Same to John, Duke of Marlborough, General of the Ordnance, and Thomas Micklethwaite, Lieutenant General of the Ordnance, and the rest of the Principal Officers of the Board of Ordnance, to make allowance of the sum of 1,584l. 12s. 0d. to John Jefferys, Esq., in making up his account as Paymaster of the Train of Artillery in Spain for the space of five years during the late war there: to make good so much lost at the battle of Villa Viciosa in 1710: he having discharged his trust with diligence and fidelity and produced regular vouchers in maintenance of every the articles of the said accounts except for the said sum: and it appearing by the examinations taken at the said Board of Ordnance and affidavits and testimonials hereunto annexed (laid before the King by the Treasury Lords) that he has produced as sufficient proof for the allowance of the said sum as can be expected from the nature and circumstances of the case.
Appending: (1) certificate to the Lord Treasurer dated 11 May 1714, signed by William Bridges, D. Windsor, C. Musgrave and R. King, that Jeffery's chest with the money and all his accounts and receipts were then taken by the enemy. He has produced regular vouchers for all moneys he has received from us amounting to 49,985l. 17s. 1½d.
(2) said Jefferys' memorial shewing that after the battle of Saragoca he received orders to go with the rest of the Paymasters for Barcelona to procure money for the Train and accordingly did set out from Saragoca the 26th August 1710 and left with Mr. William Lewis, his assistant, in money and notes the sum of 6,422 dollars 3 Rp. 6 Chs.: that there was afterwards remitted and received by the said Lewis more 5,995 dollars 7 Rp. 19 Ch., which with 650 dollars, part of a larger sum sent up by Lieut. Col. Hay left with Mr. Scott for the wounded and others at Saragoca, amounts in the whole to 13,068 dollars 19 Chs.:
that Mr. Lewis did take with him for the march from Saragoca into Castile the abovementioned money in a small box only, the great iron chest with its tumbril and all my papers and accounts being left by order at Saragoca and “where” [were] afterwards for their greater security removed with the English Hospital to Calatayud, where after the battle of Villa Viciosa they were lost with the said Hospital, as appears by the certificates marked Nos. 1 and 2.
And all the accounts and receipts for payments made by Mr. Lewis being lost at the said battle on the 29 Nov. 1710 with the whole artillery baggage and likewise the moneys then remaining in cash (as appears by the affidavits marked Nos. 3 and 4 and may also be further attested), there were no endeavours wanting afterwards to have recovered any part of the said accounts from the enemy, but to no other useful purpose than the getting the paper marked No. 5 brought back by Mr. Miller, Surgeon, and Mr. Seys, Apothecary to the Hospital, being a state of receipts and payments made between 25 Feb. and 18 June 1710 and the remains of cash at that time. This, though a help, could not be sufficient for stating the accounts, the greatest part of the Train being killed or prisoners (and amongst the killed the Comptroller and Commissary) till the exchange of several of the Officers and others and receipt of those accounts that were sent me back from England.
The paper No. 6 is an account of the receipts and payments commencing from the 18th June to the time of the battle, collected from what papers could be got or what payments could be (from the best information) remembered to have been made, and are placed to account which shows the whole sum lost amounting to 6,672 dollars.
For the better explanation of the loss sustained it may be necessary to inform your Honours (1) that the Paymaster's Assistant always did and does declare that to the best of his knowledge there was lost in his chest at the battle in specie above 1,000l. as per his affidavit No. 7 computed at about 4,300 dollars: (2) that of 650 dollars sent by the Comptroller for the detachment at Toledo there was but 104 dollars accounted for, leaving 546 dollars unaccounted for: (3) that there were other detachments at Aranjuez, Siguenza, Calatayud &c. for which there is no accounts: (4) of moneys paid at several times to the Commissary and Conductors on account there was (from papers &c.) nearly 600 dollars found to have been paid and not charged: (5) there was 60 moydores paid one of the contractors for mule hire, not brought to any account, making 390 dollars: (6) all receipts for subsistence for the preceding part of the year and of Contingencies from our taking the field, being all lost it is humbly submitted there could not be any other means for making up these several accounts than from the informations and examinations of the Officers and others living (who have been all satisfied): it may be reasonably presumed that there hath been more paid than is really charged: and the whole difference being but about 800 dollars I hope the foregoing account for so many years may plead for your Honours' favourable construction as to my behaviour. (The above statement was sworn 4 May 1714 before R. Doyley.)
Followed by: Exhibit No. 1 and 2 certificate dated 1711 Feb. 28 by Vin. Chabane, director, Rowland Seys, apothecary, and Richard Miller, surgeon, that the said Jeffreys, Paymaster to his Majesty's Train of Artillery, upon his being ordered from Zaragoca to Barcelona (to procure moneys for the service of the said Train) left his baggage with Col. Borgard at Zaragoca, who going from thence in October to join the Army then near Madrid left to “my” care the said baggage: and some time after, receiving orders to remove the Hospital from thence to Catalayud “I” likewise sent the baggage there too, among which “I” do hereby certify that there was an iron chest and other small boxes with divers papers and accounts relating to the said Train and that not having time to get them from thence before the enemy came, they with the rest of his baggage were taken with that of many others.
Exhibit No. 3: certificate by Joseph Burton (sworn before R. Doyley 27 April 1714) that at the battle of Villa Viciosa in Spain 29 Nov. 1710 the enemy having possessed themselves of our guns, stores &c. I by direction from Col. Richards endeavoured to bring of [off] the moneys in cash belonging to the Paymaster of the Train, he being at that time at Barcelona, and pursuant thereto [I] had broke open the chest wherein the said money was and found therein one large bag of gold, which was Portuguese moydores, as also another bag put within the said large bag in which were pistoles. I can't judge of the number or quantity of either species, but it must be considerable, finding it so weighty that I could hardly lift it out with my right hand. There was also a bag with silver: which bags, while I was endeavouring to carry off, some of the enemy's Horse came upon me, took it from me, stripped me and made me prisoner.
Exhibit No. 4: certificate by David Dalman, sworn before R. Doyly 27 April 1714, that at the said battle of Villa Viciosa he did by directions of Col. Richards stay with [the abovesaid] Joseph Burton, Waggon Master, to help bring off the money in cash: and pursuant thereto the money chest was broke open and delivered to the said Mr. Burton, being a large bag of gold as Mr. Burton then said to me to be so and that it was very heavy, also a lesser bag of silver: both of which he was endeavouring to carry off, but immediately some of the enemy's Horse being told by some of the drivers that I had the money fell upon me and stuck me twice in the body and cut me over the head: but they finding Mr. Burton had the money took it from him and took both him and me prisoners.

Treasury warrant to Anthony Cracherode [as Treasury Solicitor] to pay 50l. to Thomas Lister of St. Leonard, Shoreditch, shoemaker: 30l. thereof for his charges and 20l. for reward for serving the Government partly in prosecuting Thomas Brooks, constable, John Elliott, dyer, John Milton, dyer, and William Taylor, victualler, all of St. Leonards, Shoreditch: he having shewn by his petition that he exerted himself in opposition to a great many of his neighbours who had upon all occasions endeavoured to shew their disaffection to his Majesty and having on several nights of public rejoicing, particularly on his Majesty's birth night and the night of his Majesty's happy accession, illuminated his windows and put out a sort of triumphal arch with several mottoes expressing his duty and affection to his Majesty, his house was beset by a numerous assembly in a riotous manner, crying out, “None but the true born King,” “No run-away Lord Mayor,” “No cheating Marlborough,” “High Church and Ormond,” “Down with the Whigs' House,” and who not only broke his windows and defaced his house, but would have also pulled it down and murdered the petitioner if they had not been prevented by the great care and industry of Henry Barnes, head borough of the said parish: one of which rioters, viz. the abovesaid William Taylor, was since fined 20l., and two others, viz. the abovesaid Milton and Brooks, found guilty, which prosecutions have had the good effect to suppress such riotous attempts in those parts: but petitioner having suffered by several subsequent riotous assaults and robberies merely on account of his loyalty and by the malice of his landlord and disaffected neighbours hath been warned out of his house unless he pays double the rent he paid before and also several times arrested and cast into prison:

By Treasury warrant of 3 Sept. 1716 I was appointed to perform works begun but not finished by Mr. Hewett where he had raised no money by wood sales, and I accordingly raised money and finished what was left undone to the dog kennel and at Lowens Lodge in Windsor Forest, but not being able to obtain from Mr. Hewett's agent an account of what work he had done until some time after the money was raised I found upon casting up his bill with mine that there was an exceeding of 60l. more than by warrant was allowed. Colonel Negus certifies that the work there done was entirely for the service of his Majesty's horses and staghounds.

Treasury reference to the Barons of the Exchequer in Scotland of the petition of James, Earl of Finlater, and Lord Deskford, his son, shewing that Sir Patrick Ogilvie of Boynd and James Ogilvie the younger, of Boynd, his son, contracted debts exceeding the value of their estate and their creditors pursued a sale thereof and the said Earl of Finlater was purchaser and has now the right thereto by decree of the Lords of Session and is in peaceable possession thereof and has the benefit of redemption of some lands mortgaged before the said sale: that James Ogilvie vested same in several of his creditors for above 1,000l. without consent of the King, who is superior; whereby the lands are recognised to his Majesty: therefore petitioner prays the gift of Recognition of the said lands on the Lord Deskford on giving bond to pay the creditors who are vested therein.
