William Breton's Regiment to Xmas last notwithstanding his non
compliance with the royal instructions dated 1704 April 28 to the
Comptrollers of Army Accounts (to wit relative to clothing, to the
effect that the General of the Forces having approved and sealed
the patterns for clothing, the Colonels are to contract for such clothing
and to exhibit their contracts to the said Comptrollers and that when
said Comptrollers are satisfied that the contracts have been performed
according to the patterns, they shall certify to that effect to the
Paymaster of the Forces ; without which certificate the said Paymaster
is not to comply with any assignment [of offreckonings] for
payment thereof) : all by reason that said Breton contracted in
April last with Henry Stapleton for a whole clothing and a half
clothing for his Regiment amounting to 3993l. 17s. 7d. but the
General being at that time gone to Flanders he could not pursue
the regular steps directed by the abovesaid instructions, so that the
Comptrollers have not seen the clothing whereby they might certify

Prefixing : (a) order of the Queen in Council dated Kensington
Feb. 21 last. By the Act of Parliament of 1699 [10 Wm. III. c. 14]
for encouragement of the trade and fishery of Newfoundland it is
enacted that each of the Fishing Admirals shall yearly keep a journal
of the number of all ships, boats, stages and train fatts and all seamen
belonging to and employed in each of their respective harbours and
to return a copy thereof to the Privy Council. For many years the
due execution thereof has been omitted. All masters of ships this
season going from London to the fishery of Newfoundland are to be

Joseph Walker shewing that on 25th Jan. 1701-2 a Hamburgh ship
was driven on shore near Wallasey co. Chester and broken to pieces,
laden with bales of linen cloth, some of which petitioner took out of
the water ; that afterwards an affray happening with one Thomas
Houghton, a Customs officer at Liverpool, petitioner was condemned
and committed to Chester gaol where he still is, his wife and five
children having nothing to subsist on but the people's charity and
