Dec. 17. Henry Guy to the Customs Commissioners. The Treasury Lords agree that you postpone your opinion on retrenchments till after Christmas. But as they intend within three or four days to adjourn for all the 12 days of Christmas, you are to attend them on Monday next with the presentment[s] or increase of officers and whatever else you have to offer. Same to the Auditors of Imprests. The Auditor of Excise and Comptroller of Excise are to send you the certificates you desire relating to the accounts of Sir John James and partners. Dec 17. The Treasury Lords to Sir Peter Wyche. In reply to yours of the 28th ult., which has been read at our board, if you will draw bills for 1,000l. on Charles Duncombe at double usance they shall be punctually answered by him "which sum we hope will be sufficient to bring you away with the reputation you desire." Henry Guy to Serjeant Ramsey to repair to Salop to the estates of Mr. Cresset, late Receiver of the Eighteen Months' Assessment, co. Salop, and of Mr. Pope, his security (which have been extended for said Cresset's great arrear and leases thereof are preparing in the Exchequer), and consult with persons there as to the safest and speediest way of answering said debt. Henry Guy to the Attorney General to peruse the grant formerly made to Mr. Heywood of the forfeitures of recognizances in co. Lancs, and to consider whether same extends to the recognizances of Recusants which now are very many and amount very considerably. Out Letters (General) VI, p. 364.

Treasury reference to the Customs Commissioners of the petition of Robert Leslie for a landwaiter's place, London port, his father having served the late and present King for 60 years and petitioner having been taken at Preston fight in 1648 and kept prisoner 10 months and since the Restoration he was a Lieutenant in his Majesty's Regiment of Guards in Scotland and was at Pentland Hills against the rebels there and had the command of a Company on board the Edgar for Tangier, but by reason of sickness the ship was not able to perform her poyage. In the margin: a later Treasury recommendation dated 1681–2, Jan. 17, to the said Commissioners to present petitioner. Reference Book I, p. 512.

Howard and Mr. Hall, proposing to make a discovery of a rent not answered to the King for many years and also an estate in lands possessed by certain persons. Royal warrant to the Clerk of the Signet for [a privy seal for] determining the grants made to three of the King's waiters of London port, viz.: Richard Ham (constituted 1660, July 10, by the then Treasury Lords and Sir Philip Warwick, their Secretary), John Harper (constituted in 1668) and James Seward (constituted 23 April, 1674, by Treasurer Danby), they having behaved themselves fraudulently in their office. Treasury instructions to same in reply to the latter's memorial of the 19th inst. (1) On examining the printed Book of Rates with the record in the custody of the Clerk of the House of Lords you find that, in the printed book, ginger of the English Plantations is rated at 1 pound the cwt. and so to pay only 12d. per cwt., but in the original record ginger from the West Indies is rated at 16d. per pound [and so] to pay somewhat more than three farthings per pound which would destroy that trade, now become very considerable and daily increasing. Upon representation hereon to Treasurer Danby you were directed to collect the duty as formerly on ginger of the English Plantations according to the rate of the printed book of 20s. per cwt. and thereupon the duty was so collected. The said order of Treasurer Danby was not ("as you thought it had been lately") confirmed by the Treasury Lords among the other orders confirmed by them (supra Calendar of Treasury Books, VI, pp. 24–28). It is therefore hereby confirmed. Ibid, pp. 41–2.
(2) As to Nicholas Parke, the patent landwaiter, we shall desire the Attorney General to proceed against him for his office.
(3) We intend to forbear giving any direction in the business of corn imported at Newcastle and other places in the North (as you have desired) till we be fully informed of the case by you.

Treasury warrant to same to discharge the seizure of the ship Olive Branch of Topsham, William Fippard master, owned and freighted by Thomas Tooke and Herbert Aylwin merchants, said ship being English built and manned with nine English (William Phillips, John Masters, Jno. Plymouth, David Browne, Jno. Wraford, George Yeatman, Jno. Burry and Jno. Wellstead), having sailed in April last for Newfoundland and thence to Lisbon, where the commander of his Majesty's frigate Kingfisher took two of her men (Wraford and Yeatman), so the master of the Olive Branch got two Dutch in their place and proceeded to Villa Nova, where another (Browne) deserted and he had to take in a third alien, so that on her arrival in London said ship was seized. Out Letters (Customs) VIII, pp. 45–6.

Same to the Attorney General to advise the Treasury Lords whether if the King should sell the old Artillery Ground (which is his ancient inheritance and has always been a privileged place) and if same should prove to be within the liberties of the city, the King has power to grant a market to them that shall buy it. Ibid.
Same to Sir William Warren. In the proposal for the Artillery Ground none are to bid under 4,000l. without a market and not under 1,200l. more if a market be obtained and settled within two years after the grant is passed: "and for Well Close that 20l. per [an.] rent be reserved to the Crown." (The like letter to Mr. Neale, Mr. Barebone, Sir Christopher Wrenn and Mr. Killegrew.) Ibid.

Report to the King from the Treasury Lords on a draft letter proposed to be sent to the Lord Lieutenant of Ireland, as by a reference dated Dec. 2 from the King. Hereon the Treasury Lords report: we have no objection thereto. Out Letters (Ireland) II, pp. 192–4.
Prefixing: said draft. Under the authority of the royal sign manual dated Whitehall, 1676, Mar. 28, the Duke of York has made discovery of the following lands (amongst other lands concealed, to which he made out the King's title and has lately placed deficiencies thereon) viz. the town and lands of Killmaeckeoge [Kilmacud], containing 703 acres of profitable land and 120 acres of unprofitable in the barony of Rathdown, co. Dublin, 90 acres in the town and lands of Staholmog, in the barony of Kells, co. Meath, formerly the several properties of Sir Tho. Nugent, Patrick Hussey and Walter Drake; the town and lands of Ardetraine [Ardagh], containing 70 acres of profitable land and five acres of unprofitable, in the barony of Loughinsholin, co. Londonderry. According to the late stating of the Duke of York's deficiencies the abovesaid lands, containing 863 acres 3 roods 12 perches, do fully answer and balance the quantity due to him in reprisal and will fully satisfy him for all and every deficiencies due to him by the Acts of Settlement and Explanation. It is the King's intention that the said Duke be satisfied in the first place before all others. A patent is therefore hereby to pass the great seal of Ireland to grant the abovesaid lands to said Duke of York.
Dec. 23. Treasury warrant to the Lord Treasurer's Remembrancer to forthwith issue writs of certiorari to the Clerks of Assize and Clerks of the Peace in co. Lancs, requiring them to certify and return into the Exchequer all forfeited recognizances of Recusants and others entered into to the King as King of England: the same not having been duly certified as they ought, whereby process of Exchequer might go forth. Same to Richard Graham and Phillip Burton of the petition of Thomas Hughes and William Smyth, shewing that since Nov. 1678, they have made it their sole business to discover estates of Jesuits and Romish priests and were encouraged by the Treasury Lords' order of 1679, June 14, and the King's proclamation of 1679, Nov. 15. Inter al. they have brought a case against the Jesuits for 2,550l. lent to Henry Nevill, which the Jesuits attempt to delay by a cross bill. Dec. 30. Royal warrant to the Attorney or Solicitor General for a great seal to contain an indenture as follows between the King of the one part and the Farmers of Excise (George Dashwood, Thomas Rowney, Samuel Dashwood, Felix Calverd, John Freind, William Strong and Edward Buckley) of the other part relating to the surplus of the Excise for the year ended 1681, June 24: viz. as follows and on the lines generally of the similar indenture for the preceding year's surplus (see supra, pp. 55–6). In accordance with the covenants in their lease of 1678–9, Mar. 13, the said Farmers have delivered to the Treasury Lords an account of their management of the Excise for the year ended June 24 last, being the first year of their said lease. Said account as stated by the Auditor shews a full produce of the Excise of 559,786l. 3s. 0¼d., and 61l. 12s. 8¼d. for over entries by brewers and 168l. 11s. 2d. for compositions omitted to be charged in former accounts, or in all 560,016l. 6s. 10½d.: out of which they are allowed 446,000l. for one year's rent, 56,000l. for charges of management, 5,000l. for bad debts, 10,000l. for reward and hazard, 747l. 3s. 9½d. for beer exported within the time of said account, 56l. 1s. 10¼d. for allowances to brewers by order of the Excise Commissioners, and 100l. 9s. 4½d. for money paid to John Wilcox, brewer, by order of the Treasury Lords, making in all 517,903l. 15s. 0¼d., thus leaving a surplus of 42,112l. 11s. 10¼d. Towards this surplus the said Farmers are allowed 34,143l. 17s. 2½d. for money paid to the Excise Commissioners on account of such surplus, 1,317l. 5s. 10¾d. for interest thereof from the times of payment to 1681, Dec. 25, and 34l. 10s. 5d. for 35 days' interest of 6,000l. paid to one Bernard Turner upon his Majesty's account and 2,150l. 12s. 6d. for the said Farmers' allowance of 12d. per £ on the said surplus. These allowances make a total of 37,601l. 6s. 0¼d. thus leaving a balance of 4,511l. 5s. 10d. of said surplus still to be paid by said Farmers. This balance the said Farmers have now paid. By the present indenture therefore the King releases and discharges said Farmers of all claims and accounts touching said surplus and the Treasury Lords are hereby, if so desired by said Farmers, to cause tallies to be stricken and other acts done for such their absolute discharge as above, and on their part the said Farmers covenant that they will pay the surplus for the last two years of their farm according to the covenants of their lease, as if the present great seal had not been made. Dec. 30. Royal warrant to the Clerk of the Signet for a privy seal for discharging William Tyndal of his surety bond as follows. James Collins, of York city, was appointed collector of Hearthmoney for the city of York and West Riding of co. Yorks from Lady day, 1671, and of the arrears thereof from 1669, Lady day. His securities were Thomas Heber of Stainton, co. Yorks, William Tyndal of St. Mary Magdalen parish in Castle Baynard Ward, London citizen and merchant taylor, John Lodge of the parish of St. Katherine Creechurch in Aldgate Ward, London, merchant, and Christopher Watkins of the parish of St. [Se]pulchre in the Ward of Farringdon Without, London, citizen and haberdasher, and their joint bond dated 1671, May 4, was for 7,000l. By the privy seal of 1675–6, Jan. 19, Tho. Heber, one of said sureties was discharged from said bond, the said Collins being indebted to the King above 2,000l. and of the said debt the King did by said privy seal grant 1,000l. to Sir Roger Bradshaigh, kt., to his own use, which sum the said William Tyndall has paid to said Bradshaigh as appears by said Bradshaigh's acquittance, dated 1677, Sept. 8. Dec. 30. Royal warrant to the Clerk of the Signet for a privy seal to discharge William Ellesdon from his bond as a surety of George Pley, collector of Weymouth port, said bond in 1,200l. having been entered into 1673, Dec. 24, by said William Ellesdon of Charmouth and by said Pley. The consideration for the present release is that said Ellesdon has paid on Nov. 23 last to the Customs Cashier 49l. 11s. 1½d. on account of coinage duty due to the King from said Pley, and to be as a further instance of the King's favour to said Ellesdon "in regard he was instrumental to our escape after the fatal battle of Worcester." Treasury warrant to the Customs Commissioners to discharge the 1 per cent. duty demanded on the lading of the ship Cicilian, William Stout commander, same having arrived from the Mediterranean with 30 men, being two less than her complement as by the Act of Frauds, said ship having sailed for Leghorn from London in May, 1681, with 32 men and 18 great guns, and one of her men having deserted to the King's frigate Falcon, Capt.
