Dec. 1. Same to the Auditor of the Receipt to pay 60l. to the Mayor, etc., of Clifton Dartmouth Hardnes for 1½ years to Sept. 29 last on their allowance for keeping their castle. Ibid.
Same to Mr. Ramsey. Treasurer Danby is acquainted by the continued complaints to the King and to himself from the Hearthmoney Contractors that several Justices of Peace in the country do still proceed to make illegal orders and judgments in prejudice of the Hearthmoney revenue notwithstanding the late resolutions of the judges in the King's Bench Court. It has been thought convenient that such orders and judgments be by certiorari removed into the said Court of King's Bench and prosecuted there at the King's charge. This is to give you notice thereof, and that you take care to remove and prosecute the same accordingly. Out Letters (Customs) III. p. 386.
Warrant from Treasurer Danby to the King's Remembrancer revoking the Treasury warrant of 1676, Nov. 14, and ordering issue of process against John West on the judgment formerly obtained against him on his bond as one of the sureties of George Pley, junr., late Collector of Lyme port : it appearing that Abraham Atkins who was one of the securities of said Pley and who paid 1,200l. to the King in part of said Pley's debt has obtained a judgment lately against said West upon a counterbond or some other account for a considerable sum, and is about to levy the same which may weaken the security of the said West to the King. Warrant from same to the King's Remembrancer to prosecute John White, late of Oxford, gent. [brewer], upon his bonds ; he owing considerable sums to the King, and having for some time absconded himself, by means whereof some of his creditors have obtained a commission of bankruptcy against him, and the Commissioners have proceeded thereon and are now ready to make a dividend and dispose of White's estate among his creditors to the prejudice of the King. Warrant from Treasurer Danby to the Barons of the Exchequer and the King's Remembrancer to take the sureties of Henry Ball, gent., as one of the Collectors of Newcastle upon Tyne for life, loco John Holman, gent. ; and thereupon to swear him in : said sureties being, besides Ball himself, Allan Wharton, of St. Margarets, Westminster, and John Bindlosse, of London, merchant. Dec. 4. George Ward, an ensign in the Barbados regiment, assigned 77l. 7s. 6d. to Robert Weldy living in Milford Lane against St. Clements Church, Mr. Baines having promised payment thereof, alleges now it is paid to said Ward, which being suspected [to be untrue] Mr. Weldy prays to be heard before any allowance be made to Mr. Baines of the said payment upon his [Baines's] account [for said regiment as Commissary General of the Musters]. Dec. 5. Warrant from Treasurer Danby to Sir Edward Griffin, Treasurer of the Chamber, to pay to John Cox, late one of the Messengers of the Chamber, and to his son Edward Cox, who succeeds him in his place (supposing the said Edward Cox to be still one of the said Messengers) 249l. 7s. 6d. for five years to Sept. 29 last on their wages : paying same out of money ordered to be issued to you out of the Exchequer : same appearing to be due to them by the certificate of Humphry Dove, your clerk, (Charles Bertie dated Dec. 7 to the Auditor of the Receipt to issue same to said Griffin : and same to the Customs Cashier to bring same in notwithstanding any former restriction.) Warrant from Treasurer Danby to the Receipt. In Easter, 1665, the sum of 6,666l. 13s. 4d. was issued at the Exchequer to Hugh May for the Works ; same being by three tallies to that amount levied upon Thomas Price, late Receiver of the Royal Aid, co. Hereford. One of the said tallies was for 1,866l. 13s. 4d., and it appears by certificate dated 1675-6, March 10, from said Price that 69l. 3s. 4d. remained unpaid by him upon said tally. By privy seal of 1675-6, March 20, said Price was discharged of said 69l. 3s. 4d. on his account, and the tally on which same was due and unpaid was to be vacated and a new tally struck to discharge said Price of 1,797l. 10s. 0d., which he really and bona fide had paid to said May. You are therefore hereby to vacate said tally for said 1,866l. 13s. 4d. and to strike a fresh tally for said 1,797l. 10s. 0d. Ibid.
Money warrant for 240l. for one year each on the annuities of 120l. each to Richard Mounteney, junr., and John Wheldon (Whelton). Warrant from Treasurer Danby to the King's Remembrancer to stay process against John Adderly, late Receiver of the last Eighteen Months' Assessment for co. Derby ; he desiring further time to collect his arrears and clear his accompt. Warrants not Relating to Money VII. p. 128.
Entry of [Treasurer Danby's subscription of a docquet of a] demise [by in custodiam lease under the Exchequer seal] to Thomas Evington at the nomination of John Hicks of the annuity or annual rent of 140l., in co. Hunts for the term of the life of Robert Payne, being part of the lands and tenements of said Payne, outlaw. Ibid, p. 129.
Report to the King from Treasurer Danby on the report dated Dublin Castle July 21 last from the Earl of Essex, then Lord Lieutenant of Ireland, on the petition of John, Lord Berkeley, as by the order of reference of June 11 last referring said petition to the Lord Lieutenant : the said report from the Earl of Essex being as follows. By patent of 1671, Sept. 15, said Lord Berkeley was granted a pension of 1,200l. per an. during pleasure. By great seal of 1674, Dec. 4, the arrear of 3,000l. owing thereon was ordered to be paid as to a moiety thereof out of the Customs and imported Excise of Ireland between 1675, Dec. 25, and March 25 following and the other moiety out of same between 1676, March 25, and 1677, June 24. But as the moneys of said Customs and imported Excise of Ireland were wholly applicable to the charge of the present establishment of Ireland and the said pension was omitted out of the same, I was as I conceive restrained from allowing the petitioner the benefit of said great seal. So no part of said pension has been hitherto paid to said Lord nor is there any fund on which same may now be placed unless it be placed on the surplus which will hereafter arise on the revenue of Ireland above the present establishment thereof. The abovesaid report being referred to Treasurer Danby Sept. 21 last, Treasurer Danby hereby reports that the said surplus of the revenue in Ireland has since been fully charged "so that it doth not appear to me that the said arrear can be satisfied unless your Majesty shall think fit to direct the payment thereof some other way." Dec. 6. Mr. Whitfield, Clerk of the Estreats, is informed that one Mr. Legge is suing for a reversion of his [Whitfield's] office after Peer Williams his [Whitfield's] predecessor, who had once a patent for his [said] office at the King's restoration, but held it [only] by Treasurer Southampton's fiat when the said Earl of Southampton was Treasurer. But said office was always before that patent granted by the Lord Treasurer's fiat and so [by that tenure] Mr. Whitfield holds it now and [therefore] desires that this new grant (which Legge petitions for and which is referred to the Attorney General's consideration) may not pass till he be heard. Corporal William Harby's relict, being informed that her husband's pay in the Barbados regiment is placed as paid in Mr. Baines's books in Aug., 1674, and it appearing by certificate of his burial that he died two years before, prays that she may be heard by her solicitor, Capt. Talbot, before the said pretended payment be allowed on said Baines's account. Caveat Book, p. 30.
Edward Gent as executor and legatee to Edward Burnill prays he may also be heard before allowance be made of the said Burnill's pay [in the said Barbados regiment] which is also said to be paid to him two years after his death by the name of John Burnett. Ibid.
John Radford, one of the Barbados soldiers, gave his pay by will to John Miles and Thomas Workman 1671, Aug. 17, who have administration thereof granted 1674, Sept. 19. Mr. Commissary Baines has since paid the pay to one Blackborne who confesses upon oath he personated the said Radford. The administrators desire to be heard by their solicitor, Capt. Talbot, before Mr. Baines's account passes. Ibid.
William Hocknel credited William Bacon, a Barbados soldier to the value of 25l. for meat, drink, etc., for which Bacon made the said Hocknel an assignment upon his pay. Bacon has now (as is pretended) made a subsequent letter of attorney for all his pay to ensign Wilkins. Therefore Hocknel desires to be heard before the Lord Treasurer. Ibid, p. 31.

By virtue of the privy seal of 1675-6, Feb. 11, Dr. William Sancroft, Dean of St. Pauls, London, was admitted to contract with the Trustees for Fee Farms for several annual rents heretofore belonging to the Chantries in Lichfield Cathedral, and also for the rent of 5l. heretofore belonging to Henry Chantry in co. Notts ; for all which the said Sancroft paid the purchase money before Lady day last, by reason whereof he was entitled to the rents due at said feast. But in regard the deed by which said rents were conveyed to him did not bear date till May 31 last and that no direction was therein made or given for payment of the said rent to said Sancroft for the said time, as of right ought to have been, you are hereby to cause due payment to be made to said Sancroft of the said rent due at Lady day last. Dec. 10. Warrant from Treasurer Danby to Sir Thomas Morgan, Governor of Jersey, to execute an order in Council as follows.
Prefixing : Order of the King in Council dated Whitehall, 1671 [sic for 1677], Dec. 5. Upon reading this day at the Board a letter from Sir Tho. Morgan, Governor of Jersey, about his having seized the Elizabeth, of Jersey, for having transgressed the Acts of Trade and Navigation in coming to that place directly from Boston in New England : and on reading also the petition of Philip Syveret, Danll. Jauvrin, et al all his Majesty's subjects [being] the master, merchants and others calling themselves owners of said ship, begging to be heard in Council before any proceedings be had against her, the King orders said ship to be brought to London that she may be there proceeded against according to law.

Treasurer Danby to the Juistices of the Common Pleas (and the like letter to the Justices of the King's Bench). The Receivers General and Farmers of the Law Duty have informed me of the assistance you have of late given them in order to secure the collection of the said duty in your Court : which I am obliged to take notice of as an acceptable service to the King and an encouragement to the Farmers : and at their request I desire you to continue the same countenance to them for the future. Warrant from same to Thomas Newton, Woodward of Whittlewood and Salcey Forests, and to the Regarders of said forests. The Queen's Council is certified by the Lieutenant of Salcey Forest and by the Lieutenant and Regarders of Whittlewood Forest that Mad Iron coppice, in Howlet's Walk in Salcey Forest and Ashwell coppice in Wakefield Walk, Buckingham Thicket in Shorb Walk, and Black Hedges coppice in Hazleburgh Walk, in Whittlewood Forest, are fit to be cut and felled and sold this season. The Queen's Council has therefore desired my warrant for felling so many trees as are necessary for the gates, stiling, cabbening and staking of the said several coppices so to be fallen. You are hereby to fell such trees for that service only, selling the offal and accounting for same before the Auditor for co. Northampton. Ibid, p. 132.

Warrant from Treasurer Danby to the Customs Cashier to execute an order in Council as follows.
Prefixing : said order in Council dated Dec. 12 instant made in the presence of the King and 20 others detailed. This day Thomas Templeman, master of the ship Mary, now going out, attended and being called in with his counsel together with two of his employers and freighters, Mr. Lionel Craftes and Mr. Henry Rumsey, who affirming that the ship was not designed for any part of Africa to the prejudice of the Royal Africa Company, the King was pleased to order that said Crafts and Rumsey enter into bond of 500l. each not to permit or suffer said ship to touch at Guinea or any part of Africa to the prejudice of said Company, either in going or returning : and then the stop of said ship to be taken off : which the said person having done, said ship is hereby ordered to be discharged [of the stop on her].

John and Nicholas Skinner, of London, merchants, in their petition set forth that the ship Submission, of London, in her voyage from Ostend to Spain put in to the Downs for convoy and was in the late storm cast away near Deal : that they had [in her] six packs, containing each 40 pieces of Flanders stuffs which are much damaged by salt water and by lying at Deal. You are to permit said goods to be brought up to London (where petitioners are like to have the first convenience of exportation) and there to remain in petitioners' custody to be refitted and shipped out again for Spain (whither they were first intended) without paying duty in or out ; on security given to so export. Same from same to same to permit the ship Friendship, of London, Obadiah Sporne master, to pass outwards with her lading and to be cleared forthwith without making particular entries, she being laden with cordage, masts and other naval provisions to be transported to Tangier for the use of the King's ships under command of Sir John Narbrough, and if she be not presently cleared she will be in danger to lose the opportunity of a convoy now ready to sail : it being represented by the Customs Commissioners that it may be inconvenient to expose publicly a particular of the said stores by annexing the same to the cocquet. Same from same to the Commissioners, Comptroller and Auditor of Excise to give allowance and defalcation to Samuel Vincent and partners late Farmers of Excise, upon the account of their farm rent, of the sum of 115l. 10s. 0d. for the duty of 279 casks of brandy which were seized by an officer of the Customs and condemned, whereupon the King's moiety, viz., 226l. 17s. 6d. was paid into the Exchequer, and the duty which would have been paid to the said Farmers was lost ; and likewise of the sum of 36l. 10s. 0d. for money bags delivered to Mr. Kent [then Receiver and Cashier of Excise when they come to the Excise Office] with their money ; and likewise of the sum of 5l. 16s. 6d. for joiners' work done in the Excise Office. The item of 12l. 0s. 6d. demanded by said Farmers for weights and scales is not to be allowed in regard they are now willing to take them to their own use without any allowance for the same. Ibid.
Warrant of assistance from same to Benjamin Edwards, of London, gentleman, constituting and appointing him to use his utmost diligence in all the ports of England both ashore and afloat for seizing any ships or goods forfeited as by the chartered privileges of the Muscovia Company : said Edwards being appointed by said Company to be their officer for levying fines and forfeitures ; the said Company having been incorporated by Philip and Mary for the discovery of new trades with a prohibition to other the king's subjects, not of the said Company and fellowship, to trade to any of the ports and places within said Company's privileges without the express licence and consent of said Company upon pain of forfeiture and loss of ship and goods and with power to constitute an officer for levying fines and forfeitures as therein, which patent was ratified by Act of Parliament of Queen Elizabeth. Warrant from Treasurer Danby to the Customs Commissioners not to take any entry from any persons whatsoever for any goods to be either laded for or landed from any port of the East[land] country or any other place, being commodities of the growth or manufacture of the East[land] country, unless the warrant or bill of entry be first signed by some person thereto appointed under the Common Seal of the abovesaid Muscovia Company, the said Company being incorporated by patent as above, which patent was afterwards confirmed by Act of Parliament, with a prohibition that only the members of said Company should trade within its district without its licence, unless the said Company should by the space of three years in time of peace willingly withdraw and discontinue the discharging their merchandise at the road of St. Nicholas Bay in Russia or at some other ports or roads lying on that North Coast of Russia or other territories then subject to the Great Prince of Russia heretofore by the subjects of this country not commonly frequented : all by reason that the said Company complains of many interlopers intruding upon the said trade and passing goods without paying the Company's dues. Same from same to the King's Remembrancer to stay process till Easter term next against William Cooke who when sheriff of co. Gloucester in 1673 was charged with the receipt of the Hearthmoney for said county, and employed one Warner as his sub-collector and also to pass his [Cooke's] account for the same, thinking himself thereby clearly discharged, until of late process ad computandum has gone forth, and he finds he is 600l. in arrear which account Warner says is forged, but refuses to make up any other, wherefore he is obliged to put Warner's bond in suit, and therefore prays stay of process against himself till said suit is over.
