Hepburn against Portmore.

After hearing Counsel, as well on Saturday last as this Day, upon the Petition and Appeal of the Reverend Mr. Thomas Hepburn the King's Presented to the Parish of Aberlady, complaining of Two Interlocutors of the Lord Ordinary in Scotland, of the 19th of November and 15th of December 1768; and also of an Interlocutor of the Lords of Session there, of the 9th of March 1769; and praying, “ That the same might be revered, varied, or altered, or that the Appellant might have such Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet;” as also upon the Answer of Charles Earl of Postmore put in to the Said Appeal and due Consideration had of what was offered on either Side in this Cause:

Interlocutors affirmed.

It is Ordered and ADJUDGED, by the Lords Spiritual and Temporal, in Parliament assembled, That the Said Petition and Appeal be, and is hereby dismissed this House; and that the said Interlocutors therein complained of be, and the same are hereby affirmed.

The Answer of Patrick Lord Ellibank and others to the Appeal of Sir John Gordon of Invergordon Baronet, was this Day brought in.

Cosham Ma-Dor. Grant of, to Methuen, Bill.

Hodie 2a vice lecta est Billa, intituled, “ An Act for enabling His Majesty to grant the Inheritance in Fee-Simple of the Manor of Cosham, in the County ofWilts, with the Rights, Members, and Appurtenances thereof, now held under a Demise by Letters Patent under the Great Seal of His Majesty's Court of Exchequer, in Trust for Paul Methuen Esquire, unto the Said Paul Methuen and his Heirs, upon a full and adequate Consideration to be paid for the same.”

Ordered, That the Said Bill be committed to a. Committee of the whole House:

Ordered, That this House be put into a Committee upon the Said Bill on Wednesday next.

Blackbourton Enclosure Bill.

The Lord Viscount Wentworth reported from the Lords Committees, to whom the Bill, intituled, “ An Act for dividing and enclosing. certain Open and Common Fields, Common Pastures, Common Meadows, and Commonable Grounds, in the Parish of Blackbourton, in the County of Oxford,” was committed: “That they had considered the Said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.”

Derby Hills Enclosure Bill.

The Lord Viscount Wentworth made the like Report from the Lords Committees, to whom the Bill, intituled, “An Act for naturalizing John Gottfried Hanman was committed.”

Tunstall, &c. Road Bill.

The Lord Viscount Wentworth reported from the Lords Committees, to whom the Bill, intituled, “ An Act for repairing and widening the Road from Tunstall, in the County of Stafford, to Bosley, in the County of Chester, and from Great Chell to Shelton, in the Said County of Stafford," was committed That they had considered the Said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.”

Hanman's Nat. Bill.

The Lord Viscount Wentworth made the like report from the Lords Committees, to whom the Bill, intituled, “ An Act for naturalizingJohn gottfried “Hanman” was committed;

Sir Thomas Chamneys I eave for a Bill.

L. Milton et al Leave for a Bill.

After reading and considering the Report of the Judges, to whom was referred the Petition of the Right Honourable Joseph Lord Milton and others praying Leave to brine in a Private Bill:

It is Ordered, That Leave be given to bring in a Bill, pursuant to the said Petition and Report.

Bill read.

Hodie 1a vice lecta est Billa, intituled, An Act for vesting the Fee-Simple and Inheritance of certain Lands and Hereditaments in the Parish of Winterborne Clenston, in the County of Dorset, in Trustees, for the Right Honourable Joseph Lord Milton and his Heirs, discharged of the several Charitable Uses to which the same now stand limited, and, in Lieu thereof, to subject and charge the same, and other Lands and Hereditaments in the same County, whereof the Said Joseph Lord Milton is seised in Fee, with the Payment of a Perpetual Rent-Charge of greater Value and for other Purposes.”

Luttrell against Netter-ville et Ux. Pleadings proved.

The House being informed, “ That Walter Sweetman attended, in older to deliver in Copies of Pleadings and Proceedings in the Cause wherein John Luttrell is Appellant, and Robert Netterville et Ux. are respondents:”

He was called in, and delivered the same at the Bar; and attested upon Oath, “ They were true Copies, he having examined them with the Originals in the proper Offices in Ireland.”

And then he withdrew.

Macleod et al. Against sir John Gordon et al Petition to amend Appeal.

Upon reading the Petition of Roderick Macleod and others, Appellants in a Cause depending in this House, to which Sir John Gordon and others are Respondents; setting forth, " That since presenting the Petition and Appeal in this Cause, and before their Lordships Order was served upon the Respondents, the Respondent Sir John Gordon petitioned the Court of Session to have the Appellant Roderick Macleod's Bond, in the Proceedings mentioned, transmitted to the Barons of the Exchequer, that the Sums thereby due might be recovered; and that Court, by Interlocutor 1st February 1770, “ ordained the Petition to be seen and answered, and the Answer to be in the Boxes against the 15th (then) Instant;” and the other Respondent William Gordon having likewise petitioned the Said Court, and his Petition answered, the following Interlocutor, 28th February 1770, was pronounced: “ Find that William Gordon the Petitioner is not barred from claiming his Share of the Jurisdictions Money, on Account of the Decreet obtained at the Instance of Mr. Charles Hamilton Gordon, the Petitioner's Father, against Mr. John Macledo, in respect the Said Decreet is void; and remit to the Lord Ordinary to proceed accordingly;” and therefore praying Leave, “ To amend their said Appeal by adding the above Two Interlocutors of the 1st and 28th of February 1770, they amending the Respondents Copy:”

It is Ordered, That the Petitioners be at Liberty to amend their Said Appeal as desired, they amending the Respondents Copy.

Irvine against E. Aberdeen et al.

A Petition of the Earl of Aberdeen and others, Respondents in a Cause depending in this House, wherein Alexander Irvine is Appellant, was prelected and read; settings forth, “ That the Proceedings in this Cause being very voluminous, and the Question of great Importance to the Parties, who cannot have their Counsel properly instructed to proceed in the Hearing on Friday the 23d of March, the Day for which it now stands;” and therefore praying, “That the Hearing of this Cause may be put oft to Tuesday the 3d of April next.”

And thereupon the Agents on both Sides were called in, and heard at the Bar:

And being withdrawn:

Ordered, That the Hearing of this Cause be put off to Thursday the 25th of this instant March.

L. Ellibanket al. against sir John Gordon; Cross Appeal.

Upon reading the Petition and Cross Appeal of Patrick Lord Ellibank, William Fraser of Balnain, Roderick Macleod of Cadboll, Charles Urquhart of Braelangwell, William Anderson of Udall, Mr. William Pulteney, formerly Johnston, Advocate, Henry Davidson of Tulloch, Alexander Fraser of Cidduthill, Hugh Rose of Aitnoch, James Crawfurd Writer in Edinburgh William Fraser of Ardochie, Kenneth Lord Fortrose, Mr. David Ross of Inverchasly Advocate, David Kofi Commissary Clerk of Ross, Roderick Macleod Writer in Edinburgh, and David Ross in Cadboll; complaining of Two Interlocutors of the Lord Ordinary in Scotland, of the 18th and 20th of December 1766, of an Interlocutor of the Lords of Session there, of the 11th of February 1767, and also of Two other Interlocutors of the Lord Ordinary there, of the 5th of July and 15th of November 1768; and praying, “ That the same may be revered, or that the Appellants may have such other Relief in the Premises as to this House, in their Lordships great Wisdom, shall seem meet; and that Sir John Gordon of Invergordon Baronet, may be required to answer the Said Appeal:”

It is Ordered, That the Said Sir John Gordon may have a Copy of the Said Appeal, and do put in his Answer thereto, in Writing, on or before Mondaythe 9th Day of April next; and Service of this Order upon the Procurators or Agents of the Said Respondent, in the Said Court of Session in Scotland, shall be deemed good Service.

Allett's Bill.

Hodie 2a vice lecta est Billa, intituled, “ An Act for, vesting the Two undivided Fourth Parts of Priscilla Allett (the Wife of John Allett Esquire), and of Alice Warner (the Wife of William Warner Gentleman), of and in the Manors or reputed Manors of Great Bourton and Little Bourton, and divers Messages, Lands, and Hereditaments, in the Parishes of Great Bourton and Little Bourton, in the County of Oxford, in Trustees, to sell and convey the same to William Frozen Gentleman, and for laying out the Money arising by such Sale in Three Pounds per Centum Consolidated Bank Annuities, to be secured and transferred in Manner therein mentioned.”

To return the Bill, intituled, “ An Act to enable the Bishop of Bristol to grant a Lease or Leases of a Close of Ground, commonly called The Bishop'sPark, in the Parish of Saint Augustine, otherwise calledSaint Augustine the Less, within the City of Bristol or the Suburbs thereof;” and to acquaint this House, that they have agreed to the same, without any Amendment.

Ipswich to Cleydon, &c. Road Bill.

A Message was brought from the House of Commons, by Sir John Wrottesley and others:

With a Bill, intituled, “ An Act for continuing the Terms and enlarging the Powers of several Acts of Parliament, made for repairing the Road from Ipswich to Cleydon, and several other Roads therein mentioned, in the County of Suffolk;” to which they desire the Concurrence of this House.

Poulton, &c. Small Debts Bill.

With a Bill, intituled, “ An Act for the more easy and speedy Recovery of Small Debts within the Parishes of Poulton, Kirkham, Lytham, and Bispham,

and Townships of (fn. 2)Preeshall and Stalmine, in the County Palatine of Lancaster;” to which they define the Concurrence of this House.

New Chappell, &c Road Bill.

A Message was brought from the House of Commons, by Mr. Burrell and others:

With a Bill, intituled, “ An Act for repairing, widening, and keeping in Repair, the Road from New Chappell in the County of Surry, over Copthorn, in the County of Sussex, through Lindfield to the Town of Ditchling up to the Top of Ditchling Bost Hills, in the said County of Sussex;” to which they desire the Concurrence of this House.

E Orford's Estate Bill.

Hodie 2a vice lecta est Billa, intituled, “ An Act for vesting a Messuage in Pall Mall, and the Pictures and Furniture thereunto belonging, in George Earl of Orford, discharged from certain Trusts created thereof, and for settling Freehold Lands in the County of Norfolk, of greater Value, in Lieu thereof, to the Uses therein mentioned.”

Sutherland Claim of Peerage, Committees of Privileges to meet on.

Ordered, That the Committee of Privileges to whom the Petitions of the several Persons claiming the Peerage of Sutherland, &c. stand referred, do meet on Wednesday next, in order to appoint a Day for hearing Counsel upon the said Claims, and that Notice thereof be given to His Majesty's Attorney General and the Lord Advocate for Scotland.

After hearing Counsel upon the amended Petition and Appeal of John Wilkie of Foulden Esquire, complaining of an Interlocutor of the Lords of Session in Scotland, of the 25th of January 1769; and of Three Interlocutors of the Lord Ordinary there, of the 26th of January, and 9th and nth of February 1769; and praying, “ That the same might be reversed, or that the Appellant might have such Relief in the Premises as to this House, in their Lordships great Wisdom, should seem meet;” as also upon the Answer of Samuel Simpson of Newlands put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Interlocutors affirmed, with Costs.

It is Ordered and ADJUDGED, by the Lords Spiritual and Temporal, in Parliament assembled, That the said Petition and Appeal be, and is hereby dismissed this House, and that the said Interlocutors therein complained of be, and the same are hereby affirmed: And it is further Ordered, That the Appellant do pay, or cause to be paid, to the said Respondent, the Sum of Sixty Pounds for his Costs in respect of the said Appeal.

Bromley's Bill.

The Lord Viscount Wentworth reported from the Lords Committees, to whom the Bill, intituled, “ An Act for empowering the Guardians named in the Will of William Throckmorton Bromley Esquire deceased, to make Sale of Timber growing upon Part of his Settled Estates, and for inverting the Money thereby arising in the Purchase of Lands for the Benefit of his Infant Children,” was committed: “That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to die House, without any Amendment.”

Ordered, That the said Bill be engrossed.

Caldecot's Bill.

The Lord Viscount Wentworth also reported from the Lords Committees, to whom the Bill, intituled, “An Act for discharging certain Estates from the Uses and Trusts thereof, created in and by an Act of Parliament, passed in the Twenty-eighth Year of His late Majesty's Reign, intituled, “ An Act for charging the Settled and Unsettled Estates of Gilbert Caldecot Esquire, with railing Money to pay his Debts and Incumbrances; and for limiting his Unsettled Estates to charged to the Uses of his Marriage Settlement; and for charging the said Estates to the several Uses and Trusts therein mentioned;” was committed: “That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made several Amendments thereto:”

Which Amendments, being read Twice by the Clerk, were agreed to by the House:

Ordered, That the said Bill, with the Amendments, be engrossed.

E. Roseberry against Fowlis et al.

Upon reading the Petition and Appeal of Niel Earl of Roseberry, complaining of an Interlocutor of the Lords of Session in Scotland, of the 6th of this instant March; and praying, “ That the same may be reversed or varied, or that the Appellant may have such Relief in the Premises as to this House, in their Lordships great Wisdom, shall seem meet; and that William Fowlis of Woodhall, and the other Heirs Substitutes, may be required to answer the said Appeal:”

It is Ordered, That the said William. Fowlis and the other Heirs Substitutes may have a Copy of the said Appeal, and do put in their Answer, or respective Answers, thereunto, in Writing, on or before Wednesday the 11th Day of April next; and Service of this Order upon the said Respondents, or upon their Counsel or Agents, in the said Court of Session in Scotland, shall be deemed good Service.

Palmes Leave for a Bill.

After reading and considering the Report of the Judges, to whom was referred the Petition of George Palmes Esquire; praying Leave to bring in a Private Bill:

Hodie 2a vice lecta est Billa, intituled, “An Act to empower the Justices of the Peace for the County of Devon to apply a Sum of Money, out of the County Stock, for the opening, making, and maintaining, a convenient and commodious Highway from the High Street in the City of Exeter, to the Castle of Exeter.”

Ordered, That the Said Bill be committed to the Consideration of the Lords Committees aforenamed:

Their Lordships, or any Five of them, to meet on Thursday next, at the usual Time and Place and to adjourn as they please.

Order for taking the Printer of the Middlesex Journal into Custody read.

The House was moved, “That the Order of the 9th of February last, for taking into Custody William George Edmunds, No. 73, Shoe Lane, Fleet Street, the Printer of “The Middlesex Journal, or Chronicle of Liberty, from Saturday, February the 3d, to Tuesday, February the 6th, 1770,” might be read:”

The Said Order was accordingly read by the Clerk.

Usher of the Black Rod examined.

And the Gentleman Usher of the Black Rod was tolled upon, and examined at the Bar, as to what he had done in consequence of the Said Order and acquainted the House, “That he had used his utmost Endeavours to attach the Said William George Edmunds, but had not been able to take him; that he had applied to Sir John Fielding for his Warrant to break open the Doors of the House of the Said William George Edmunds, Who, he had Reason to suspect, locked himself up; that Sir John Fielding offered him every Assistance, but declined granting a Warrant, as the Said William George Edmunds lived out of his Jurisdiction.”

Whereupon,

Means For making such Orders more” effectual to be considered.

Ordered, That the Lords Committees for Privileges do meet Tomorrow Morning, to consider of proper Ways and Means for making the Orders of this House, for taking Persons into Custody, more effectual, and report their Opinion thereupon to the House.

Adjourn.
