Same to the Attorney General of the petition of John Apletree, Esq., shewing that in December last he petitioned for a grant of the Water Bailiff of the river Severn for 31 years at the same rent and fine as was granted to Sir Thomas Monins, bart.: that the Surveyor General has thereon reported that a fine of 3,000l. and rent of 10l. per an. may be reasonable consideration: but the petitioner finds that the fishery of the said river is almost destroyed: therefore prays a grant without a fine, at the ancient rent of 10l. per an. Prefixing: report by H. Cholmley on said Huggins' petition. The ground is a small piece taken out of the waste of the manor of Hampton, Co. Middlesex, on the south side of the road leading from Kensington to Hampton Court and abuts north on said road and on buildings belonging to said Huggins, west on a green house or arbour in his Majesty's gardens, south on the said gardens and east on the House Park or Home Park and is 145 feet by 133 feet and worth 20s. per an. Royal letters patent dated Kensington appointing Charles Burniston, Esq., to be Surveyor General of Woods in America “of all and singular our woods within all and every our Colonies and Plantations on the Continent of America now growing or being or which hereafter shall or may grow and be within our said Colonies or Plantations”: with the salary of 200l. per an.: to be paid by the Treasurer of the Navy on bills to be made forth by the Navy Commissioners: all in place of John Bridger, Esq., whose commission for the same is hereby superseded and determined. And the said Burniston is hereby directed to instruct all our subjects in the said Colonies and Plantations in making pitch and tar, raising and curing of hemp and in all other matters relating to the production and manufacturing of naval stores there. To hold during pleasure and to execute the said office by himself or sufficient Deputy or Deputies. And he or his Deputies are hereby required at all convenient times and seasons in the year to view and survey all our said woods and timber and also to mark such of the said trees that now are or hereafter shall be fit to be taken for the use of our Navy and to keep a Register of the same; transmitting half yearly an account of his proceedings herein to the Admiralty Commissioners, to one of the Secretaries of State, to the Treasury Lords and the Commissioners of Trade and Plantations: and further to observe and follow all such orders and directions “as we have or shall sign in this behalf” or as he shall receive from the Admiralty, Treasury, or Plantations Commissioners or either of the Principal Secretaries of State. And all Governors, Lieut. Governors, Justices of the Peace, Constables and all other Civil Officers in the said Colonies and Plantations are to assist, promote and encourage the said Burniston or his Deputies in due execution of their duty: the King reposing special trust in the skill and integrity of the said Burniston in directing and instructing the inhabitants of New England and other Colonies and Plantations in America in the best methods of making tar, raising and curing hemp and producing and working all other naval stores “and for preserving the woods from spoil and for rendering the several Acts of Parliament relating thereto more effectual.” King's Warrant Book XXIX, pp. 170–1. |

Same to the Barons of the Exchequer in Scotland of the petition of John Leigh of Whitehaugh shewing that his predecessors have been tenants these many years to the Bishop of Aberdeen and his redendo is for the most part Customs which after the Act of Restraint were converted to nigh three times the prices that his predecessors paid: therefore prays an order to the Exchequer [in Scotland] to exact no more but the old fee Duty, which will amount to about 10l. sterling yearly, “as also him and his heirs to present a minister for the church of Tillenssel when vacant during the vacancy of Bishops [of Aberdeen], the parish being but small and he paying four fifths of the stipend.” Out Letters (North Britain) IV, p. 331. |

Letter of direction in the form of a letter from C. Stanhope to the Auditor of the Receipt. The Treasury Lords desire that (out of loans in the Receipt on credit of the Land Tax anno 1718 you issue 34,564l. 8s. 0d. to Henry, Earl of Lincoln, on the unsatisfied order in his name as Paymaster General of the Forces: and is intended to be applied for Half Pay upon account for half a year to 1718 June 24 to such Officers as are found qualified by the present examination of the Commissioners and General Officers appointed for that purpose: and is to be esteemed as part of the 94,000l. granted [by Parliament] to his Majesty for Half Pay for the year 1718 upon account to the reduced Officers of his Majesty's Land Forces and Marines. C. Stanhope to Anthony Cracherode [Treasury Solicitor]. My Lords direct you to take care that the following suit be defended by you at his Majesty's charge.
Prefixing: Memorial from Lord Cobham, Constable of Windsor Castle and Warden of the [Windsor] Forest, shewing that two several actions at law have been commenced this term against Baptist Nun, one at the suit of Mr. Saint John, the other at that of Mr. Waterman, for having taken away some guns and nets and other instruments for the destruction of game within the said Forest. “What was done by the said Nun and Webb was done by virtue of my warrants as Warden of the Forest in support of his Majesty's right which I have very good grounds to believe is unquestionable in this case. Wherefore I pray your Lordships' order to your Solicitor to defray the charges of defending the said suits.” Out Letters (General) XXII, p. 308.
