PRAYERS.
Ship-money.
POWERis given to the Committee for Ship money to treat and consider of all things, that may concern that Business.
Leave of Absence.
Leave is given to Mr. Jo. Meaux of Newport in the Isle of Wight, to be absent, for some great Occasions of his own, till after Christmas.
Recusants.
Ordered, That the like Order, as was sent to the Justices of Peace for Middlesex and London, for the Indicting and Prosecution of Recusants, at the next Sessions, be sent to all Justices of Peace within the several Counties of England and Wales; and to all the Officers of every several Liberty, within the said Counties; to proceed accordingly, at the next Sessions: And that Copies of this Order be delivered to the Knights of all the Shires, and to the Citizens and Burgesses of the Cities and Boroughs, within the said Counties; to the End that they may be sent down with Care and Speed.
Grants to the Queen.
Lord Chief Justice Litleton, and the Lord Chief Baron Davenport, bring from the Lords a Bill, intituled, An Act for the Confirmation of several Letters Patents, made by our Sovereign Lord the King, and other Grants, made to his Majesty's dearest Consort, the most High and Excellent Princess Henrietta Maria, Queen of England, Scotland, France and Ireland, and others, in Trust, for her Use.
Ship-money.
Mr. St. Johns reports from the Committee for Ship- money:-Which is to be entered, together with the other Particulars, read in this House, and ordered to be entered.-
His Report ended, it was
Resolved, upon the Question, Nullo contradicente, 1. That the Charge imposed upon the Subjects, for the Providing and Furnishing of Ships; and the Assessments, for raising of Money for that purpose, commonly called Ship-money; are against the Law of the Realm, the Subjects Right of Property, and contrary to former Resolutions in Parliament, and to the Petition of Right.
Resolved, upon the Question, Nullo contradicente,
2. That the extrajudicial Opinions of the Judges, published in the Star-chamber, and inrolled in the Courts of Westminster, in hæc verba, &c.
in the Whole, and in every Part of them, are against the Laws of the Realm, the Right of Property, and the Liberty of the Subjects, and contrary to former Resolutions in Parliament, and to the Petition of Right.
Resolved, upon the Question, Nullo contradicente,
3. That the Writ following, in hæc verba, &c.
and the other Writs, commonly called the Ship-writs, are against the Laws of the Realm, the Right of Property, and the Liberty of the Subjects, and contrary to former Resolutions in Parliament, and to the Petition of Right.
Resolved, upon the Question, nullo contradicente,
4. That the Judgment in the Exchequer, in Mr. Hampden's Case, a Transcript whereof followeth, in hæc verba, &c.
in the Matter and Substance thereof, and, in that it was conceived, that Mr. Hampden was any way chargeable, is against the Laws of the Realm, the Right of Property, the Liberty of the Subjects, and contrary to former Resolutions in Parliament, and to the Petition of Right.
Lord Falkland, Mr. Hollys, Mr. Hide, Sir J. Culpepper, Mr. Kirton, Mr. A. Goodwyn, Sir M. Fleetwood, Sir Guy Palmes, Sir Wm. Litton, Mr. Perpoint, Sir J. Strangwayes, Ld. Wenman, Mr. Crew, Sir A. Haslerigg, Mr. Perd, Sir Fr. Seymour; these are to go forthwith to the several Judges, to know how they were solicited or threatened, and in what Manner, and by whom, to give any Opinion [or Judgment] concerning Ship-money; and Three to go to a Judge.
This Committee hath likewise Leave to acquaint the Judges what hath been voted this Day in the House, touching Ship-money; and to use their own Discretions, to ask such Questions, as shall be material to the Matter contained in the Order.
Bossinny Writ.
Resolved, upon the Question, That the Election of the Burgesses for Bossinny, in the County of Cornewall; is void; and that a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery. for a new Writ, for Electing of Two Burgesses to serve for the said Town of Bossinny in this present Parliament.
Corryton's Misdemeanours.
Ordered, That the Committee for Mr. Corriton's Business shall consider also of the Misdemeanours committed by Mr. Corryton, as Steward of the Duchy, and Deputy Lieutenant of the County; and are to meet on Friday in the Afternoon, at Two of Clock, in the Court of Wards.
Mr. Chadwell, and Mr. Prideaux, are added to this Committee.
Barwick Writ.
Ordered, That the Election of Sir Edw. Osborne, for One of the Burgesses for Barwick, is void: And that a Warrant issue forth, under Mr. Speaker's Hand, for a new Writ, to elect another Burgess to serve for that Town in his Stead.
