writing that of the 27th ultmo. I receiv'd a letter from Sr. Chaloner
Ogle of which a copy is here inclos'd (? encl. viii. 27th March) in
answer to mine of the 8th (? 18th, encl vi. 27th March) of ye same
month, which produc'd the declaratory sentence etc., enclosed.
Sir Chaloner being expected on this side every day, I shall put it
into his hands, that he may proceed in this matter according to

101. i. Deposition of John Harris. 3rd April, 1732. Repeats
and amplifies deposition of 2nd March (v. 27th March
encl. iii.) stating value of goods plundered from his sloop.
The master put on board by the Spaniards destroyed all
his papers, including bonds, receipts, journals and notes
of hand. The damage in wages and loss of time of the
sloop amounts to £60. Deponent was not released from
confinement on the main guard, or see any Englishman,
for ten days, when one Garvy from Jamaica arrived etc.

101. ii. Declaratory sentence for the sloop Mary by the Judge
of the Vice Admiralty Court, Jamaica. 3rd April, 1733.
The taking the said sloop out of Port Morant harbour
and the barbarous and cruel usage John Harris, the
master, received, the carrying him and his said sloop
into St. Jago, on Cuba, and the detaining him some
time there as prisoner, the taking several and embezzling
the goods on board the said sloop, and the extorting
port charges from him etc., was a piratical act committed
by some of His Catholick Majesty's subjects commissioned
by the Governor of St. Jago etc., and that the same
is contrary to the several treatys of Peace and Amity,
as also of Commerce now subsisting etc., and a high
violation and infringement thereof, and that satisfaction
ought to be made to the said Harris not only for the
damage he received for the capture of his said vessel, but
for the irreparable injury done to his person by the
wound he received, whereby he has lost the use of his arm.
The whole value of the damages sustained by the master
of the said sloop and of the several goods, as they are
specified in the above written affidavit duly sworn before
me amounts to £273 3s. 9d. of current money of Jamaica,
and that no proof of the value of the other goods
mentioned in the said affidavit hath as yet been made

102. Matthew Concanen to the Duke of Newcastle. May it
please your Grace, I take the liberty of acquainting you that I
arrived here the first of March, and as soon as the Governour came
to Spanish Town, from the north side of this island, where he then
was upon an expedition against the rebellious negroes, I waited
upon him with your Grace's commands. I need not assure your
Grace that he paid a proper respect to your letter. His politeness
and good sense are I believe too well known for your Grace to
doubt it etc. Excuses himself for having been prevented from
attending him for his last leave etc. Refers to his predecessors and
some "injurious ribaldry" published about him at the time of
his Grace's "appointing me to this place." Suggests that in
filling up this place, his Grace's behaviour "has been infinitely
more justifiable and praiseworthy than the practice of most of your
predecessors. In the first place, your Grace has employed a man
who, from the malice of his enemys, your Grace must think, can
write : whereas not one in ten of your Grace's predecessors, had
ever any reasons to believe that the persons they trusted in this
office could read. In the next place I must congratulate your
Grace upon breaking thro a scandalous custom used by some of
your predecessors of leaveing this office to the disposal of some
favourite servant or underling dependant, who generally farmed
it to somebody here for a yearly income, without any regard to
the principles, capacity or character of the tenant etc. Asserts his

106. Governor Johnson to the Council of Trade and Plantations.
I was very well pleased to consent with H.M. Council and
the Lower House of Assembly to the sending home Mr. Yonge,
who will present this to your Lordships, and is to waite on you and
to inform you clearly of the reasons that induced us to pass the
bill for remission of the arrears of quit rents, which we are informed
has undergone your Lordships' censure. The objections sent
home by Mr. St. John the Surveyor Gen. I must acknowledge if
they had been true might very justly have induced your Lordps.
to have reported for the repeal of it ; But the facts by him alledged
(if the account I have of them be as they are sent to me) are all
false, as Mr. Yonge will be orderd to demonstrate to your Lordps.,
and as for the patents which by that law are made valid tho'
before apprehended to be defective, I have taken care not to carry
that part into execution until I should be informed of H.M.
pleasure about the law, so that in no colour or way whatever can
H.M. revenue or interest suffer by it, but on the contrary the
time is now near elapsed that is given the people to record their
titles and I believe most have done so, and many paid their rents
in Proclamation money so that the thing intended for H.M.
service by the said law that is the perfecting a rent roll will be
obtained. I shall not detain your Ldps., but leave it to Mr. Yonge
to acquaint that those people that have most complained against
the ingrossing lands, which they charged to be the consequence of
making good the patents have chiefly been induced to that complaint
by a prospect of gain to themselves, they being no sooner
informd that the act would probably be repealed but they combind
themselves into a company and ran out those very lands, purchasing
poor peoples' warrants for a triffle, and are now gone to
sollicit for grants for them from H.M. as they give out, and have
by their notary and lawyers threatned me very hard for refusing
to give them grants here. I beg your Lordships will be pleased
to allow Mr. Fury and Mr. Yonge a candid and patient hearing
on this affair etc. P.S. I have pursuant to H.M. Instructions
published his orders for putting in force the Summons law and to
revoke the act for regulating the Courts of Justice. Signed,

Since my former relating to Port Royal, a sloop of Providence,
but lately at the Havana arriving here, and being informed
that the Master had something material to inform me of ; I had
him before H.M. Council, where being examind he swore to the

111. i. Deposition of Nathaniel Coverley, master of the sloop
Batchelor. 10th April, 1733. Sent in December to the
Havana with a packet from Mr. Colebrooke of Providence
to Mr. Nicholson factor there, the latter informed
him that three 60-gun ships of warr were then fitting
out in order to destroy the fort at Port Royal in S.
Carolina, and that there was an inbargo layd on all
vessels in that harbour etc., to prevent any intelligence
being given etc. Deponent was asked whether the fort
at Port Royal was built on the South or North side of
the river, and he said it was on the North. It was the
common report that the Spanish ships came from La
Vera Crux, with a great treasure of silver and other
money. The Captain of a Rhode Island man told him
that great part of the said treasure was landed.
Deponent told them that the bar at Port Royal was
very dangerous, and believed that if 20 of their ships
came there, none would go back again. There was a
stop put to the said expedition, and the landed treasure
taken on board again, which deponent believes was
occasioned by his saying the fort was built on the north
side of the river etc. The said ships did sayle while he
was there, one to Old Spain, the other two to the coast

account whatsoever. This gives me an opportunity of wishing

small employment which I used the freedom to sollicit your
Grace for in favor of Mr. James Wedderburn, a younger son of Sir
Peter Halket Wedderburn's, formerly a Member of Parliament for
the County of Fife, and a faithfull friend to the Protestant
Succession as can be well attested by his successor Sir John
Anstruther, is Clark of the Pleas in South Carolina, which allwise
gos along with twoo small patent places which patent I bought of
Mr. Lowndes for said Mr. James Wedderburn, viz. Clark of the
Crown and Clark of the Peace in South Carolina, the former being
in the gift of the Crown, makes me to presume to trouble your
Grace with this sollicitation, it has no sallary from the Crown only
small fees of office not worth asking for if Mr. Wedderburn were
not possessd of the patent for the other twoo small offices, and as
he is a gentleman of merit and capacity who had lately a great
loss in trade by the failing of his correspondent in London, I
humbly hope that I shall not be refused soo small a favor for him,
the election of that county being very much in his father's power
who is my relation and a sincere friend to Sir John Anstruther etc.
