Instructions from Treasurer Danby to the Customs
Commissioners in reply to their presentation of the
12th inst. 1. Your solicitor is to know from time
to time what warrants I sign for stay of process
against debtors for Customs, and to have copies
thereof before they be executed. 2. I intend
that the case of Mr. Miller, Collector of Customs
in Carolina, shall be laid before the Committee
for Trade and Plantations as it has been represented
here to the end the Lords of said Committee may
desire the Proprietors of that Colony to send for
said Miller, with the charge and proofs against him
[for same] to be examined by his Majesty and in the
meantime that you depute Seth Southwell to collect
in the room of said Miller, but his deputation to
cease in case upon examination Miller be thought
fit to be sent back. 3. I will advise with Sir John
Shaw, the Collector inwards, London port, about
the difference between Mr. Agberow and the rest
of the patent leadwaiters as to his sharing in the
bill money abovestairs. 4. Send Mr. Sansom
forthwith down to his charge at Bristol, and to
attend the execution of the commission going
down thither to examine the evil practice of filling
up Prizage wines. When Mr. Younger's witnesses
shall have come up from Poole (which Younger
has not yet produced nor fixed a time for) you are
to send for Sansom again to be heard as to said
Younger's accusations against him. 5. You are
to manage, collect and levy the new Additional duty
lately granted to the King upon wines and vinegar
in such manner as you were authorised to
manage, collect and levy the lately expired impost
and as by the Act of Parliament lately passed
for granting that Additional duty is directed. "But
this authority from me which is to take effect
from the 1st inst. is to cease when his Majesty's
commission under the great seal shall be issued
for managing of the same revenue."

Reference to the Customs Commissioners of the
petition of Robert Harwar, late waiter and storehousekeeper
at Chester, with a recommendation
for his employment in some of the outports at the
next vacancy : petitioner praying restoration to
his office or for some new employment, being 74 years
old, poor, with a sickly wife and three children,
having been an officer of the Customs for 39 years,
was never found in fault before, this being no fraud
but neglect. Mr. Ball, surveyor [of said port] was
as guilty and is restored.

for a great seal for a grant to Sir Walter St. John,
Bart., Sir Richard How, Kt. and Bart., Sir Ralph

quarterly from Midsummer last out of the Hereditary
Excise ; and with power for striking tallies and
other covenants and clauses for the due payment
thereof as are contained in the grants to the goldsmiths :
all in trust for Edward Henry, Earl of
Lichfield, for life and after his decease for Charlotte,
Countess of Lichfield, his wife, for her life and after

with proviso that this grant shall cease and be void

Royal warrant to Charles Bertie to give acquittance
to Richard, Visct. Ranelagh, for the sum of 4,128l. ;
the Earl of Essex when Lord Lieutenant of Ireland,
having in pursuance of the King's letter of 1677,
July 24, required said Earl of Ranelagh, Vice-Treasurer
of Ireland, to pay and return [i.e., forward
to England] said sum to said Bertie for the further
carrying on of the buildings at Windsor ; a further
royal warrant of Jan. 1 last having also directed
the said Vice-Treasurer to make payment of the
said sum without deducting anything thereout
upon account of the charge of exchanging the same
from Dublin to London "which we are informed
he hath accordingly done... And because
we have supplied our building at Windsor with other
moneys, we do hereby will and require you [Bertie]
to pay the said sum of 4,128l." to Dr. John Taylor,
who is appointed to receive the same from you.
Appending : (a) Memorandum : The above mentioned
sum of 4,128l. was paid to Dr. Taylor the
25th day of August (altered to March), 1678, and
his acquittance for the same endorsed upon the
original warrant in these words "Received this
25th day of Aug. (altered to March), 1678, of the
Honble. Charles Bertie, Esq., the within mentioned
sum of 4,128l. in pursuance of his Majesty's warrant
within written by me Joh. Taylor. Signed in the
presence of Sam. Langford."
(b) Copy of said royal warrant of Jan. 1 last (said
date being altered to Jan. 1 from 1678, Aug. 20) to
said Earl of Ranelagh to so pay said 4,128l. without
deducting the charge of exchanging the same from
Dublin to London, which "we have been since
informed" will amount to 400l. or thereabouts,
which if deducted will so far lessen it as to make
it unable to answer the use to which the King designed
it. The said cost of exchange is to be charged by
said Ranelagh [upon], and to be allowed to him in,
his account of the 27,000l. reserved to the King's
disposal out of the revenue of Ireland for the present
year ending Dec. 25 next.

Warrant from Treasurer Danby to the Wine Licence
Commissioners to discharge Edward Hutchinson
and his partners (one Mr. Edmd. Thompson, a
merchant) of the arrear of 123l. 14s. 0d. due to the
King from them as Farmers of the Wine Licences of
the city of York for the years 1672 and 1673, and
[as farmers of same] for several towns in co. Yorks
for 1672, 1673, and 1674 : and to deliver up their
bonds : it appearing that of their rents amounting
for the whole term to 1,383l. 4s. 6d. they have
paid 1,259l. 10s. 6d. : the said Wine Licence
Commissioners having (upon said Farmers' petition
for deductions) reported that "the late Lord
Treasurer Clifford (after the petitioners' farms
were taken) by his instructions dated 1673, May 24,
commanded the then Commissioners of the Wine
Licences to break all contracts before that time
made if they could break the same, and to let licences
at lower rates, whereupon the petitioner consented
that his said contracts should be broken, but the
Commissioners who were sent to put the said instructions
in execution refused to break the same, and
tied the petitioner to the several rents, which by
his contracts he was obliged to pay, though he could
not make the same rents after the publication of the
said instructions : and the said Commissioners did
let licences in many of the places contracted for
by the petitioner at lower rates than by his contract
he was obliged to pay : by means whereof (you
report that) the petitioner hath been at losses about
200l., besides the loss of his time and other
expenses, and you do find that the then Commissioners
put the petitioner upon (and before the
determination [thereof] stopped) a suit against
one Pawson which he affirms cost him about 30l.,
and thereby he lost all his charges [therein]."

report on said Emperor's petition that on April 19
last he ordered his correspondent at Rotterdam
to ship off 4 bags of nutmegs containing 110lb.
each, and on the 22nd [of said April] by letter
from Norwich he advised the Collector's clerk
at Yarmouth thereof, and praying him to write
to the Customs Commissioners, London, for a licence
to import same, "the said clerk received the said
letter and the next Custom House day (which was
three days after his receipt of it) filed the same
in the Custom House to give notice to the officers
concerned therein and the same day filed up a licence
and sent it to the Post House to come up to you"

nutmegs arrived the 28th of the said month before
petitioner could possibly obtain said licence :
whereon the said Commissioners report that they
think it a very hard case that the officers should
insist on the seizure.

to the king of such prizes, and for bringing all officers,

Fanshaw, Esq., James Symes, and Joseph Embrey,
gent., to receive all moneys and profits arising
to the King from prize ships and goods taken in
the two Dutch wars : they to pay the same from
time to time to such persons and for such services
as the King by his sign manual shall appoint : with
power to them (by the approbation of the Lord
Treasurer) to make any composition or agreement
with any persons chargeable to the King in respect
of the premises : their acquittances to be an
effectual discharge : the present appointment
being made by reason that because of embezzlements,
concealments or other fraudulent or indirect
practices the King has not been duly answered
the value, proceed or effects of several prize ships
and goods which were taken in the said two wars
and were brought into the ports of London, Portsmouth
and Hull, and by reason also that several
officers and others employed in the affair of the Prizes
in the said ports have not yet duly accompted
for moneys received thereon ; also that several
sums of money were imprested, paid or deposited
upon accompt to several treasurers, receivers
and clerks or others for services relating to Prizes
in said ports which are likewise yet unaccompted

and authority to Edmond Joddrell, a copyholder
within the royal manor of Macclesfield, co.
Chester, to fell, cut and grub up all such decayed
wood, underwood and trees standing or growing
upon his copyhold land within said manor and to
sell or dispose of same to his own use without being
liable to forfeit the double value upon the decree
as follows, or to be otherwise accomptable to the
King or his heirs ; provided that no timber trees,
or saplings like to prove timber, be cut or employed
[as fuel] for the making of iron as follows : and
likewise to give said Joddrell and his heirs licence
for 21 years to dig, get and take iron stone or iron
mine within the said lands for his and their own use
and profit, so as the same be done with the least
prejudice that may be to the King's inheritance :
the said Joddrell having petitioned the King setting
forth that by an agreement decreed in the Court of
Exchequer at Chester, the copyholders of said
manor may cut down any wood or timber or other
trees on their copyhold lands or tenements for
repair of their houses or [similarly they have the
right] to sell [such timber] to any tenant of the
said manor for repair of his or their houses within
the said manor and not elsewhere, and that if
any copyholder cut and sell trees in any other
manner, he shall forfeit double the value of the
trees sold : and further setting forth in his petition
that he has much brambles, brush or underwood
timber and other trees growing on his said copyhold
in no wise fit for building or reparations,
the timber trees being aged and decayed : and
further that he has received some encouragement
of finding iron stone within the same land, and
therefore prays liberty to cut, etc., and dig, etc.,
as above, and to erect a furnace for melting down the
same : on which petition the Surveyor General
has reported that the land may be of better use
when the said wood is cut down, and that the iron
stone may be got and carried away without damage
to the King's inheritance, provided ut supra.
