Feb. 1.

Same to the Attorney or Solicitor General for a great
seal for a farm of the Additional Excise in the form
of an indenture between the King of the one part and
George Dashwood, Thomas Rowny, William Roberts,
Samuel Dashwood, Felix Calverd, John Freind,
William Strong and Edward Buckley, of London,
Esqrs., of the other part. By indenture of Feb. 26
last [1676-7], the King (in consideration of 250,000l.
by them advanced at the times and in the proportions
as mentioned in the said indenture of Feb. 26
last and in consideration further of the rents
and covenants therein reserved and set out) did
for 3 years from June 24 then next ensuing [i.e.
1677] and now last past grant the farm of the
Excise as by the two Acts of 12 Car. II. :
together with a covenant on the King's part that if
the Additional Excise granted by the Act of
22 Car. II. should be continued by any fresh Act
of Parliament during the term of this farm that
then said Dashwood and partners herein should
have a lease of said Additional Excise for the said
term of 3 years. By the Act lately passed for
the Additional Excise the said Additional Excise
is continued for three years from 1677, June 24.
Therefore the present indenture demises to said
Dashwood and his partners herein the said rates of
Additional Excise for 3 years from 1677, June 24,
subject to the rents and covenants as in the said
recited indenture of 1676-7, Feb. 26. And whereas
in the said rated indenture the said Dashwood
and partners did covenant not to sub-let or sub-farm
the Excise within any county, city, borough or place
without the consent of the Lord Treasurer, and that in
case of such consent they would pay to the King
all advance moneys coming to them from such
sub-farms to be repaid with 6 per cent, interest
in such manner as should be agreed upon between
the King and them ; and whereas further they
have sub-let the farm of the Excise of Wales at the
rent of 13,600l. per an. and the like for Cumberland,
Northumberland, Westmorland and Durham at
14,000l. per an. on which sub-farms several advance
moneys amounting in all to 13,800l., have been paid
to them, which they have lent and paid to the
King as above, this indenture further witnesses
that for securing said loan of 13,800l., with interest,
the said sum shall be allowed and repaid to
said Dashwood and partners by way of retainer,
and that they may detain the same in their hands as
follows out of the rents due from them, viz., 3,450l.
out of their farm rent payable Lady day, 1679 ;
3,400l. out of same due 1679, June 24 ; 3,450l. out of
same due Michaelmas, 1679, and 3,450l. out of same
due Christmas, 1679 : and the King hereby
covenants to pay 6 per cent, interest for said sum
from July 16 last [1677], until repayment of same ;
such interest to be by way of defalcation or detainer
out of their farm rent quarterly, the first such
defalcation to be made at Michaelmas now last
past [1677] : with proviso that the said Dashwood
and partners shall not be liable to account for the
profits of the Excise of Wales or of said four
Northern counties : and with proviso further
that if the King reassume the Excise he will first
repay to said Dashwood and partners he said
13,800l. with interest thereon in the same manner
as the said 250,000l. with interest thereon is to be
repaid in the like case as by the said recited indenture

the accompt of Walter Strickland, Esq., deceased,

county and York city, it appears that there is due
and in arrear from the city of York 517l. 7s. 1d. of
the said aids and assessments as below. For
recovery hereof process of Exchequer ought to
issue out against you the Commissioners and against
the inhabitants of said city for not levying and answering
same in due time, the Acts for said grants
having provided that the tax set upon any place shall
not be lessened or abated by any negligence, wilfulness,
mistake or other accident whatsoever. I desire
you to take some speedy course for discharging
the arrear by making reassessment or such others
ways as you think meet, and according to the powers
given to you by the Acts : and so prevent the
inconvenience to yourself from Exchequer process.

yearly rent of 1,200l., payable quarterly, of which

be retained to the proper use of the said Sir Bernard
Gascoigne for so long of the said terms as he shall
live, as in discharge of the pension to him as below
(in case the said duty shall amount to so much) ; and
the residue thereof, after satisfying the said pension,
to be paid into the Exchequer : nevertheless
with this express agreement between the king and
said Gascoigne that during the continuance of the war
between France and Spain or in case that by reason
of any other war or any plague, fire or other accident
happening at any time during the said term the
said duty of 5s. per ton shall not answer the said
rent of 1,200l. per an. that then and immediately
thenceforth said Gascoigne, his heirs, etc., shall
only be chargeable as an accomptant to the King
(as he now is by the privy seal as below) for so
much as and no more than the said duty shall (over
and above all necessary charges and deductions)
amount to according as the same shall be certified
out of the Register book of the Custom House
under the hand of the Collector of the Navigation
Act and of the Comptroller General of the Customs ;
or otherwise (at the election of the said Gascoigne,
his heirs, etc.) that they shall have such defalcations
and deductions for the said accidents as the Lord
Treasurer shall think fit ; and that in case he
become such an accomptant the said 600l. per an.
pension and all arrears thereon shall be in the first
place paid or retained as above and only the residue
after such payment and after such charges and
deductions as above is to be paid into the Exchequer :
the King having granted to said Gascoigne a pension
of 600l. per an., which was afterwards settled to be
paid out of said French duty ; which pension said
Gascoigne has since assigned to John Lord Pawlet,
of Hinton St. George, and Thomas Fowles, citizen
and goldsmith of London, in trust for himself, said
Gascoigne ; and the King having further by indenture
of 1674, Nov. 26, granted said French duty
to said Gascoigne at 1,200l. per an. rent and for
7 years 1 month and 20 days if the said duty and
the duty of 50 sols per ton imposed by the French
King on English shipping shall so long continue ;
"and whereas of late since the war between France
and Spain very few ships of the subjects of the
French King have arrived in any of our ports of
England or Ireland whereby the said duty of 5s. per
ton is much increased [sic for decreased]" therefore
by the privy seal of 1674, Oct. 30 (1675, Oct. 13,
according to the Docquet Book see Cal. Tr. Books,
Vol. IV. pp. 602, 809) said Gascoigne was made an
accomptant as above during the continuance of the
said war, and is now desirous to have a fresh lease
upon surrender under the like understanding as above.

Commissioners to permit a lading of fish out of the
ship Mathew, of Lynn Regis, to be landed without
payment of the duties imposed by law on fish caught

of the seizure of said vessel, but there being a doubt
whether such discharge implied the discharge
also of said fish and its free import as above by
