merchant and owner of the ship Abercorne, shewing
that said ship sailed from Londonderry to Port
Royal in Carolina, arrived in May, 1685, and there
laded timber for Barbados, but petitioners and all
the passengers falling sick and 29 dying thereof, they
put to sea for safety and the men falling weaker they
bore up to Virginia to save their lives, and in Aug., 1685,
arrived at Protoxon [Patuxent] River, in Maryland,
where the master died and Mr. Scott used all his
endeavours to get the seamen to sail, he fearing seizure
by reason of some Irish manufactory aboard, but he
could not induce them and so they were necessitated
to stay; and were advised by some to unlade their
goods privately without intention of sale, which was
a design, for as soon as they took said advice Col.
Dornell and Major Shewell seized the ship and
goods, made themselves judges and without calling
in a jury condemned the ship and goods, nor would
they sell same to petitioner at their own appraisal:
therefore prays satisfaction for such loss and cruel
usage. |

He does not think it necessary that the summons
should be recalled on this occasion, but that the
Convocations meet according to the same and that
there be a supplemental privy seal to justify your
warrant and summons and their election and proceeding according to their charter and ancient
usages. Please therefore proceed on the summons
you have issued, and such a supplemental privy
seal as above shall be passed. |
