Prefixing: (a) Order of the Queen in Council, dated Whitehall, Sept. 28 last, adding the word “corn” to the Order in Council of 1691, Aug. 27, which directed that the Customs Commissioners should do all that in them lies to hinder foreigners from carrying to their Majesties' enemies coals, lead, copper, naval stores or any contraband goods and to that end to cause all foreigners with two sufficient sureties to enter into bond under condition as expressed in said Order.

I have read to my Lords the Admiralty Lords' letter of the 30th ult. concerning the Talbot ketch, which was sometime since taken by the enemy and lately re-taken by their Majesties' ship St. Albans, wherein they desire that she may be bought for their Majesties' service. Appending: (a) letter to the Treasury Lords from Col. B. Fletcher, Governor of New York, dated Fort William Henry in New York 15 Aug. last. Pursuant to your commands I did consider of a method of supplying the Land and Sea Forces in the West Indies and am sorry my endeavours that way are lost. I fear the consequence of the Fleet being at Boston and not proceeding to “Canida” (when heard by our Indians) will be the loss of them. The Governor of Canida doth court them very much. If we lose them Virginia and Maryland must live in garrison or fly the country. I did also appoint a Committee of the Council [here] to consider of the production of hemp, tar, pitch and rosin in this Province. They reported that there is produced here tar at 12s. per barrel containing 31 gallons; flax at 6d. per pound; hemp at 4d. per pound; no rozin made here. The quantities yet small, but the soil agreeable for such improvement.

Prefixing: (a) like Order in Council, dated Sept. 28 last, granting permission for the like number of seamen to go to the Plantations in America as were allowed for those trades in 1690, including [in that number the crews of] such ships as have been permitted to go out since June 1 last (“an account whereof [missing] is hereunto annexed, containing 61 ships and 637 men”): and the ships allowed to go to Barbados, the Leeward Isles and Jamaica are to be ready to sail by Nov. 1 next. And further that the ships allowed to go upon the trades above mentioned be obliged to give the usual bonds to go and return with their convoys in case the same be required of them. The Customs Commissioners are to distribute what ships and men shall be allowed to each of the Plantations and how the numbers shall be apportioned among the merchants in the ports; and to settle the proportion between London and the outports: and to send an account of their proceedings to the Committee of Trade and Plantations.
Oct. 4. Royal warrant, under the Queen's sign manual, to the Lords Justices, Ireland, for a patent to grant and annex for ever to the Office of Auditor General, Ireland, the house lately belonging to Terence Dermot on Ormond's Quay in the city of Dublin, as in place and stead of the other house standing on said Quay and lately belonging to Luke Hoar: to be for the safe keeping of the records belonging to said Office: all by reason that the King's sign manual of 1692, Nov. 14, did direct (on the petition of Charles Dering, Auditor General of Ireland) that said Hoar's house should be so annexed as above: but said Dering has since represented that Hoar's house is encumbered with a mortgage to Col. Fitzpatrick, whereas Dermot's house is already in Dering's possession by a custodiam. Out Letters (Ireland) VI, pp. 353–4.

Oct. 6. Royal warrant, under the Queen's sign manual, to the Attorney or Solicitor General for a great seal for a discharge to Sir Samuell Dashwood et al. as follows. Between the 1st Aug., 1692, and the 13th July, 1693, John Ward, gent. [searcher], seized at Ratcliff in Middlesex or elsewhere in London port a parcel of raw silk of the goods of Sir Samuel Dashwood, Sir Stephen Evance, Sir Henry Furnese and Francis Dashwood, all of London, merchants, and Thomas Pennyman of London, gent., for being commodities of the growth of Asia, Africa or America, but imported from Amsterdam, and same were appraised at 680l. 16s. 0d. and likewise between 1st Sept., 1692, and the 15th Aug., 1693, the said Ward and Henry Langford seized other raw silk belonging to the said merchants to the appraised value of 1,968l. 10s. 0d.: and similarly said Ward, Langley and Isaac Manley between 1 Sept., 1692, and 28 Aug., 1693, seized other like silk belonging to the said merchants to the appraised value of 12,609l. 11s. 0d.: the Crown hereby releases its moiety of the said seizures to the said merchants. Same to Edward Ward, esq., Attorney General, to enter a noli prosequi to the information in the abovesaid seizure cases on production of a certificate that the said seizers are satisfied of their part therein. Ibid, p. 249.
Money warrant for 1,220l. 16s. 9d. to Sir Leonard Robinson in full of all his charges and in reward for the pains, attendance and hazard of himself, his agents and clerks in receiving from the Exchequer and repaying several sums amounting to 360,835l. for principal and interest to divers citizens of London and others for the loans by them made on the Million Act and for keeping distinct accounts with the lenders of the said moneys. The like for so many ships to sail to Madeiras and the West Indies as shall be sailed by 120 English seamen.
Treasury reference to the Navy Commissioners of the petition of William Beckford, esq., praying payment of some part of the money due to him for slop clothes furnished by him for the Navy: there being 20,000l. due to him and the service for the next Spring will amount to at least 12,000l. Reference Book VII, p. 8.
The Treasury Lords to the Commissioners of Accounts [Ireland]. By several letters we have informed you that the King has directed the clearing to 1692, April 1, of those Regiments that served in Ireland and were removed to England and Flanders and that the Paymasters [of the Forces, Ireland] cannot proceed therein till the debts due to the country [people] from said Regiments be adjusted. Among these is Col. John Coy's Regiment, who has sent his Major to Ireland for that purpose. We desire you to close with said Major the accounts of said Regiment with all speed and similarly for the like accounts for the rest of the Regiments that have not [been] examined with you. Transmit the same hither with the vouchers as soon as finished. Ibid, VI, p. 347.
Henry Guy to the Revenue Commissioners, Ireland, enclosing a letter [missing] from the Earl of Nottingham concerning a prize ship of 30 guns brought into Kinsale by the Dover frigate. My Lords desire you to buy the said prize for their Majesties' service pursuant to the Queen's pleasure, as in said letter. Ibid, p. 349.

In reference to mine of May 17, last, supra, p. 206, concerning the quit rents of 5,000l. per an. in Ireland, upon which the Countess of Dorchester and Sir Stephen Fox made several claims, application is made to my Lords that this matter should be no longer delayed. You are to give directions for the payment of said quit rents according to such orders as you have or shall receive from the Exchequer Court, before the end of Michaelmas next, without expecting any further directions from hence. The Treasury Lords to the Lords Justices, Ireland, to report on the enclosed petition [missing] from Henry, Earl of Drogheda, referred to us from the Queen, concerning some houses he is in possession of for a debt coming to him by Ignatius Pippard and Christopher his son. Ibid.
Henry Guy to the Revenue Commissioners to report on the enclosed petition [missing] of Elizabeth. Countess Dowager of Castlehaven, praying to be paid some quit rents due at Michaelmas, 1692, and Easter, 1693, which belonged to her, but were paid into the Treasury in Ireland. Treasury order to the Customs Commissioners to order payment of the salary bill of the outports for last Michaelmas quarter: being of 5,390l. 2s. 0d. for established salaries and 560l. 15s. 0d. for additional salaries: or 5,950l. 17s. 0d. in all. Ibid.

Treasury warrant to the Commissioners for Excise and Arrears of Hearthmoney to pay 50l. to Richard Cocks, one of the Receivers General of the late revenue of Hearthmoney, for four years before that revenue was taken away, said payment to be for the quarter ended 1690, June 24, he having been paid only to 1689, Lady day, but having continued to act in getting in the arrears thereof and in making up the accounts with his officers till after 1690, June 24, including the recovery of a desperate debt of 110l. 6s. 0d. from one of the sub-collectors. Preston's agents turning their Majesties' tenants out of their estates. We enclose copies thereof. It is the Queen's pleasure that unless these people have quiet possession she will order Lady Preston's pension to be stopped. Ibid.

Gathin, apprehended Francis Dormorant and William Cannon for publishing scandalous libels, for which said Brown and Gathin have obtained an order for 50l.; therefore praying that said order may be stopped till they have their share. Oct. 10. Royal warrant, under the Queen's sign manual, to the Attorney or Solicitor General for a great seal for a discharge to the East India Company as follows. By the charter of 1661, April 3, for incorporating said Company the trade to the East Indies was restricted to said Company or persons licensed by them under penalty of forfeiture of goods and ship of intruders, one half of such forfeitures to be to the Crown, the other half to the said Company. Further the Company was therein empowered to send ships of war etc. to any their factories, with power to make peace or war with any Prince or people not being Christians. By the charter of 1683, Aug. 9, Charles II granted the Company the right of visiting and seizing ships etc. intruding etc. as above, with reservation to the Crown, as before, of a moiety of the forfeitures thereunder. By a great seal of 1686, April 12, James II ratified said charters. And divers persons having traded contrary to the said charters and to bye-laws founded thereon, have made forfeitures, and fines thereby have accrued both in England and in the East Indies. Further, “we are informed that” by several commissions or reputed commissions James II authorised the following Captains or Commanders to assist the said Company in the making of war against the then Mogul of Hindustan, the Nabob of Decca and the King of Siam or some other Princes or heathen people of the East Indies, viz. Samuell Lake of the Prudent Mary; Antho. And in 1690, Easter term, a bill was exhibited in the Exchequer by Sir George Treby, Attorney General, at the relation of Walter Whitfeild, esq., John Earle and Thomas Kilner, gent., against said Company and against Sir Josiah Child and Sir Benj. Bathurst, members thereof, for an account and recovery of said tenth of prizes; to which bill several answers were put in. And in 1692, Michaelmas term, said Court decreed that said Company should pay 7,940l. 1s. 9d. to the Crown for said tenth part of the prize goods imported in the two ships Charles the Second and the New London, and divers other orders have been made concerning the goods and ships taken in said war for which the cause is still depending in said Court. And further in Easter term last a bill was similarly exhibited by Edward Ward, esq., Attorney General, against said Company and against Sir Edward Des Bovery, Sir John Moore, Nath. Tench and John Goodyear to discover forfeitures taken since 1680, July, for interloping. In consideration of the sum of 16,638l. 6s. 11d. paid into the Receipt by said Company before the date hereof and in consideration of the release to the Crown of 1,361l. 13s. 1d. which had been brought into Court, the Crown acquits and exonerates from the abovesaid moiety of forfeitures and tenth of prizes and from said 7,940l. 1s. 9d. the said Company and all the defendants as above and all the ships' commanders as above, and also Bartho. Oct. 12. Royal warrant, under the Queen's sign manual, to the Lords Justices, Ireland, for a patent to pass the great seal of Ireland for granting to Francis, Archbishop of Dublin, and his successors in said bishopric for ever, the premises as follows under the quit rent of 9l. 2s.d.: to date from the date of the custodiam as follows and to be to complete the augmentation intended by the Acts as follows for the said bishopric. All by reason that Francis. Archbishop of Dublin, has petitioned shewing that by the Acts of Settlement and Explanation so much of the forfeited lands as were anciently the inheritance of the See of Dublin but were granted in fee farm by the Archbishops thereof to the then forfeiting persons were appointed to be set out in augmentation to said See to the amount of 2,000l. per an. pursuant whereto the Commissioners for Executing said Acts did set out several lands. part whereof (viz. the lands of Sea Town, New Town, Blackhall, Gamwell, Smith's lands and several others in and about the town of Swords to the amount of 437 acres in the barony of Nethercross, co. Dublin, being the former property of Christopher Russell, whose son Bartholomew Russell, being declared innocent by said Commissioners, was left to recover his right by law in remainder after his father's death), were not passed in the patent with the other lands, but were by order of the said Commissioners granted to the then Archbishop in custodiam at 15l. per an. rent until said Bartholomew Russell's pretence should be determined: and though said Christopher Russell died in 1682, yet Bartholomew never brought his pretence to trial till 1688, when the Earl of Tyrconnell was Chief Governor of Ireland and Popish Judges sat on the Bench, who gave judgment in his favour, though John Osborne, then Prime Serjeant, and Sir John Temple, Solicitor General, gave opinions adverse to his claim: whereby said Russell obtained possession and so remained till the reduction of Ireland to William III, when he was in actual rebellion against said King, for which he stands outlawed, and did die in actual rebellion: whereupon the premises were seized by the Revenue Commissioners, Ireland: and the Archbishop, petitioner herein, applied to the late Lord Lieutenant and Council for a grant thereof in accordance with the intentions of said Acts, and did by judgment of the Exchequer Court, Ireland, obtain a custodiam thereof from Sept. 29 last [1692] at the improved rent (100l. per an.) they are now let at, pending further royal pleasure: wherefore said Archbishop did petition for a grant of the premises at 15l. per an. rent. Which petition being referred to Sir Richard Levings, Solicitor General of Ireland, confirming and amplifying the facts as above and stating that the said See of Dublin remains 285l. per an. short of the 20,000l. augmentation designed as above; that the custodiam was granted to said See in Hilary term, 1664, and remained in it till 1686. May 4: that Bartholomew Russell filed his plea in the Exchequer in 1682, setting forth that Bartholomew his grandfather. on the marriage of Cisley Meara with Christopher his son, settled part thereof on them; that said grandfather died in 1646, Cisley in 1660, and Christopher in 1682: to which plea Sir William Domvile, then Attorney General of Ireland, made a special replication that said Christopher was outlawed on account of the rebellion in 1641: which record depended before the Court till 4 May, 1686, when judgment was given as above, which judgment said Levings herein thinks was unwarranted, and that in view of said present Bartholomew's treason a grant of the premises may be made as hereinabove at 9l. 2s.d. per an. rent, being the quit rent payable thereout by adventurers and soldiers for lands in that province.
