Same for 6,756l. 17s. 2d. to John Portman to complete two years' interest on his principal debt, as by the letters patent of 1674, July 23 : it appearing by a certificate of Auditor Aldworth, bearing date the 14th inst., and by an interest accompt made up to 1674, July 1, that there is due to said Portman 47,387l. 6s. 11d. [principal money loaned to the Government] together with 12,527l. 15s. 3d. due to him upon [? assigned] orders of loan, making a total principal of 59,915l. 2s. 2d. : two years' interest whereon at 6 per cent. making the interest principal every six months amounts to 7,519l. 15s. 3d., of which 762l. 18s. 1d. was directed by warrant of Oct. 13 last, thus leaving 6,756l. 17s. 2d., "which is 63l. 5s. 7d. less than the total of the stated accompt herewith sent you, the said accompt by so much exceeding two years' interest of the whole principal debt." Clarges, Sir Robert Payton, or any two or more of the Commissioners for the late Eighteen Months' Assessment for co. Middlesex. Several sums of money assessed on officers in Middlesex and the proportion laid upon the Tower Within for said assessment are not yet collected, although you have been several times solicited in this affair without effect. Warrant from same to the Customs Commissioners for the future upon the death or removal of any Customs officer (except the Collectors) to deliver up his bonds, where no cause of forfeiture appears, or in case of such forfeiture then to deliver them up on satisfaction made. Ibid, p. 62.
Same from same to same. By letters patent of — the King has appointed that where any goods shall be seized for non-payment of Customs, the Customs whereof would not exceed 40s., the Customs Commissioners should compound such seizures, agree with the parties offending and finally acquit them. Several sums of money have been received and from time to time may be received by way of composition in pursuance of such agreement. It is hereby directed that the Receivers of London port, who ought to receive the Customs of the said goods, shall receive the moneys already paid or in future to be paid for such compositions to the use of His Majesty and shall pay same to the Cashier General [of the Customs]. The Collectors of said port and the Comptroller, Surveyor and Surveyor General there are to make entry thereof in their books of account to be transmitted from time to time into the Exchequer, "and that to the titles of the parchment books under the Exchequer seal for the said officers it be added that such books contain an account of such moneys." June 16 Treasurer Danby's subscription of a docquet, dated 1675, May, of a grant to Sir Denny Ashburnham and Sir James Edwards of several manors and lands late of Sir John Jacob, in cos. Essex, Huntingdon, Cambridge and Somerset, which have been extended for non payment of his part of the arrears of 30,000l. payable to the King by him and others, late Farmers of the Customs, and which [his said part] was afterwards paid by William Wogan, Esq., [and] William Maniston, of London, merchant, purchasers of the greatest part of the said extended [parts and] other lands of the said Jacob : to be held in trust for said Wogan and Maniston for the protection of their respective purchases until that part of the said debt payable by said Jacob be satisfied to them out of his estate and for such other purposes as the Exchequer Court shall direct. Royal warrant to the Attorney General for a great seal for a grant to John, Lord Frescheville, of the manor of Hemel Hempstead, co. Herts., and of all rents reserved or to be reserved upon my demise thereof or on any part thereof and all liberties and privileges thereto belonging for 31 years from the death of the Queen Consort (part of whose jointure it is) and at the rent of 9l. per an. : with a clause that the King's interest in the premises at the time of said Queen's death shall remain and be for the use of said Lord for said term. Royal warrant to the Attorney or Solicitor General for a great seal for a grant of the office of Surveyor General of Customs, London port, to George Smith and Francis Smith, Esqrs., in reversion after George Nicolas and Orlando Bridgeman : with the salary of 500l. per an. and all profits, &c., thereof. Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Sir Andrew King of the office of Clerk of the bills of the Customs for 31 years from the expiry of the grant thereof made to him in 1660 ; said King having heretofore furnished (by His Majesty's direction) the garrison of Pendennis with necessaries to a considerable sum, amounting (with 6 per cent. interest) to 2,560l. or thereabouts, in satisfaction whereof he prays the above extension of term. A clause to be inserted empowering said King from henceforth to print the said bills (from henceforth to the end of said term to print and publish the said bills as he or his executors, &c., shall think fit). Same to Sir Philip Lloyd. Treasurer and Receiver General of the revenue late in jointure to the Queen Mother, to pay 500l. as royal bounty to Raphaell Tartareau, Gentleman Usher of said late Queen Mother's privy chamber : he having served said Queen about 58 years and received neither wages nor pension for 19 years thereof, being thereby obliged to engage his estate in both England and France and sell his jewels to the amount of 3,000l. : the said Queen Mother having directed him three several leases, which, however, he could not obtain. Warrant from Treasurer Danby to John Birch, Auditor of Excise, to discharge Sir William Bucknell et al., late Farmers of Excise of the five counties, of the residue of 627l. 18s. 8¾d. (being their allowance of elapsed interest) on their paying 1,053l. 8s. 1d. into the Exchequer and 1,046l. 11s. 11d. to Richard Kent, Receiver General of Excise, being the sums remaining in their hands. Same from same to the King's Remembrancer to stay proceedings against Anthony Sturt, of London, Esq., on the information against him by Walter Powell, et al., about a ship's lading of wheat, said Sturt "having several things to allege in his defence which he has desired may come to a hearing before me in order to the adjustment of the matter." Ibid.
Same from same to the Customs Commissioners to discharge a parcel of Swedish iron and the vessel in which it was transported from Amsterdam, belonging to Daniell Hoare, merchant, and seized by Jeremiah Hunt, officer at Hull, on the pretence that such importation was prohibited by a clause in the Act for Navigation : it appearing from the report of the 12th inst. from the said Commissioners on the said Hoare's petition that "an information being heretofore brought in the Court of Exchequer for a parcel of Malaga wine imported from Ostend and a special verdite being found before the then Lord Chief Baron Hales it was afterwards argued by the whole court and declared that the said clause was only relative to the goods of Asia, Africa and America, and not to the goods of Europe, and judgment was thereupon given for the defendent against the information, and that you have inquired into the practice of this port [London] and find it attested by the officers as well clerks as others that iron of the product of Swedland and other countries hath been frequently imported from Holland without interruption and that you find no precedent in the port of London for the confiscation of Swedish iron or any other European commodities since the aforesaid judgment in the Exchequer." Warrant from Treasurer Danby to the King's Remembrancer to stay proceedings against Sir Robert Vyner, Henry Lewis and Richard Stratford, citizens and goldsmiths of London, on their bond of 1671, July 6, for 2,800l. to John Browne found by inquisition Jan. 27 last (extent having been awarded against Thomas Browne and said John Browne on two bonds to the King) and likewise against said Vyner, Lewis and Stratford on their bond of 1671, Nov. 24, in 900l. to Charles Goodwine, conditioned to pay 450l. within 20 days after demand, the Sheriff of Middlesex having seized said bond into the King's hands by reason that said Goodwin, William Walker and Ambros Ested are bound to the King in 14,300l., whereon extent has been issued and an inquisition taken May 12 last before Sir Nathaniell Herne and Sir John Lethulier, Sheriffs of Middlesex, whereupon the abovesaid bond of Vyner et al was found. The present stay of proceedings being due to the fact that said Vyner, Lewis and Stratford have advanced great sums to the King, which are still owing at the Exchequer, whereby they are disabled from the speedy payment of said debts. Same from same to Sir William Jones, Attorney General. I am commanded by the King to take care that no prosecutions be had on His Majesty's behalf against Thomas Whitgrave, gent., Francis Reynolds, gent., Mary Pendrell, widow, William Pendrell, George Pendrell, Humph, Pendrell, John Pendrell and Elizabeth Yates, widow (persons very instrumental in His Majesty's preservation after Worcester fight), for their recusancy. And being informed that some proceedings have been had against them in ordinary course, whereby they or some of them are in danger to be disturbed in their persons and estates, you are to wholly supersede all such process. Same from same to the Commissioners of Wine Licences to discharge William Stirke, vintner in Oxford, of his contract for a licence to retail wine in Oxford city for a term of years yet to come at 20l. per an., he finding he cannot proceed in his trade of retailing wine there without manifest ruin by reason of the great opposition he receives from the University : all out of a due regard to the University, who have made application herein, and also in view af your opinion that the continuance of the licence will not promote the consumption of wine. June 20 Warrant from Treasurer Danby to the Customs Commissioners to deliver to Monsieur Brunetts, Custom free, and without opening, several vestments, habits, scenes and other necessaries belonging to the Italian comedians and lately brought from France in the "Portsmouth" and "Ann" yachts. Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Sir Walter Wortesly (Wrotsley, Wrotesly), bart., Richard Congrave and John Gifford, Esqrs., and their heirs of the rents and particulars in the schedule below upon trust as to 100l. per an. thereof to the use of Mary Pendrell, late relict of Richard Pendrell, for her life, and after to the heirs of the body of said Richard Pendrell ; and as to 100l. per an. thereof to the use of William Pendrell and the heirs of his body ; and as to 100 marks per an. thereof to the use of John Pendrell and the heirs of his body ; and as to 100 marks per an. thereof to the use of Humphry Pendrell and the heirs of his body ; and as to 100 marks per an. thereof to the use of George Pendrell and the heirs of his body ; and as to 50l. per an. thereof to the use of Elizabeth Yates and the heirs of her body ; and as any the said persons shall happen to die without issue that person's share is to remain and come to the survivors and their heirs to share equally so long as any issue of their bodies continue : and for want of such trust then to hold for the King and his heirs. Treasurer Danby to the Earl of Bath, Lord Warden of the Stannaries. I have returned His Majesty's answer verbally to Sir John Arundell, Sir William Godolphin and others of those gentlemen who prepared the petition to the King concerning the quarterly coinings of tin. To prevent any further mistake I send it you in writing as follows, viz that His Majesty, considering it will be Xmas before any question can arise upon that matter by reason His Majesty intends not to interrupt the coinages either at Midsummer or Michaelmas, but believes they do belong to them of right, will give himself time till then to consider whether he can gratify them in their further request without prejudice to himself. I acquainted them at the same time that His Majesty was sorry they had not taken the price he had formerly offered them for their tin by way of farm (which at the time would have been of advantage to himself as well as them), but since it had been so positively refused those who had encouraged him to the bargain had otherwise disposed of their stock, besides that the price of tin was grown much lower and that for these reasons he was not now prepared to come to any agreement with them upon that matter, but that he intended to speak again with the same parties and would dispose them if he could to new offers if the price might be lower, which there seemed to be great reason for, and I am not without hopes yet of getting men to give 4l. per cent. [hundredweight] if a cheerful concurrence in the country can be found to it, without which I believe scarce any will deal for the commodity at all. Another great impediment to a present treaty was a consideration how improbable it would be to make any conclusive bargain with particular gentlemen out of the Convocation when it was not only doubted but affirmed by some of those very gentlemen that the Convocation itself could not bind the proprietors of the tin without their own consents, insomuch that I find it necessary to be well informed even on that also before the King be tied by new offers on his part when I do not see what obligation will lie on theirs after a price seemingly accepted by the tinners. Instructions from Treasurer Danby to the Customs Commissioners in reply to their presentments of the 21st inst. Thomas Lastly, one of the tidesmen in the port of Plymouth, is to be appointed surveyor of the boatmen there, with the addition of 10l. per an. to his salary. To prevent an increase of the charge of said port the salary of one of the vacant tidesmen is to be sunk. The merchants of Bristol are to be required to pay the 26l. 15s. 3d. disbursed by Mr. Tyndall in prosecuting several suits against them for importing corn without paying the full duty and in his own defence upon several suits and informations by them prosecuted against him upon that occasion, as also the charge His Majesty's Solicitor has been at in prosecuting the recovery of the said duty. Further they are to release said Tyndall from all the said suits : otherwise the stay of proceedings against the said merchants is to be superseded. You are to pursue the opinion of Sergeant Stephens touching the repayment of half duty upon the exportation of corn and fish oil. You are to appoint Mr. Clement to collect the Custom at Lynn until further orders. The prosecution of Mr. Polstead, the Collector there, is to be suspended pending enquiry as to his present undertaking to secure his [debt to His] Majesty. Those persons who have undertaken to set up a manufacture of paper in this kingdom may be permitted to import one piece of coarse woollen cloth to make others by here. Mr. Skynner, one of the Jerquers, is to be paid his salary for the part of the quarter he served. [You are to allow Mr. Arthur Upton 20l. for officiating the trusts of Deputy Collector of Penryn and of Surveyor of Falmouth. Penryn and Truro from 1671, March, to 1672, Lady Day.] As you have a prospect of using Booke Bookey in some discoveries for His Majesty's service you may discharge him out of prison upon his entering into a new judgment on His Majesty's behalf. You are to make an allowance of one third to Mr. Stanley, of Southampton, for the decayed tobacco. Report me your opinion as to the expediency of supplying the vacancy caused by the death of the Collector at Appledore or of suppressing the said office. Col. Molesworth is to be directed to pay Mr. Mounteney the money arising by the sale of such Plantation goods as are returned in lieu of the duty payable in the Plantations. Mr. Mounteney is to keep distinct accompts of such receipts. [Sir Sackvill Crow is to be repaid the money by him paid at Milford Haven for the Customs of wreck wines, unless he be content to make an allowance thereout towards the officers' charge. You are to prosecute Mr. George Pley, Collector of Weymouth, for the debt owing by him to the King.] As to the case of Mr. Wright I have appointed that the Attorney General be attended therein.
