Prayers.

Privilege against Jurisdiction of Lords-Sherley v. Fagg.

A MOTION being made on the Behalf of Sir John Fagg, a Member of this House, That he is served with an Order of the House of Lords, made on the Petition of Thomas Sherley Esquire, to put in an Answer to the Petition on Friday next;

And the Opinion of the House being desired, Whether, by his Privilege, as a Member of this House, he is not excused from answering the Petition in the Lords House;

And a Precedent being urged in the like Case;

Ordered, That the further Consideration of the Matter touching the Privilege of Sir John Fagg, a Member of this House, be adjourned till To-morrow Morning.

And it is referred to Sir Trevor Williams, Mr. Hales, Sir Robert Carr, Sir Anth. Irby, or any one of them, to inspect the Journals; and give an Account to the House, of the Precedent in the Case of Mr. Hales.

Privilege.

Complaint being made of a Breach of Privilege, committed against Col. Kirkby, by an Arrest made of Robert Dunbarr, Servant attending the Person of the said Col. Kirkby; and detaining him Prisoner in Execution in the Gate-house, at the Suit of George Jenings, since the present Session of Parliament; knowing him to be Servant to Colonel Kirkby;

Ordered, That the Keeper of the Gate House do forthwith release and discharge the said Robert Dunbarr out of the Prison of the Gatehouse.

Lewis's Estate.

A Bill to enable the Executors of Edward Lewis Esquire to sell certain Lands in the Counties of Glamorgan and Monmouth, was read.

Resolved, &c. That this Bill be read a Second time.

Tayer's Estate.

A Bill for Sale of Part of the Estate of Robert Tayer Gentleman, was read.

Resolved, &c. That this Bill be read a Second time.

Newcastle Election.

A Petition of Sir John Bowyer Baronet was read; complaining of several undue Practices used in the Election of Leveston Gower Esquire, to serve for Newcastle Underline, in Injury of the Petitioner.

Resolved, &c. That this Petition (if it be not excluded in point of Time) be referred to the Committee of Privileges and Elections; to examine the Matter; and report it, with their Opinions therein, to the House.

A Bill for Selling of Lands, for the Payment of the Debts of Alexander Davyes Gentleman, deceased, was read the Second time.

Privilege-scandalous Words.

Complaint being made, on Behalf of Sir Thomas Littleton, of a Scandal and Aspersion cast upon him, and dispersed abroad, of his tampering with, and promising Money to, Thomas Salter, lately ordered to be summoned to give in his Testimony, in the Matter relating to the Lord Treasurer;

Ordered, That the said Thomas Salter be sent for to give an Account to the House, in the Matter before-mentioned.

State of the Navy.

The House then resumed the Debate of the Matter concerning the Navy, according to the Votes made Yesterday: Which being debated;

Resolved, &c. That a Bill be brought in, to appropriate that Part of the Revenue that arises by the Act of Tonage and Poundage, passed in the Twelfth Year of the King, to the Use of the Navy, for Three Years, if the Duties granted by that Act shall so long continue.

And it is referred to Mr. Garraway, Mr. Vaughan, Sir Nich. Carew, Sir Cha. Wheeler, Sir Wm. Coventry, Sir Tho. Littleton, Mr. Powle, Colonel Birch, Sir Cha.
