Auditor of the Receipt to apply the surplus at June 24 last of 9852l.
0s. 6¾d. (arising from the 9d. per barrel granted by 4 Wm. and Mary
c. 3 for annuities) towards satisfaction of the orders of loan as they
now stand registered on the Act of 1 Anne c. 6 granting several
Subsidies for the war against France : "Sir Edward Northey, her
Majesty's Attorney General having given his opinion in writing that
the said surplus is to be computed on the 24th day of June yearly
and not on the 25th of January."
Appending : said opinion of the Attorney General
"4 Wm. and Mary page 207 grants 9d. per barrel Excise for
99 years from 25 Jan. 1692-3 : all the weekly payments on
this branch [of the revenue] shall be a yearly fund page 215 :
out of which 100,000l. yearly till June 24,1700 and 70,000l.
yearly from that time shall be divided amongst contributors
for one, two or three lives by half yearly payments on 24 Dec.
and 24 June : the first payments on 24 Dec. 1693 with survivorship
till but 7 are living : if 1,000,000l. is not advanced
by 1 May 1693 the actual contributors to receive proportionably
viz. 10 per cent. for the first 7 years and 7 per cent.
afterwards pp. 217-221 ; a discount of 10 per cent. per an.
for prompt payment p. 221 ; if 1,000,000l. be not advanced
before 24 June 1703 the King and Queen may borrow the
complement : if 1,000,000l. be not advanced before 1 May
1693 any persons may purchase annuities after the rate of
14 per cent. per an. for single lives to commence from the
29th Sept. 1693 payable quarterly p. 234 with a discount
at 10 per cent. per an. ; if any purchaser on survivorship
shall before 29 Sept. 1693 desire to have an estate for life
at 14 per cent. it may be converted p. 237 ; if there be a
surplus at the end of any year of the said 99 years after all
annuities are discharged, such surplus shall be to the use of
their Majesties, their heirs and successors p. 238 ; all grants
and dispositions of the money of this Act by their Majesties
in any manner or for longer term than by this Act appointed
are void p. 239.
Query : whether the year for computing the surplus is to end
on 25th January or 24th June.
I am of opinion the year for computing the surplus is to end
on the 24th day of June and not on the 25th day of January.
The words are at the end of any year during the term of
99 years and not at the end of any year of the 99 years ;
and the surplus being to be paid as shall remain at the end
of a year after the yearly payments shows plainly the
Parliament intended to have the surplus computed at such
time when the year ended and the annual payments that
were first to be discharged became due, which is 24 June.

The Lord Treasurer will endorse the said tallies &c. for said interest

Lord Treasurer is informed of great irregularities committed by
Commanders of her Majesty's ships in disposing at their own pleasure
of such prizes as they take in America. He desires special
instructions to be given to the Commanders bound to America that
they do not dispose at their own will of any prizes they shall take but
submit themselves to the Courts of Admiralty there and to the Agents
employed under the Principal Commissioners for Prizes and in cases
of dispute or wrong supposed to be done them to apply to the
Governor of such Island or Plantation where the prizes shall be
brought in, and in default of redress they may appeal to her Majesty.
Further, that directions be given to the officers of the Courts of
Admiralty in America that they be very careful of her Majesty's
interest in relation to prizes and do not unduly dispose of any ships

William Lowndes [to the Auditor of the Receipt]. A case as follows
has been stated for the Attorney General's opinion viz. whether the
remainder of the 6000l. repaid into the Exchequer by [Mr. Povey] the
late Treasurer for Sick and Wounded Seamen (after so much is reserved
as will discharge all claims that can justly be made [appear as] debts
due to Sick and Wounded in the late war to which the said 6000l. was
applicable) may not be applied to the service of the Sick and
Wounded during the present war, such reservation being made as in
the query. "He has given his opinion that it may be so applied.
Please issue the said sum to the Navy Treasurer for Sick and
Wounded either in the late or present war as the Lord Treasurer

the Comptrollers of the Accounts of the Army, relating to offreckonings
due to Alexander Stewart and Benjamin Taylor for clothing the

1701-2. Please satisfy the remaining 14 months' offreckonings to
them on their producing to you their contracts and agreements
entitling them to the said offreckonings.

[English Troops in] Portugal, for which the Officers pray levy money

accounts of the Regiment may be stated and cleared and the Captains

royal warrant for payment of 50l. to Lieut. Cha. Congreve out of

Report by same to the Queen on the petition of Capt. John Henley
of Brigadier Holt's Regiment of Marines, shewing that he was at
the taking of Gibraltar, lost his right arm there and received another
wound in his right side by a cannon shot. Although by the present
Rules of the Navy there is no allowance to Marine Officers who lose
their limbs in service "because as I humbly conceive when those
Rules were made there were no Marines employed in the Fleet" yet
I think it reasonable to allow him a year's full pay in like manner
as is allowed to sea Officers on like occasions. "And I am further
humbly of opinion it may be for your Majesty's service if the Rules
of the Navy be made for the future to extend to Officers of Marines

warrant of May 12 last to the Master of the Great Wardrobe for the
cleaning and mending of eight pieces of fine landscape hangings called
Queen Mother [sic], 4 pieces of Cleopatra, one piece of Sampson and
2 pieces of gardens and fountains : all to be bordered with canvas :
likewise for cleaning and mending a green velvet carpet for the
Council Chamber at St. James's and for mending the 4 bed cups
that belong to her Majesty's new travelling damask bed, and 2 folding
chairs, and to fit up her new travelling bed at Newmarket : to a total

Warrant by same to Henry St. John to prepare a royal warrant
for taking off the respit on Major Robert Parsons' Company in Lord
Lucas's Regiment from 1703, 25 June to Dec. 24 which was occasioned
by Lord Lucas's order to turn out all men that were not 5 feet 6 inches
high and to list none that were under 5 feet 7 inches high but the
Garrison being weak at that time the Governor did not think fit to
discharge them before taller men were got to supply their places, so
that Major Parsons was obliged to pay them.

their report on Capt. Gardner's petition (relating to the muster rolls

Park on part of the ground heretofore used for a common highway,
leading from Charing Cross to St. James's Palace ; 230 feet in length
from the place where a gate formerly was near the said wall towards
the said palace on the west unto the place where a certain passage
called the Welsh Exchange sometime was ; and 62 feet broad from the
Park wall on the south to the wall built on the north of the aforesaid
way.
(2) The piece or parcel of ground heretofore part of the said old
highway under St. James's Park wall and now enclosed within the
wall of the Garden belonging to Warwick House, being 20 feet in
breadth and 40 feet in depth.

Report dated Whitehall to the Lord Treasurer from William
Blathwayt as Auditor General of the Plantations on the petition of
John Yeamans, Lieutenant Governor of Antigua, one of the Leeward
Islands. Petitioner prays a privy seal for his salary of 200l. per an.
By order in Council of 10 April 1703 the Queen appointed the salary
of 200l. per an. to each of the Lieutenant Governors of those Islands ;
to be paid out of the Four and a Half per cent. Duty there ; as is
particularly set forth in a late report on a like petition from Col.
Walter Hamilton, Lieutenant Governor of St. Christopher. It is
certified by the clerks of the Council and Assembly of that island
[Antigua] that the petitioner has not at any time since the date of his
commission taken or received any manner of present or gift of any
kind whatsoever either from the Council or Assembly according to
his [her] Majesty's Declaration in that behalf. I conceive he is
well entitled to the said salary from 10 April 1703 the date of the
said order in Council and that a privy seal may pass for the, said
yearly salary during his continuance in that command.
