Value of One thousand Pounds per Annum, be settled upon the said Brigade, out of the Lands and Estates appointed by the said Act, intituled, An Act for Sale of several Lands and Estates forfeited to the Commonwealth for Treason: And that the said Trustees appointed by the said Act, for Sale of the said Lands, do set-forth and settle upon the said Brigade, out of the said Lands and Estates so appointed to be sold, Lands of the Value of One Thousand Pounds per Annum, as they shall find fittest, with most Advantage to the Commonwealth:

Forasmuch as no particular Persons have been appointed, to whom the said Lands may be conveyed, for the Purpose aforesaid:

It is Ordered, by the Parliament, That Colonel John Okey, Colonel Philip Jones, Colonel Thomas Read, Major Walter Bethell, Major Tobias Bridges, Major Nathanael Barton, Major John Wade, Major Christofer Mercer, Captain Thomas Goddard, Captain Benjamin Burges, Captain Edward Orpin, Captain John Nicholas, and Captain William Forster, who are Commanders and Officers in the said Brigade, be, and are hereby, nominated and appointed Trustees for and to the Use of the said Brigade: And that the said Trustees, for Sale of the said Lands and Estates, do make a Conveyance, accordingly, unto the Persons herein named for Trustees for the said Brigade, and their Heirs: And that they, or any Three or more of them, be and are impowered to convey or dispose the same, or any Part thereof, to or for the Use or Benefit of the particular Persons which did belong unto the said Brigade, according to the Intention of the former Order.
