and his sureties] and the penalties therein contained
and the original debts or duties for which the same
were respectively taken and all interest and damages

and also all other bonds, specialities, books,
accompts, papers and securities whatsoever relating

sue for and recover same in the name of the King,
his heirs, etc., or in his own name and to compound

Godfrey. Treasurer Danby some time since
deposited 300l. in said Sir Edmundberry Godfrey's
hands towards making the new sewer by St. James's

directs the money to be paid to said Commissioners,
and I desire your ready complyance herewith,
Sir Edmundberry having given a note under his
hand for paying the money to this use.

Report from same to the King on the Lord
Lieutenant's report on the petition of Col. Thomas
Dungan. Said petition sets forth that Edmund
Nugent, of Culvin, in co. West Meath, Ireland,
by decree of the late Court of Claims in Ireland
in execution of the Act of Settlement has (upon
a deed of conveyance made by Jno. Nugent,
his father, of certain lands and hereditaments
mentioned in said decree and of the value of about
200l. per an. sterling limited by the said John
Nugent to several uses) been restored as an Innocent
person to a remainder in tail of the said lands
and hereditaments to him, the said Edmond, and his
heirs male with divers remainders over ; so that
by virtue of the said Act of Settlement the
remainders or reversions expectant upon the said
estate tail of the said lands and hereditaments
are and remain vested and settled in the Crown.
Petitioner Dungan is of near relation and kindred
to said Edmund Nugent and has on several occasions
loyally served the King. He therefore prays a
grant of the said reversions and remainders under
the like crown rents and services as are now
answered to the King out of the said estate. For
such grant of the said reversions "your petitioner
hath obtained the allowance and consent of the
Duchess of Cleveland, whom your Majesty was
pleased to concern in the reversions and remainders
of that nature vested in your Majesty." Said
petition being by order dated Whitehall, Aug. 15
last referred by the King "being well inclined
to show the petitioner all reasonable favour" to
the Duke of Ormonde, Lord Lieutenant of Ireland,
the latter reported thereon Oct. 25 last as follows.
I have considered same and consulted therein
Sir William Domvile, Kt., Attorney General
of Ireland, who has stated petitioner's case and
delivered his opinion thereon to me as follows,
viz., said John Nugent of Culvin was seized in his
demesne as of fee of several lands in cos. West-Meath
and Longford, and by deed of feoffment
dated 1626, Sept. 22, conveyed several lands in
the abovesaid decree mentioned to certain feoffees
(amongst other things since determined) to the use
of said Edmond Nugent, his eldest son and his
heirs male, with remainder to Walter Nugent,
second son of said John and his heirs male, and
failing that with remainders to Laurence, Robert
and Francis, younger sons of said John successively :
all which sons were declared innocent by the late
Commissioners for adjudication of the claims of
Innocents and were by decree dated 1663, July 27,
restored to their respective estates in remainder.
All the said younger brothers of said Edmond
Nugent are since dead, and said Edmond is still
living without issue male "and it doth not appear
unto me [Domvile] by the said decree but that the
reversion in fee after the particular estates ended
and determined was still in John, the father of
Edmond, and his heirs." And as said John the
father was not declared innocent, and as Edmund
the son was not restored to any other estate than
what was limited to him, said Domvile therefore
thinks the reversion in fee may be in the King's
gift, and may be by the King granted to said
Dungan. This opinion of Attorney General Domvile,
the Duke of Ormonde humbly certifies to the King.
Thereupon by order dated Nov. 14 last said
report of the Duke of Ormonde with said petition, etc.
was referred to Treasurer Danby, who thereupon
reports the present 9th inst. "I am able to certify
noe more in the case of the petticoner then has
been stated to your Majesty by his Grace the Duke
of Ormond."

Harbour Victuals. You are to assign said bills
from time to time for payment by 1,000l. a week
out of the weekly sum of 2,500l. which will be duly
paid to the Treasurer of the Navy out of the
Customs for this [abovesaid] year to begin the
1st inst.

inserting therein their claims for repairs, interest
of money and for victuals not taken off according
to contract.

Danby has directed the issue out of the Exchequer
to you of 5,000l. out of the January portion of the
Hearthmoney Contractors' advance money. You are
to issue same to Mr. Brett and partners, Victuallers
of the Navy, upon bills of imprest signed by the
Navy Commissioners and assigned for payment
out of such money as Treasurer Danby shall
appoint.
